Hey I’m all in for a helmet fine in Thailand or Indo here and there but I do protest it and most of the time you just get a warning once you protest it… I guess that’s my way of stamping out corruption

Money laundering and financing of terrorism: the FATF grants three years of reprieve to the DRC and places it "under enhanced surveillance"

The Democratic Republic of Congo was finally spared from the sanctions of the Financial Action Task Force (FATF) which threatened to place it on the blacklist for the delay accumulated in the implementation of the recommendations relating to the fight against money laundering and the financing of terrorism.

At the end of a conciliation meeting between the two parties, held on September 8, 2022 in Livingstone (Zambia), the FATF granted a three-year reprieve to the DRC, while placing it under "enhanced surveillance".

In a press release dated October 3, 2022, the LICOCO (Congolese League for the Fight against Corruption) salutes the efforts of the DRC in the fight against these two scourges.

At the same time, LICOCO recalls that "when a country is placed under enhanced surveillance, this means that the country must quickly make a high-level commitment in writing, under FATF supervision, to resolve the shortcomings identified in the report. of mutual evaluation”.

One of the important recommendations of GAFI is the reform of the law on money laundering and financing of terrorism in the DRC.

The reform bill has been tabled in the National Assembly and LICOCO hopes that it will be voted on during this parliamentary session.

The FATF welcomes the efforts of the DRC in the fight against money laundering and the financing of terrorism

The Congolese League for the Fight against Corruption, LICOCO in acronym, congratulates the Government of the DRC, through CENAREF, for having provided all possible information on the efforts that the DRC is making in the fight against money laundering and financing of terrorism.

The information provided by CENAREF, during the face-to-face meeting which has just taken place in Livingstone (ZAMBIA) on September 08, 2022, convinced the experts of the Financial Action Task Force, GAFI in acronym, and these the latter granted the DRC an additional period of three years (October 2022 – May 2025) to implement an action plan agreed between the parties. Therefore, the DRC would be placed on the list of countries under enhanced surveillance.

When a country is placed under enhanced surveillance, this means that the country must quickly make a high-level written commitment, under FATF supervision, to resolve the shortcomings identified in the mutual evaluation report.

Several countries in the world are currently identified in the list of States under enhanced surveillance under the terms of the mutual evaluation and this does not constitute a sanction but a constraint to remedy the shortcomings identified, the CENAREF expert told us.

One of the important recommendations of GAFI is the reform of the law on money laundering and financing of terrorism in the DRC.

The reform bill has been tabled in the National Assembly and LICOCO hopes that it will be voted on during this parliamentary session.

Another important FATF recommendation to the DRC is to have a National Study of the risks of Money Laundering and Terrorism Financing.

Regarding this study, it is in the final phase and by December 2022 it will be published by CENAREF.

LICOCO already warned in August 2022 of the threats that the DRC was running by not taking legislative and regulatory measures to comply with FATF requirements in the fight against money laundering and terrorist financing.

Reading the action plan that FATF sent to the Government, LICOCO believes that the DRC can comply with FATF requirements if the political and administrative authorities get involved in enforcing the law.

The fight against money laundering and the financing of terrorism must be a matter for all Congolese and LICOCO encourages citizens to denounce those who are involved in illicit activities.

People who are involved in acts of corruption, tax and customs fraud, embezzlement of public funds, influence peddling, the sale of weapons or protected species, terrorist acts and its financing are among the activities illicit acts that citizens must denounce.

LICOCO undertakes to monitor the implementation of this action plan to ensure compliance with the commitments made by the Government to FATF.
