I think the quickest and most harmonious way out of this shitshow is to negotiate a deal on the north under the old split where we get a free carried minority ownership percentage of Manono Lithium with a deal to share the power plant

So we end up with 51% or 66% of the south and around 15% of the north at no cost allowing us to still have long term exposure to the entire deposit

From information available we gave up the north under the original split. Dathcom submitted a waiver and mining code says this means the area ceded automatically goes back to the state for the tender process. Not that the DRC government have any intention of allowing anyone but Zijin to have it.

Allegedly management have supporting documents that say we keep the north but so far they are yet to surface. Although this contradicts the claim that we will be part of a JV for the north in the May 4th 2022 announcement for the mining licence decree.

Our entire case at the ICSID is about the survival of our acquired rights which is a PE for the south only. Yes the DRC government could overrule this and grant a PE for the entire 13359 in accordance with the mining code but they haven't in the last 19 months. And I don't think they have any intention of ever changing that.

Nigel dropping that quote about sitting down to do a deal on the north in the new year wasn't accidental imo

Fuck that, sell the lot.

AVZ needs a convincing win from the court action to stay in the game. This would assist in gaining more capital and having support for continuing legal actions. If AVZ loses access to the North and also the Power Station, Zijin will go full bore on developing the North and this would diminish AVZ's ability to compete for sales Internationally.
My perception is that AVZ needs to win all the court cases so that they can do a deal to sell the project. Unfortunately, the Chinese influence in DRC is a potential blocker to get any non-Chinese competitive bidders.
For those shareholders expecting big returns on their AVZ investment, I suspect whatever happens everyone will be very disappointed.

To be fair you also thought Fat Tail would get up . Not that I'm disagreeing with some of your post . Winning the court cases is essential .I've dropped my price to $2 . If anyone is interested please DM me .

And not just because these cunts asked for it by trying to steal Manono, but also because of the DRC people suffering in poverty because of Chinese corruption

Chinese Mining ‘Wrecking Lives’ In DRC​

The Democratic Republic of the Congo (DRC) is home to some of the world’s most sought-after minerals.

Four-fifths of the world’s cobalt, a critical component in batteries used in electric vehicles and electronic devices, is in the DRC, along with more than 70% of global production.

The DRC also holds the world’s seventh-largest reserves of copper and is the third-largest producer.

The country and its people should be on verge of an economic boom. The constitution states that: “All Congolese people have the right to enjoy the national wealth.”

But there is a dark side for the Congolese who work in and live near the mines. China owns most of the industrial mines in the DRC and is responsible for child labor, horrific working and living conditions as well as systematic evictions of residents who live on its vast concessions.

A new report from the DRC-based Initiative for Good Governance and Human Rights, known by its French acronym, IBGDH, along with international rights group Amnesty International, shows how Chinese copper and cobalt mining is “wrecking lives” in the DRC.

“People are being forcibly evicted, or threatened or intimidated into leaving their homes, or misled into consenting to derisory settlements,” IBGDH President Donat Kambola said in a statement on September 12. “Often there was no grievance mechanism, accountability, or access to justice.”

The IBGDH is based in Kolwezi, one of the centers of mining expansion in the southern province of Lualaba, where cobalt and copper mining has skyrocketed in recent years.

Satellite imagery of Kolwezi has revealed this expansion over the last five years, as mines have crept into neighborhoods and entire city streets have disappeared.

The IBGDH interviewed more than 130 people at six different mining projects in Kolwezi. “Evictions are often carried out by mining operators with little concern for the rights of affected communities and little heed for national laws meant to curtail forced evictions in the mining sector,” the report stated.

In his new book, “Cobalt Red,” Siddharth Kara explores how the mining industry has ravaged the landscape of the DRC.

The air and water around mines have been contaminated with toxic dust and effluents from the mining processing. Millions of trees have been cut down.

Local miners operate in extremely dangerous conditions. “Cobalt is toxic to touch and breathe — and there are hundreds of thousands of poor Congolese people touching and breathing it day in and day out,” Kara told National Public Radio. “Young mothers with babies strapped to their backs, all breathing in this toxic cobalt dust.”

Kara, a fellow at Harvard University’s T.H. Chan School of Public Health, described inhumane conditions. “Imagine an entire population of people who cannot survive without scrounging in hazardous conditions for a dollar or two a day,” he said. “People are working in subhuman, grinding, degrading conditions.

They use pickaxes, shovels, stretches of rebar to hack and scrounge at the earth in trenches and pits and tunnels to gather cobalt and feed it up the formal supply chain.”

China’s stated intention is to corner these mineral markets. In 2009, then-DRC President Joseph Kabila signed a deal with the Chinese government for access to mining concessions. In short order, Chinese companies seized ownership of 15 of the country’s 19 primary industrial copper-cobalt mining concessions.

“They dominate mining excavation on the ground,” Kara said. “And not just that, they dominate the chain all the way through to the battery level. They have about 70% to 80% of the refined cobalt market and probably half of the battery market.”

DRC President Felix Tshisekedi has vowed to overhaul his predecessor’s deal, which he said unfairly benefits China more than the DRC. China vehemently disagrees. Paul Nantulya, a research associate at the Africa Center for Strategic Studies, said the dispute has the potential to sour DRC-China relations.

