JOINT PRESS RELEASE N°002/OSC/RN/11/2022 THE MANAGEMENT OF COMINIERE SA MUST STOP BLOCKING THE DEVELOPMENT OF MANONO AND UNDERMINING PRESIDENTIAL POLICY ENERGY AND DEVELOPMENT OF 145 TERRITORIES IN MULTIPLYING STRATEGIES TO BLOCK DATHCOM MINING. Kinshasa-Bukavu-Kolwezi-Lubumbashi, November 20, 2022. Our national civil society organizations specializing in resource issues natural resources in the Democratic Republic of Congo, signatories of this press release, invite His Excellency the President of the Republic, Head of State Félix-Antoine TSHISEKEDI TSHILOMBO and the Government led by His Excellency the Prime Minister Jean-Michel SAMA LUKONDE KYENGE to be concerned for the normal functioning of the Dathcom Mining SA joint venture to enable it to start producing Lithium in the territory of Manono and apply its community development policy according to the country's mining legislation and international standards. Our organizations are seeing unrest and maneuvering from some departments administrative and judicial authorities as well as Cominière SA with the aim of freezing the notification of the Dathcom Mining SA Exploitation License and communicate the total amount surface rights due to the State; this constitutes a serious prejudice not only for the party Congolese (Congolese State with its 10% of the shares returning to it by right as well as those of the portfolio company, Cominière SA), but above all for the population affected by this project mining which was already to conclude the Specifications for community development for combat current poverty; this also prevents the start of the construction works of the mine and the production of this popular mineral in the manufacture of electric batteries essential in the fight against global warming against which the DRC is positioning itself into a solution country for the global energy transition. Since September 2022, the General Management of Cominière SA, one member of which is supposed to sit in the Technical Committee for Monitoring the works of the rehabilitation project of power plants of Mpiana-Mwanga, launched a call for tenders claiming that the said power plants are to be abandonment. During a meeting organized by the communities of Manono on Saturday, November 12 2022 on Dathcom Mining SA, the delegate of Cominière SA has publicly declared that they have '' selected the Chinese group Zijin for the rehabilitation of the hydroelectric power plants of Mpiana- Mwanga within three years and unconditionally”, according to the information in our possession received of a participant in said meeting. While the official documents in our possession (including the ministerial decree of which we publish a copy in this press release) prove the contrary. The signatory organizations find in this one more unfortunate maneuver to block the start of the Dathcom Mining SA mining project which will contribute to the development of Manono and its surroundings in the province of Tanganyika as requested by His Excellency Mr. President of the Republic and His Excellency the Prime Minister through the ambitious grassroots development program for our 145 territories, with positive spin-offs and ripple effects on the provinces of Haut-Katanga, Lualaba, Maniema, Haut-Lomami, Lomami, South Kivu. Our organizations remind Cominière SA and the Ministry of the Portfolio that one of the reasons that motivated the government to sign the agreement with AVZ POWER SAU is the announcement made by this private company to rehabilitate the plants concerned in compliance with the laws of the country and the international standards in the sector in order to supply energy to Dathcom Mining SA for its mining operations as well as public and private schools and hospitals (health centers) in Manono and its surroundings without forgetting a quantity to be used by the State for the electrification of the city of Manono and Mpiana-Mwanga. This vision of things is part of the policy of development of His Excellency Félix-Antoine Tshisekedi Tshilombo, President of the Republic and Head of State, to electrify our villages and towns through public-private partnerships. After documented investigations with the Ministry which manages electricity in the Republic Democratic Republic of the Congo, our organizations have succeeded in establishing the following chronology of events known to Cominière SA that they wish to share with public opinion: -On June 04, 2019, AVZ POWER SAU sends a letter of Expression of Interest on a project hydroelectric development of the Mpiana-Mwanga site at least 87 km from the city of Manono in Tanganyika; -On June 13, 2019, there was a meeting convened by the Ministry of Energy sanctioned by a ‘’ Minutes of the meeting
n technique for the rehabilitation of the hydroelectric plant of Mpiana-Mwanga’’ written by the General Secretariat of the Ministry of Water Resources and Electricity ; -On June 21, 2019, a collective service order referenced No.ERH/SG/0/036/B9/NB/19, on government sends a technical mission on site to the Territory of Manono; -In July 2019, a mission "Report" carried out at the Mpiana Mwanga hydroelectric power station on the Luvua River as part of the rehabilitation project by the company AVZ POWER SAU from July 24 to 03, 2019 at the expense of the Project; -On July 29, 2019, there was a document referenced No. ERH/4/SG/0/08681/G9/LK/19 and entitled “Transmission Mission report – Mission carried out in Mpiana-Mwanga in the territory of Manono in the province of Tanganyika”; -On January 13, 2020, there was the signing of the “Protocol of Understanding between the DRC and AVZ POWER SAU in about the rehabilitation of the Mpiana-Mwanga I and II hydroelectric power stations by the Vice Minister of the Ministry of Water Resources and Electricity for the Minister. -On March 25, 2020, there was “Transmission of the feasibility study of the hydroelectric power station of Mpiana-Mwanga in the province of Tanganyika in Manono’’ at the Ministry of Resources Hydraulics and Electricity (Government) under reference 001/AVZP/MD/PERTH/03/202, followed by the acknowledgment of receipt on March 27, 2020. On October 30, 2020, there was an “Information Note for the attention of His Excellency Mr. Minister of State, Minister of Water Resources and Electricity” on the “Mission requested by the company AVZ POWER SAU within the framework of the technical and environmental assessments of the Mpiana-Mwanga hydroelectric power plant under reference RHE/4/SG/0/1321/G20/SMW/2020. -On October 30, 2020, there was “Transmission of the report of the service mission carried out in Manono in the province of Tanganyika” according to the referenced mission or service order RHE/0/SG/070/B9/SM/2020 of September 15, 2020” to support the technical agents of the companies Congo Energy SA, Blue Phoenix, Stucky, CREC 8, International Montage Maintenance SA, Zest Weg Group, Muama Business SARL Group, WD Power, Power Line, Africa Services DRC SARL, TBEA Hengyan Transformer Co. Ltd and Tramico SARL in connection with the valuations technical and environmental aspects of the Piana Mwanga I and II power plants, under reference RHE/4/SG/0/1322/G9/ALS/2020. -In October 2020, there was a "Mission Report" carried out in Manono by Engineer Timoleon EYUMA, a ministry official responsible for coordinating all the work. In December 2020, the General Secretariat of the Ministry of Water Resources and Electricity shared with the parties its “Mission Report” carried out, from November 24 to December 09 2022, at various sites in the Territory of Manono, in the province of Tanganyika for a comprehensive assessment with a view to planning the rehabilitation works of the power stations Mpiana-Mwanga I and II. - On January 22, 2021, the report of the service mission was sent to the Ministry carried out in Mpiana-Mwanga on collective service order No.RHE/4/SG/0/114/B9/SMW/2020 -29 JANUARY 2021, the Minister of Energy signed a Ministerial Order No.129/CAB/MIN/RHE/EMM/2021 of 29 on the “creation of a Technical Project Monitoring Committee rehabilitation of the Mpiana-Mwanga I and II hydroelectric power stations, in which a representative or delegate of Cominière SA.
