AGOA Summit: Julien Paluku pleads in favor of exporting mining products to the USA without customs duties​

The Minister in charge of Foreign Trade of the Democratic Republic of Congo (DRC), Julien Paluku, has advocated for the export of mining products to the United States of America (USA) without customs duties.

It was during his participation, last Tuesday in Washington (USA), in a meeting related to the American Act on Growth and Opportunity in Africa (AGOA) that Julien Paluku defended foreign trade in sub-Saharan Africa.

"I was received at the American Congress in Washington where I pleaded with national senators and deputies for the renewal of AGOA which allows eligible sub-Saharan African countries to export most of their products to the United States of America without customs duties," declared the Minister of Foreign Trade Julien Paluku.

The DRC has 26 exportable mining and non-mining commodities. This meeting, which is taking place in Washington, aims to promote mutual interests between the host country, the USA, and sub-Saharan Africa.

The DRC needs to pull their finger out and sort their shit out sooner than later - they are likely going to get a better outcome while the Democrats are in power with any agreement/negotiations. Should the Republicans get in, Trump is likely to drive a tougher deal that benefits America more than the DRC - he loves the deal.

Trumpy is not one to be blackmailed - it also seems there is a theme/undercurrent that the DRC are wanting support in their boarder wars which they are seemingly trying to leverage for outcomes in mining (Felix I suspect is playing off Europe/China/America off each other).

The DRC are going to do more harm to themselves by delaying positive outcomes for Dathcoms tenement while we progress through the ICSID / ICC and the potential swing to the Republicans - but Tim (time) will tell.

The DRC reaps what they sow - at the moment it is nothing for their poor and disenfranchised population. Dathcom will assist in growing wealth in the local community of Manono for the poor and destitute.

I'm not really buying the silence is golden approach more than two years down the track when AVZ have already called out the corruption and given how swiftly things are moving against us. Why aren't they publicly condemning things like this when the courts have ordered the reinstatement of our tenement and issued fines against the illegal actions of cominiere? Somebody or multiple peoples are feeding them bullshit behind the scenes without any action to back it up as Zijin move full speed ahead doing whatever they like which is validated through official channels like CAMI against stop work and court orders.

We are stuck with inaction due to legalities as the enemy carries on ignoring any and every legal protocol that's in place.

It's entirely possible I've lost the plot but ffs put some real pressure on these criminals. It feels like a slow motion train wreck.
Nobody is going to buy this if Zijin is already set up next door with control of all the electric, water and other infrastructure.

10 years of seeking damages through arbitration is looking highly likely.

Now delisted they are not bound to tell us anything so I don't expect it , we have been fucked over by the chinks and corrupt DRC and there is not a thing we can do about it but sit and wait , financially in trouble for some shareholders is zero concern for Zijin , DRC , AVZ management that's how I see it .

In April 2024, the ICSID ruled in favor of Swedish and Australian investors, ordering Gambia to pay damages for the unlawful expropriation of their tiger-prawn farming business. The case stemmed from actions taken by the Gambian government under former president Yahya Jammeh, which involved the direct seizure of the investors' aquaculture facility without compensation. Does that sound familiar?

The Tribunal awarded the investors approximately 95% of the damages they claimed, amounting to over £20 million ($AU39.3 million), along with interest at a rate of 8% from the date of expropriation until payment is made. Additionally, the investors were awarded full legal costs associated with the arbitration process. The Gambian government acknowledged the award, linking it to the previous administration's disregard for the rule of law and arbitrary decision-making practices.

As we are all aware, AVZ has a solid case against the corrupt DRC snake headed by Felix Tshisekedi. It just needs to remain sufficiently buoyant and engaged to see things through to completion.

Chemical accident in Lualaba: two NGOs warn of the consequences​

In the Lualaba province of the Democratic Republic of Congo (DRC), a tanker truck belonging to the COMMUS company and transporting sulfuric acid overturned on the night of Sunday, July 21, near the Kelangile River.

In a joint press release on Thursday, July 25, two Non-Governmental Organizations (NGOs) warned of the harmful consequences of this accident. They are Action for Integral and Sustainable Development (ADID) and Initiative for the Protection of Human Rights and Social Reintegration (IPDHOR).

They say they fear considerable damage to "aquatic ecosystems, including fish, crabs and plant species. Despite the ongoing identification of victims, some people are harvesting vegetables in the contaminated areas," the press release reads.

These two local civil society organizations stress the need to raze these fields in order to protect public health, destroy contaminated crops, decontaminate rivers and put in place preventive measures.

During a press briefing, held on Tuesday, July 23, on the government's reforms undertaken in the justice sector, the Minister of State in charge of Justice and Keeper of the Seals, Constant Mutamba, answering the question about the perpetrators of financial embezzlement and embezzlement of public funds, indicated that anyone who will divert a single dollar from the Congolese will have his place in Makala prison.

"The Head of State gave us the mission to crack down. We will therefore be intransigent and intractable vis-à-vis all diverters of the state's public money. Regarding the former Minister of Finance, Nicolas Kazadi Kadima, accused of embezzlement of public funds in the case of the purchase of drills and streetlights, the Minister of Justice made it known that "no one is above the law", while nevertheless evoking the principle of the presumption of innocence guaranteed by the country's Constitution.

"Alone the judge is authorized, in terms of our law, to be able to condemn someone for an offending fact. So, I wouldn't want to interfere in an ongoing instruction, "said Constant Mutamba.

In addition, the latter said he had set up a framework for consultation with the Attorney General at the Court of Cassation, in order to prosecute all cases related to embezzlement of public funds.
(Can only hope he follows through on his promise to review all files of corruption/ embezzlement sent to their office over the past 3 years).

Much more, the Minister also indicated that parallel investigation mechanisms against money laundering have been put in place. These mechanisms provide for unconditional confiscation of property, in accordance with Article 130 of the new Money Laundering Act.
