The land allocation allows access to the land - which is decided by the Chief Mining Officer in a special cadastral procedure
The land allocation determines the land required for the mine and the mining area. It also determines the right, ownership or lease of the land to be leased to the concessionaire.
The land allocation links the required land to one or more processing concessions and is valid for as long as the concessions are valid.
The decision on the allocation of land is usually based on an agreement between the concessionaire and the landowners. Land can be allocated against the will of landowners and rights holders, but this is unusual. It is always the landowner who decides whether the land is to be acquired or used with a leasehold right. If the division of the land is not based on an agreement between the parties, the Chief Mining Inspector decides on the compensation. The rules of the Expropriation Act apply to the determination of compensation. If necessary, two guardians from the village take part in the land allocation procedure."
