Is anyone expecting Jin Chen/Zijin to be a no show in Paris ?
To be honest that would be their best move. They are fighting the indefensible, cant fucking wait!!!!!
Even if they show up its a no show considering how much of a fucking beat down they will receive

According to AVZ the SPA's contained a clause for arbitration outside the DRC. I've never seen the agreements but I'd say they have similar clauses to the Dathcom JVA regarding going through the ICC. Even without a specific clause in the SPA's any dispute between shareholders of Dathcom must go through the ICC anyway under Article 11 of the JVA.

The fact that Cong didn't follow these rules when trying to weasel his way out of the contracts he intended to be bound by shows that he knows that he has no chance of winning based on the facts of the case. Worth remembering AVZ's claims against Dathomir at the ICC include damages.

This is how I'm interpreting this. Maybe things have once again stalled with DRC ministers pocketing more Chinese flavored snacks, and AVZ are politely saying fuck around and find out. Maybe things are going 'well', however we are simply not as naive anymore and are pushing for signatures on dotted lines. The DRC only seem to respond to Chinese tactics, we can't bribe but we can strongarm with the ICSID.
ICC is good, but it very much seems the ICSID has been their kryptonite.

Time is now critical for us. The project has been delayed for years and we can't lose any more time. AVZ should just push hard along with ICSID proceedings with hearing dates so it's clear for DRC not to use any Chinese tactics to delay further. It's then in DRC's court to decide whether to issue the mining decree prior to the hearing date or not. If they do issue, it's not too late to cancel the hearing at the 12 hour.

I know there are bigger legal issues at play / that are the priority, but, jeeeeeze I can't wait to see his time come....

Cong not showing up to ICC would be a good win for us, but part of me hopes they show up so the IGF report is displayed in all its glory in a courtroom.

Cong never took the cash. But he recieved it. Which is legally good enough.

The Dathomir cases are the most open and shut contract law examples I have ever seen. It is extraordinary that arbitration takes so long for something like this. The ICC is a joke regarding timetables and the ability of claimants to delay proceedings like Zijin have been doing.
For Cong to have received cash, he must of signed documents and possibly counter signed.

Signed documents are legally binding regardless of what the said party does with the cash, unless of course you can prove that signatures were forged.........aka Graeme Johnston, with the accusation apparently taken to the DRC courts and purportedly Graeme was found guilty and sentenced to 5 years jail plus a significant fine........:ROFLMAO::ROFLMAO:

Yet, i spoke to Graeme Johnston at the last AGM....;)

The money was wired to Cong and then he wired it back. No documents needed. SPA's usually contain payment instructions and that was almost certainly followed exactly by AVZ's lawyers.

Pretty sure Graeme Johnston was convicted for allegedly illegally registering the 15% into AVZ's name upon completion of the payment for both SPA's. But that makes no legal sense as you can't just rip up contracts because the value of the asset went up. If the lithium price had of crashed as all the experts were predicting at the time Cong would have gladly taken the money and run. As frequent visitor to Epstein island Prince Andrew once said about contracts 'you have to take the rough with the smooth'.

Johnson said that AVZ paid the money and that he received a receipt from the bank stating that it was paid in to the required account. Apparently cong then returned the money to AVZ. Johnson then stated that AVZ placed the money in another account as the money did not belong to AVZ
