They have requested additional time to develop their case which reeks of desperation/clutching at straws. This is all heard in Stockholm. I reckon they will be denied the time plus if they cant prove new case law guidance is needed by the Supreme Court or a miscarriage of justice has occurred we could hear back well within the SC decision limit of one month

Agree WTM — they’ve got nothing new and this will be thrown out as per the previous appeals.

In the interim while we are waiting, it would be good to hear more on Talnode—Si as MT said an update was coming ˋsoon/shortly´ at the last investor webinar, which was approx 4 weeks ago — so might be close now after his visit to Europe.

In the interim while we are waiting, it would be good to hear more on Talnode—Si as MT said an update was coming ˋsoon/shortly´ at the last investor webinar, which was approx 4 weeks ago — so might be close now after his visit to Europe.
My gut is that this is also tied to the permit.

He said the Talnode Si project would be underpinned by an offtake, and there is no feedstock without the permit.

The news flow is going to be quite something once the SC doors slams shut!

All just opinion.

Yeah all roads lead back to the mine permit!

Having said that, it hasn’t prevented Talga announcing non—binding offtakes with ACC & Verkor for Talnode—C. Therefore, it is possible a customer could be linked to Talnode —Si before the Supreme Court verdict.

I do recall MT saying in the webinar that he wants to bundle the customer, offtake, financing and site location first before we hear publicly; so it will take some time to get all the ducks lined up.

I'm surprised the SP has held up today. I thought a lot of people hoped no appeals would be lodged and spit the dummy when they were!

I thought it was a high probability they would lodge an appeal, but I actually don't know what happens next!

I wasn't expecting them to just ask for more time. I wonder if that works at the supreme court? I can understand it worked in the court of appeals, they were only given 3 weeks to read the decision (which from what I understand is quite long, addressing all of the points), and to compare that to the evidence submitted might take time.

But they just had 4 weeks, and there's not much to assess from an outcome of "your appeal was denied". The process wasn't that detailed in the court of appeals. Surely 4 weeks is enough to simply state "I believe this could be case law or an extreme miscarriage of justice because xyz". There's not really extra evidence to collect. So theoretically they might be told "tell us why 4 weeks wasn't enough, otherwise denied".

On the other hand, I feel like the courts want to give everyone their chance to have their say. They don't care how long the process takes, they just assess other cases while a new deadline passes. So to give everyone a chance to have their say they may just give them an extension. If they do, I expect the lawyers will submit something. They won't win, but by submitting they'll be able to extend the process longer, which at this point is all they can do.

I'd have a Kings Counsel specialising in Environmental Law plus a couple of barristers to brief him/her plus a phalanx of solicitors and two or three personal assistants and some little hottie ( yeah I'm sexist LOL) to calculate the amount of legal fees I'm going to be paying and to get the coffees each morning............

She is doing nothing but handle such cases. I guess they can't afford another lawyer because she probably does it for free. I agree, it's a case of 'you can try'. I would have managed such an appeal as an engineer, 10 minutes of googling and not giving any reasons and just attaching a request.

Please please please give us more time!
We're already squeezing the mushrooms we've found as hard as we can. Really! This is hard work of environmental protection. But no reason has yet emerged from the mushrooms as to why there has been a major miscarriage of justice.
In the meantime, we have dried the leftovers and rubbed them over our pasta. So now we need more and we need time for that. We are convinced that if we try the same thing again, a different result will come out and we will finally find the reasons to question the justice, which of course is not directed against you, Your Highness, but against the others from the other court.

So to short summarise my plea: We are desperate because everyone is only thinking about themselves and talking about the really not green Green Transition and the not green Green Deal and about so called global warming, but we see ourselves in the right to focus on our wallets and besides we love our mushrooms and reindeer meat. We also distrust the science-based collection of laboratory data on water pollution. We also do not see the scientifically allegedly proven global warming as a focus here. Our mushrooms are important because we suspect in those the reasons why the court made a mistake. Talga just overlooked them and didn't press hard enough and therefore overlooked the reasons why the court made a mistake. We find that unfair. Please look after our interests and turn a blind eye. There's nothing wrong with it, everyone makes mistakes.

We will certainly find some if we press harder when we find new mushrooms. Don't be like that!
So please give us more time - our people are already there, but unfortunately we can't find any more rare mushrooms yet. Too bad, they tasted so good. But I'm digressing. Please do something about the genocide. And as Greta says, we must not allow green colonialism, even if it is about the so-called and not green Green Deal or the so-called climate change.

A loyal friend of the Green Deal, fan of the Green Transition and convinced that something urgently needs to be done about climate change.

I repeat: I wish Friday for Future, Extinction Rebellion, the Last Generation, environmental groups and activists would demonstrate Europe or worldwide for projects that are actually in their and our all interest. That would be active work for climate protection. So go out and demonstrate locally and convince people not to work against these projects because they are important for all of us, up to people who are drowning on their islands because everything is delayed.

Yeah all roads lead back to the mine permit!
Why I'm not doing so badly with the attempt at deadline extension:
Once this permit is final, anything that harms or impedes the mine is unlawful and illegal as a matter of national interest.
This could also be the reason why the court granted an extension in the last round. Once the spade is put in the ground by Bergstaaten for the opening ceremony the mine is automatically protected by law. Even a demonstration outside the gates to stop traffic would be illegal and the police obliged to remove the demonstration and the demonstrators automatically in the wrong. At least that's how I understand it.

The processing concession comes to mind again with Bergstaaten. That is still pending. Maybe they will attach it to the decision of the Supreme Court and everything will become legally effective at the same time and the head of Bergstaaten can perform the ceremony short after that.

I can imagine that after all this time, the financiers and customers just want to see that it has finally happened and then the knot will be untied quickly.

We have now been granted a reprieve until October 26 to develop the basics."

Disappointing that obvious, malicious stalling tactics are tolerated. They must still develop the basics? Crazy. The silver lining is that we're at the tail end of this, which will undoubtedly be the hardest permitting process Talga will go through. Talga are one of the first movers in a system that for years has been set in its ways, ossified with an apathy toward extracting its own minerals outside of iron ore, more than happy to rely on China.

We know the world is changing - every single day there is a new media report with alarms being sounded. Yesterday it was France removing subsidies on dirty Chinese EVs, today it was US Energy Secretary Jennifer Granholm in a closed-door meeting with other high-level government officials, executives and academics from over 50 countries, all stating how serious a threat China's outsized position in critical minerals has become. The way the courts operate currently is because of the way the world used to work. A changing world means that the courts will soon operate differently, the mold just needs to be broken in. Talga, being one of the pioneers in the green transition, are moving their way through the sludge that is the old mindset of the Swedish permitting system.

Future expansions will be backed by the CRMA, with a streamlined process that will break the back of these delusional NIMBYS. At that point, the floodgates open, especially on a company specific level. Talga could draw on their environmentally sound stage 1 operation as evidence for future expansions, showing the court real world data on an even larger scale to the trial mines that no negative impact on environmental/reindeer herding occurred. The NIMBYs are aware of this, which is why you often see them complaining about 3 other mines not being looked at all in one permit.

This is beyond frustrating, but sadly doesn’t surprise me. They haven’t complied with the requirements of the appeal, so why the fuck are they being given an additional 4 weeks to do what they were supposed to do within the last 4 week period?

The SC better pull their finger out and make rejecting this nonsense their number one priority after 26 October.
