You may cop some flak on this post, but I found it an interesting read. I think management rightly value CATH expertise, and seemingly other large scale strategic partners were unfathomably hard to come by, however I am very wary of Chinese intentions regarding Manono.

Also its a fair point on FT. Beyond our now dated inclusion in the battery council, and his statement stating that more Australian investment is welcomed, there has been little to suggest direct support from FT towards AVZ. Sure we are just a small blip on a much larger presidential mandate, and he's trying to navigate a complex environment whilst not shooting himself in the foot politically ahead of next elections, but you'd think his support would be more overt if it was truly firm. Does he believe AVZ have the capacity to underpin the battery endeavor on which he's placing so much political capital? Jury still out on that, IMO

I for one, and I think there are only two.... value the input of R2D2 and der giest. It was der geist who unravelled all this shit and (I believe) sold in the 90's on a matter of principle - that being, AVZ were very economical with the facts EVEN IF THEY THOUGHT IT WAS NOTHING TO WORRY ABOUT.

With all of AVZ’s woes coming to a head in 2022 in a business environment that is inclined to what we call ‘corruption’, it is reassuring CATH engaged AVZ for the TIA and did not abandon. HuaYou also did not sell its shares. Nor Bin Guo’s Lithium plus to my knowledge. Zijin’s proxy did.

Of course many of us are wary of Chinese involvement including management. When I met Nigel in 2019 at the Sydney RIU conference, he was very keen to head ‘West’. Some of us may recall the Swiss engagement and German as well. Even the GHG report signalled a lot, not least company statements on strategic locations.

But the reality was and is the Chinese partners have a well oiled machine to succeed in DRC. We know that.

This brings me to the point of this post which is not so clear to western audiences.

I want to draw your attention to lower case “the” in “the Ningde Era”. 宁德-时代, suggesting that this is CATL’s time, it’s dominion.

This is how the Chinese often use the word ‘Era’ 时代 ‘Shídài’. It is almost dynastic in connotation. In fact we probably have all intuited this fact but we just see it as marketing. But for the CCP and CATL, it really is the Shídài of CATL reflecting the Shidai of China in the world. It is a gigantic hiving entity that draws all the ‘nutrients’ supply chains in and around itself. When the domestic supply chain entities consider an IPO listing it is as a CATL supply chain entity.

Therefore for AVZ, CATH is a client of CATL. And, yes you guessed it, AVZ is an irritant regards to integration into it’s shidai.

Recall that CATL IPO listing commenced at a time the market was still heating up for lithium but in same month offical EV subsidy plans started to be leaked disconnecting lower range vehicles and lower energy density Li battery companies from the ‘boob’ hence a domino effect on supply and demand. (AVZ’s 37cps happened in January), but by June when CATL listed the market was in decline. (We know what Eckhof did signalling that, and despite we were (and are) waiting on BNB’s IPO plans to emerge + more.). Result is CATL worked to pick up cheap pickings including as you know Yibin looking to get a board seat on the cheap. 4.5cps was humiliating. Thanks to the Australian Government they didn’t get a board seat. If they did however, what would that do for the current politics on AVZ shoring up it’s mandate over Manono’s key real estate?

CATL probably doesn’t care. It is developing sodium batteries to take the heat out of the lithium battery market. By the time Manono is in production the prices could be lower. But they may still be higher than anything AVZ’s DFS imagined.

As we often rehearse in our mind when we think about jurisdiction risk, it is occasionally noted the Congolese know what depending on one external state does for its sovereignty. The ‘shidai hiving dragon’ needs careful resisting. And the USA really needs to see its client states and partners as ‘Americans’ too. The US needs to embrace AVZ more as one of it’s own just as it does with the 5 eyes.
Bin Guo, Shidai Hiving dragons, Ningde era....FMD, just use one nic ffs, this blatant multi nicking is like having to visit and endure a never ending dissocial / Bipolar Disorder meeting session, whilst they think everyones also a fool.