“It is perceived as patently unfair because obviously the Congolese side could have gotten a lot more,” he told VOA. “How are the Chinese partners likely to respond to this? I think it’s fair to say that they’re going to try and keep their piece as big as possible.”

To be extremely honest, I thought wow, somebody stuffed up and it wasn't me.

Huljich location during the AGM was a part of the Fat Tail show, a coward with a huge mouth, afraid to open his trap in public.

I don't think dick and cohorts have foreign interests in mind, their main game is/was self interest.
If it means they can generate max money out of AVZ by giving it to foreign interests on the cheap, then that will be the go.

He had shown his value when he did his trick with Amani gold and thought he could pull a similar trick with AVZ.
The dick had to do all the hard yards in the front row, while Peter H sat in the back observing his performance.
At the end of the day, the 3 musketeers could be disposed of, as having served their purpose and no further required.
If it would have suited Kong, the musketeers would have gone swimming in the Congo River with their feet properly secured in concrete so they couldn't win a medal swimming in record time from Kinshasa to the Banana Port.

ASX-listed litigation funder Omni Bridgeway is gearing up for a major fight in Britain’s High Court after a client refused to pay a multimillion-pound bill, claiming the funding agreement was unenforceable in England.

Lawyers for the client, Bugsby Property LLC, said the action could have wide-ranging implications for the litigation funding industry in the UK, and accused the Perth-based Omni Bridgeway of “aggressive” behaviour.

The lawsuit against Omni Bridgeway is the first major challenge following a UK Supreme Court judgment in July. Jessica Shapiro
The fight in London’s commercial courts is the latest challenge against litigation funders, including in Australia where former treasurer Josh Frydenberg sought to impose stricter regulations.
Bugsby Property received just under £3 million ($5.8 million) from Omni Bridgeway and more from litigation funder Therium for legal action over a failed acquisition of London’s Olympia Exhibition Centre in 2016.
Bugsby was partially successful and awarded about £15 million in damages.


But lawyers now acting for Bugsby said the funding agreements with Omni Bridgeway and Therium meant the pair were entitled to 133 per cent of the award.

Funder claiming 133pc is ‘terrifying’​

“Winning in the High Court to be told that the funder is claiming 133 per cent of the winnings is terrifying,” said Ashkhan Candey, managing partner of New York-based litigation firm Candey, which is representing Bugsby.
“There needs to be greater public transparency into how funders operate,” Mr Candey told The Australian Financial Review, adding he was hopeful a judgment from the UK Supreme Court in July would provide the answer.
The Supreme Court ruled that many existing agreements used by litigation funders were “damages-based agreements” (DBA) under the law and subject to a strict regulatory regime, including a 50 per cent cap.
DBAs are where the amount payable to a funder is “determined by reference to the amount of the financial benefit obtained” if the lawsuit is successful. Litigation funders, who had believed their funding agreements did not constitute DBAs, scrambled to review and rewrite agreements.

Bugsby’s action against Omni Bridgeway is thought to be the first challenge to seek a declaration that an existing funding agreement is a DBA and unenforceable. It would also require a ruling that the court could not cure the unenforceability or give restitution and return money invested.
Mr Candey said Bugsby was “disappointed and shocked” that while the parties were waiting for the High Court in London to determine the claim, “Omni Bridgeway obtained ex parte and without notice a £20 million freezing injunction against them – almost seven times the amount they funded our client”.
“They also attempted to have a recent hearing about the freezing injunction held in private, though this application was unsuccessful. This conduct is not only disproportionate and aggressive, but also seems to run against Omni’s value of being the champion of ‘access to justice’.”
In its financial results for the year ended June 30, Omni Bridgeway downplayed the development, saying it had “very limited” exposure to affected matters.
An Omni Bridgeway spokesman declined to comment.
Omni Bridgeways shares traded at $1.65 at 10.45am AEDT, compared with $4.60 last November. The company’s largest shareholder is Rest Super, which has increased it holding to 8.5 per cent in the past year.

Before the AGM I have never been a true fan of our BoD & their silent tactics but after the weeks leading to the meeting realised the 💩thats being going down ,so its 🐶/Ben/John & Co or we are screwed .The 1 thing we learnt was who in the TOP 20 register are the real Kunts.

Think Bags/Dave 😛was tongue in cheek suggesting 🥕would make a good CEO or Director of a company because he was SO unimpressive ,still in a little disbelief that was the best they had to throw at us 🤷‍♂️bit of a anti climax fizzer .Looks like everyone has gone to ground at present waiting for outcomes/Xmas …Thanks for the deep thinker reference Cruiser ,you probably caught me at a time thinking “Yep have time for another🍺 or 🍺🍺

As i referenced before it was nice putting faces to TSE names in finishing i have come to the conclusion …We have it …they want it SO

Really looking for some guidance from the outcomes of the arbitrations.

Hopefully good news for AVZ and some more ammunition in the fight against corruption and increasing the chance of seeing the DRC laws and Mining Code finally being upheld

Fuck it's been a long wait to get to this point

And still a good while longer to go probably until we get the outcome we want for shareholders and the good people of Manono and the DRC in general

I originally wanted to go mining and saw the project as transformative for the DRC and also potentially for shareholders

Unfortunately with the shitfuckery I've seen I have become so disillusioned with the high ranking corrupt officials and politicians of the DRC and the perverse activities of China backed Zijin that I simply want out

If Nige can get the "right" deal and present it to shareholders I'd be all for it
