Dossier Cominière and AVZ minerals: forgotten social projects

In January 2017, La Cominière and AVZ signed an agreement.

The share capital of Dathcom S.A was as follows: La Cominière 25%, AVZ Minerals 65%, and Dathcom 10%.

La Cominière then ceded 5% to AVZ to remain with 25%.

In the process, AVZ, a company listed on the Melbourne Stock Exchange, raised the funds in Australia.

However, voices are being raised to denounce the vagueness of the amount of funds raised and their allocation.

This is to say that everything would have happened without the knowledge of the Cominière.

In the meantime, complaints from the populations are pouring out to denounce the non-respect of the clauses signed between Cominière with the company Dathcom Mining S.A. Construction of roads, a hydroelectric dam and a residential camp, nothing is visible.

Within the framework of the exploitation of minerals, specifically lithium in Manono, in Tanganyika, the local population raises the tone to denounce the non-respect of the clauses, in particular on the contract between the company AVZ Minerals and the company Dathcom Mining S.A. , created by two shareholders, namely Cominière and Dathomir. Each holding, respectively, 30 and 70% of the shares.

From this contract that has linked the Australian firm AVZ to the Congolese state for 5 years, local civil society denounces the neglect of social projects intended to benefit communities.

Basically, we note that it is the non-compliance with this contract that led the Cominière into the situation of cessation of operation.

Projects in oblivion!

As a reminder, it was a question of building roads, a hydroelectric dam and a residential camp.

Already, in the construction project of the camp, denunciations of overcharging have been made, with the cost presented at 2 million dollars.

And on the government side, Cominière wants to ensure that the requirement, moreover, included in the contract, which provides that the AVZ partner submits the feasibility studies to Cominière for its favorable opinion, is respected.

This has never been done to this day, not to mention the complication which is amplified by the fact that today, AVZ continues to hold board meetings to which La Cominière is not invited.

In the field, five years later, the project remained in a research phase to the detriment of local populations who hoped so much to benefit from mining.

In the process, La Cominière was contacted by the Chinese company Zijin, which was eyeing a project called Manono-Kitotolo.

Thanks to a world-class lithium deposit, Cominière was counting on the project, but compliance with the clauses by the shareholders posed a problem and AVZ would have preferred to obstruct this project with opacity in fundraising operations.

Dispute of the Cominière

La Cominière also expressed its indignation about the subcontracting contracts of 500,000 USD which were signed without the approval of the partners.

In the understanding of La Cominière, who castigates this attitude, once the feasibility study is ready, it should give its favorable opinion for formalities in the mining cadastre with a view to transforming PR 13359 into a PE and to add, the feasibility study sent to Cominière contains an assertion that makes it inadmissible.

In this study, AVZ claims to have recovered the hydroelectric power station of Mpiana Mwanga, whereas it is a heritage of the Congolese State via the Cominière.

According to the results of the investigation, AVZ has signed a memorandum of understanding with the Ministry of Energy for the rehabilitation of this plant by skipping the owner who is Cominière.

In this confusion, accusations are crossed when the Cominière evokes cheating which exposes AVZ to prosecution.

And the latter, in turn, accuses the Cominière of violating the agreements and the statutes of the company.

In this confusion, it is the local population who are really left behind.

The President of the Democratic Republic of Congo, Félix Tshisekedi, has appointed new ambassadors notably to Ghana, Qatar, Botswana, Poland and Tanzania.

The announcement was made this weekend on the antennas of the Congolese national radio television.

Below, all of the presidential orders appointing ambassadors:

Is appointed Ambassador Extraordinary and Plenipotentiary of the DRC to the Republic of Ghana, Mrs. Jaynet Djuma Nyakeru;

Is appointed Extraordinary and Plenipotentiary Ambassador of the DRC to the Republic of Poland, Mrs. Clémentine Shakembo;

Is appointed Extraordinary and Plenipotentiary Ambassador of the DRC to the State of Qatar, Ms. Valérie Lusamba Kabeya;

Is appointed Extraordinary and Plenipotentiary Ambassador of the DRC to the Republic of Botswana, Ms Emilie Ayaza Msuhobekwa;

Is appointed Extraordinary and Plenipotentiary Ambassador of the DRC to the United Republic of Tanzania, Mr. Jean-Pierre Masala.

What solutions to fight corruption?

The prevention and fight against corruption agency (APLC) set up, on July 26, a Task Force for an inclusive strategy for the fight against corruption.

The purpose of it will be: promoting institutional and operational collaboration between service and public organizations working in the fight against corruption, the embezzlement of public funds, money laundering and the financing of terrorism.

However, despite several anti-corruption structures in the DRC, corruption continues to gangrener the country.

To reduce the corruption rate, mechanisms must be put in place.

For Patrick Ilanga, magistrate at the Lubumbashi prosecutor's office and president of the anti-corruption network in Haut-Katanga, we must tackle the roots.

"First of all, a sincere will of the government. Then, to conceive of the actions that directly attack the known causes," he said.

In number of causes, he notes "the personality crisis, the weakness of justice, impunity, clientelism and tribalism".

Patrick Ilanga also thinks that it is necessary to improve "the working and remuneration conditions of state agents. We will also have to promote the integrity and morality of agents.

Patrick Ilanga remains confident. ”I don’t think corruption has become a standard in the DRC”.

The Congolese do not like corruption, I am convinced of it.

A sincere program, which directly attacks the causes, applied by honest people, fulfilled with personality and trust, put in the right working conditions, security, and well remunerate these people, will reduce corruption ”, He confident.

While we are waiting for this charade to play out can anybody elaborate on the following.
At the last investors presentation in Perth Nigel explained to us that once the decree was issued by the MoM they had basically 30 days to issue the licence.If not issued in that time AVZ could commence proceedings via courts and licence HAD to be issued.
Obviously this was not his preferred course of action,but is it realistic or was he just blowing hot air?
My understanding is the minister had 30 days to award the license or after that period the licence CAN be issued by the cournt

Thta's not "will" be.....it's "can" be

Well that's my simple understanding of it

He must be thinking this is going to be resolved without the need for a court application, or worse still doesn't think an application would succeed.
In any event hopefully we get some resolution in 14 days and we can get on with the process to construction.

It's best to rip the bandaid off and tackle all the issues so that it can be undisputed going forward and under different presidents.

Really! A court ruling should take about five minutes.10 boxes of indisputable evidence on one side and a 12 piece variety pack of Smith's crisps on the other.
