In our case at least there is an actual asset in the form of Manono that can be used to negotiate some sort of deal for the award when we win at ICSID and DRC cant play being too-poor-to-pay card.

(ICSID Case No. ARB/23/18)

Case details:

Claimant: AVZ Minerals Pty Ltd

Year: 2025

Summary:

  • The DRC government failed to grant an exploitation permit (mining license) for the Manono Lithium and Tin Project in accordance with its Mining Code.
  • The DRC government failed to adhere to its mining code regarding AVZ's rights over the Manono exploration tenements (PR 13359), and
  • Cominiere (90% DRC govt owned) corruptly expropriated AVZ’s Manono tenement (PR13359), and on-sold 71% of the tenement to the equally corrupt Chinese miner, Zijin Mining. Cominiere retained 39%.
Outcome: The ICSID tribunal awarded AVZ Minerals $US20 billion compensation plus a further $US200 million in costs and exemplary fines.

So what's the total fines Cominiere have been ordered to pay so far from the ICC case? All court costs and 22,000,000?

$AVZ: Just an update we're getting closer to a government in #DRC after 6 months of waiting. The National Assembly (lower house of DRC's Parliament) now has elected all its leadership positions. See the below tweet form the Assembly's X account. Notable here is @moise_katumbi isn't following anyone. Autodesk_new's party as the largest opposition bloc (overall opposition is divided in DRC) with the position of Deputy Rapporteur- the "leader" of the Opposition- going to Dominique Munongo. (For us Anglos, I realize DRC's institutional set up seems pretty alien but it's a lot like France's if you need a reference) The next steps from here according to the Constitution:
1.@SuminwaJudith announces a Government 2. She then creates, negotiates (with the Presidency), and signs what is effectively an "operating agreement" (an "ordinance" in DRC legalese)- which basically lays the roles and responsibilities between the Government, its ministers and between the Govt vis a vis the Presidency. 3. She then creates and sends a "policy of the Nation" (ie, top policy goals of the Government) to the Parliament to endorse. 4. Parliament votes for the "policy of the Nation" (or not, we'll see). 5. Assuming the "policy of the Nation" passes, all gov't ministers + President release a list of all their assets/wealth and send to the Constitutional Court.

Once all this happens, DRC will finally have a government.

The Sacred Union announces the exit of the government this weekend

The composition of the Suminwa government will be known this weekend, almost five months after long political negotiations and the establishment of other institutions.

This was announced by Bernard Kayumba, member of the conference of presidents of the Sacred Union, the political platform of the head of state Félix Tshisekedi.

The final adjustments have been made, reassures Bernard Kayumba, who emphasizes that the representativeness of each province has been taken into account and certain leaders of the groupings will be part of this government.

“By Sunday at the latest, the Congolese population will be equipped with their team from the central government of Madame Judith Suminwa. :unsure: :rolleyes: 🙏 :rolleyes: :unsure:

Everything is ready.

There are no more gray areas and everything has been marked out, especially since all the groups have submitted the lists to the Prime Minister, who, in turn, went to see the head of the State for arbitration,” he said on Top Congo.

Before adding: “The political weight of each grouping, most of them members of the Sacred Union, was taken into account, but also the representativeness of each province.

There will be few moral authorities who will take part in this government.

Many will remain at the level of the Senate and the National Assembly.”

As a reminder, it was on April 1 that Judith Tuluka Suminwa was appointed to the post of Prime Minister by the Head of State Félix Tshisekedi.

The new Prime Minister organized, immediately after her appointment, a series of consultations with the different groupings and member parties of the USN -Sacred Union of the Nation-.

Consultations which were extended to different segments of the population through civil society organizations.

The government, once formed, must be invested by the lower house of Parliament, whose final office was installed on May 22.