Congo's Supreme Court dismisses rival claim over AVZ's Manono lithium project​

AVZ Minerals Ltd. said May 8 that the Democratic Republic of Congo's Supreme Court of Justice dismissed a claim over the Manono project by previous license holder Manono Minerals Sarl.
The company signed a US$6 million deal in early February to acquire a 60% interest in the Manono lithium-tin-tantalum mine.
AVZ expects to receive a report from its legal advisers in Congo by the end of the week and to settle the acquisition May 21, it said.
In an April 6 release, AVZ said it applied to the Supreme Court of Western Australia to have a separate claim, which was filed by Mauritius-registered MMCS Strategic 1, permanently stayed.
In early March, MMCS Strategic 1 claimed that the cancellation of a license at Manono by the Congo Mining Registry in 2016 was invalid.
The company said it expects a hearing for the application to get the proceedings permanently stayed in two to three months.

Mauritius-registered private resources investment firm MMCS Strategic 1 has filed a writ in the Supreme Court of Western Australia to end a dispute between itself and Australian-listed junior resources company AVZ Minerals.

MMCS is seeking a declaration in regard to its legal ownership rights of the mining licence covering the Manono and Kitotolo lithium deposits in the DRC.

Amsterdam & Partners and cross-border transaction specialist law firm Clifford Chance have prepared the application to contest the claim by AVZ Minerals that it has entered into a transaction to acquire a 60% interest in the Manono project area, which effectively covers the licence area held by MMCS.


MMCS is a 68% direct shareholder in Manono Minerals, a JV between it and the DRC government-owned Cominière, which holds mining permit PE 12202 covering the Manono and Kitotolo deposits in the Katanga province.

According to the claim, in 2016 the DRC Ministry of Mines unlawfully revoked mining permit PE 12202 and issued a new permit covering the same area to a separate joint venture led by AVZ Minerals and also involving Cominière.

MMCS acted promptly to appeal the unlawful revocation of its Manono licence and this remains subject to proceedings in the administrative section of the DRC Supreme Court of Justice. Under DRC law, when an appeal is brought in relation to the revocation of a mining permit, the permit is deemed to remain valid until the appeal proceedings are concluded.

Nevertheless, AVZ Minerals has proceeded to publicly inform shareholders of its acquisition of this licence, which is being challenged by MMCS.

MMCS notified AVZ Minerals on 10 February 2017 that there are pre-existing claims over the Manono and Kitotolo lithium deposits. Subsequent to that notification, AVZ Minerals released a notice of a shareholder meeting and Manono due diligence update, which stated “the company has established a presence on site at Manono with a group of technical and support contractors” in preparation for planned drilling and sampling activity that had been previously delayed due to ground conditions.

AVZ Minerals also told the market it “is negotiating an extension to the previously agreed 60-day due diligence period with its joint venture partners” in regard to its acquisition terms and that “the company’s DRC legal adviser has commenced a review of legal matters including the validity of title in relation to the Manono project”, but the company’s JV partner (Cominière) had made standard representations and warranties with respect to the validity of title.

The shareholder meeting called by AVZ Minerals for 6 April 2017 will seek approval of several resolutions, including the terms of the proposed acquisition of the Manono project, the details of the up to $5 million in capital the company is seeking to raise for the acquisition and development of the Manono project, and the issue of facilitation shares to recently appointed executive chairman Klaus Eckhof.

Parties to the proposed acquisition are AVZ Minerals (60%), Cominière (30%) and Dathomir Mining Resources (10%).

MMCS will seek confirmation from the Supreme Court of Western Australia as to the ongoing validity of its existing licence. MMCS and its legal counsel consider the circumstances and events that led to the purported revocation of mining permit PE 12202 as highly unusual and exacerbated by the subsequent grant of rights over the same area to a new JV involving common parties. The WA Supreme Court is deemed to have jurisdiction given the fact AVZ Minerals is domiciled in Australia.

MMCS may pursue a number of avenues to explore legal remedies within local and international courts to enforce its existing rights over mining permit PE 12202 and to protect its intellectual property rights in regard to the Manono project, which is a high priority given the announcement that AVZ Minerals has commenced activities on the ground in the DRC, said the company.

Since the joint venture between MMCS and Cominière started in September 2013, MMCS has spent a total of $9 million on advancing the Manono project, including pre-feasibility study analysis and development of a local corporate social responsibility initiative.

MMCS spent 9 mill in what? 7 years? And got part way through a PFS. Give me a break. Greed standing in the way of progress. Sad
