On August 19, 2021, the Minister of Primary, Secondary and Technical Education (EPST), Tony Mwaba Kazadi, gave his agreement to the international firm, in a 2017 project with the German company VERIDOS, to provide its expertise in the student identification project.

This project should make it possible to know the exact number of students in establishments, both public and private, across the entire national territory, with a view to accommodating the vision of the Head of State on the recovery of this sector.

After the Kinshasa authorities failed to comply with this contract with VERIDOS, the Germans filed a complaint before the Paris arbitration court.

On January 30, 2024, INCC sent a notification to the power of Kin Kinshasa on the complaint file, something which prompted Jean-Louis Esambo, special advisor on security matters of the President Félix Tshisekedi, to react by requesting the creation of a commission between both parties in search of a solution.

On January 17 of this year, the Paris Court notified the Congolese authorities of Jean-Louis Esambo Kangashe as special security advisor to President Félix Tshisekedi.

Just waiting for the DRC to respond to AVZ's request about changes to CAMI, which show Monono Lithium (Cominiere-Zijin JV) as the lease holder (PR 15775) over the top of AVZ's PR 13359 tenement.

If confirmed, this is a clear breach of ICSID Tribunal's Procedural Order #3 dated 16 January 2024, which among other things ordered the DRC to "refrain from taking, either through its officials, bodies, emanations or companies (...) any new act likely to call into question PR13359 or which could lead to an aggravation of the present dispute or deprive the award to be made of its effect".

The DRC's response will inform AVZ's next move about getting the ICC's daily penalties actioned.

Haven't AVZ already requested ICC fines to be paid/actioned?.

My understanding is that AVZ asked the DRC govt to explain the changes to CAMI in breach of the ICSID's emergency orders of Nov 2023.

The DRC govt provided the following response to AVZ: To date, the defence team, under the coordination of the Ministry of Justice, is working on drafting the briefs which must be filed before the Arbitral Tribunal on July 31, 2024, at the latest late. To do this, I intend to urgently bring this team together to explore all the options exploit in the best interests of the country.

A detailed report will be sent to you.

The letter the MoM wrote was to the Prime Minister, not to AVZ (AVZ received a copy only). It was in relation to the DRC's counter memorial that was filed on 31st July (you can see this on the ICSID website as the latest development).

AVZ had already asked ICC to liquidate the fines (have them paid). A hearing was held on that earlier and we are waiting on ICC to make a ruling.
This ICC ruling isn't waiting on anything ICSID.

The change at CAMI to show the 15775 PR being converted to PE would be investigated by ICSID separately to the ICC fines.
