I don’t know what’s got into shareholders here…. Marius explained pretty clearly what has happened.

Previous meetings with Felix where he has been manipulated by MoP, Cominiere, Dathomir and Mupande.

All these are high level actors who live in the DRC with years of corrupt experience and able to access him more easily, and no doubt doing it while he is focused on the thousands of people getting slaughtered by rebel groups in the north east of the country.

I’ve tried to be more considerate and respectful for a while now but I would punch several fucken whinging ignorant heads in if they were standing in front of me right now

Still some issues with Dathomir but all they want is money so at worst we pay a bit more. Not sure where the Hydro has ended up but for now would be bloody happy to be reinstated to trading with the above scenario.

Looks to me that they withdrawed their claim through that court because the court has been dragging the chain ; they’ve referred it to the ‘General’ ; no case pending , so possibly higher avenue of non court bumpkins can make decision on it

For clarity - RCE7102 is AVZ‘s case against Cominiere regarding the sale to Zijin.

My personal opinion is that we will get the 15% at ICC, so to play nice with Cominiere, we just withdraw this.

I read those translations that both sides have dropped that particular case "for personal convenience".
I honestly can't see AVZ giving Zinjin a cent going on what's been said, so far as how they view their legal standing, so something seems to be brewing that is maybe going in our favour?

Seems like Nigel and Co are bending a little to smooth the waters. As for the 15 % well it was never ours anyway and quite likely Zinjin or someone else would trump our offer anyway....highest bidder wins. Still confusing as fuck but finally in the past couple of weeks we appear to have some positive movement. Im still confident of a great outcome here but right now ive had enough of this circus and iam off to the beach for run and swim

Highest bidder only wins if AVZ can't match the offer under first right of refusal. Whatever Cominiere are willing to accept we have 40 days to match or we lose our rights. Key thing is Cominiere have to tell us the exact price of the offer for the 40 days countdown to begin which didn't happen in 2021. Technically we have every right to buy the 15% for 33m USD but we won't try to enforce that for obvious reasons.

MM just publicly destroyed the Minister of Portfolio’s reputation and detailed her corruption for all to see. Something that the President will finally have to see - concerning that Felix has done Fck all on this project. Great move by MM. 13th Feb 2023 local DRC court document highlights that AVZ and Cominiere (including Dathcom representative) agree to withdraw case number RCE7102. AVZ lawyer notes that due to the extended and drawn out process they would like to withdraw the case which was agreed by all parties. The tribunal (local DRC court) acknowledges the request for withdrawal pending final deliberation.

RCE7102 original case was issued by AVZ against Cominiere in 2021 for breach of the Datchcom JV agreement (article 10 and 12) which is related to the exercise of preemptive rights. AVZ's case against Cominiere is related to the illegal sale of 15% to Chinese Zijin. The original case was to be heard October 26, 2021.

After all this time, we still want to get a new meeting with the president and hope he will help us. Nigel is still not in the DRC.

Marius often talked with the MoP, what didn’t go well. And talked with the MoM and at the moment it looks like this didn’t go as well as hoped.

And now he is jumping in every interview to make the case more public and to increase the pressure of the government. That gives me the taste the negotiations are not going well too.

Can someone tell me what progress did they make the last 10 months with the DRC government? Personally I don’t see many.
Only that we still have no support from the government.
