Hi Folks

Overall, a rather sullen, pensive, resigned vibe going on with TSE forum of late, no real surprise given its been 28 months since AVZ initially entered VS and in that time, there have been numerous whispers of hope, but up to this point, nothing transpiring materially, except i guess the wins we have had at ICC arbitration level.

So, the reason for this post is simply this, dont give up hope!

Why you say ?

Well, lets just say that i do know that there are machinations playing out behind the scenes within the inner sanctum that most of you are not aware of which i am not at liberty to portray for many reasons , but most importantly, because there are evil lurkers in the back ground that will attempt to gleen any info and twist the knife .........this we all know well and truly from past experiences.

Yes i have heard this all before too and still sceptical myself .......fair call!

What i can say with all conviction, is that Nigel is hurting as much as we all are here, (literally speaking i might add ) and is working hard to garner a solution that would be acceptable to all given the dire circumstances that we are facing from the dark forces of DRC / CHINA.

All is not lost believe me, far from it and thats the message i wanted to put out to anyone that is feeling despair, especially the ones that are " all in " with AVZ.

I am sorry i cant offer more and apologies if this post is a bit cryptic and truly hope that the " machinations " transpire into something formal.

I don't know if they are just that stupid, thinking if they tell a lie often enough loudly enough people will believe it.

Or, they are just 100% in deep now so might as well play this through to the bitter end.

Speaking about karma und how it works. To my understanding here might be a bit of our karma as well, that we now in such circumstances. But dont want to get too mystical and still hope for the best.

Hey mate, I've been in this every step of the way, went to the roadshow after the suspension and have followed this so closely ever since.

I understand not being able to say a whole lot publicly. However, can you hint towards any kind of timeline for some kind of resolution, or major update in the process besides what going on in the international courts? If you're saying all is not lost, and far from it, are we talking....potentially within six months, or further out? I guess that'd be nice to know. As with everyone, I'd like some resolution somehow, to close this chapter one way or another.

I have no time frames to give you, i simply do not know.

All i can say is that i have met sophs via past AGMs who have been in my ear of late individually and all have shared intel which have common themes .

No one is more sceptical than me given i have been burnt to the crisp via WFE, VEC, BABCOCK & BROWN and others in the past, but this intel gives me hope and so just wanted to share that thought in a limited capacity.

What i would like is something concrete to arrive before the next AGM.

Failing that, then i will be attending the upcoming AGM with alot of questions as per normal.

Butter my bread Beish but we were all quietly confident and getting warm and fuzzies a few weeks & months leading up to the last AGM.
Still confident in the long term outcome but personally doubtful of anything prior to this year's AGM, only around 8 weeks away. 🤔

Fight against corruption: Odep advocates for the strengthening of the control powers of the Court of Auditors

The Public Expenditure Observatory (Odep) supports the approach led by the first president of the Court of Auditors, Jimmy Munganga, for the extension of the control power of his institution in order to enable it to properly lead the fight against corruption.

In a press release published this Friday, September 13, Odep emphasizes that corruption is, in fact, a real scourge that dooms all efforts made for the development of the DRC to failure.

Based on the report published by Transparency International in 2021, placing the Democratic Republic of Congo 11th in the ranking of the most corrupt countries in the world, the Public Expenditure Observatory expresses its support for the project to revise certain provisions of the organic law on the composition, organization and functioning of the Court of Auditors.

In this context, ODEP demands the following:

- The extension of the competence of the Court of Auditors in matters of budgetary discipline to political authorizing officers, in particular government ministers and provincial governors, which implies the amendment of Article 32 of the organic law of the Court of Auditors;

- The explicit recognition of the power of the Court of Auditors to directly seize the bank accounts of persons responsible for serious irregularities noted during its controls and their prohibition from leaving the national territory until the closure of their files, without going through their hierarchical superiors, which requires the amendment of Article 39 of the organic law of the Court of Auditors;

- The authorization of the Court of Auditors, in addition to the conviction of fines, to order the confiscation and restitution to public entities that are victims of funds or property stolen following mismanagement, which requires the amendment of Article 136 of the same law;

- The mandatory and automatic transmission to the Court of Auditors of any public procurement contract signed at the level of the central government, provinces, portfolio companies and public institutions, which requires an amendment to Article 28 of the same law.


In this same vein, ODEP calls for the unity of all civil society dedicated to the control and monitoring of public finance governance to come together to support the Court of Auditors, which it describes as “the main and first control institution in the DRC”.

It also invites the President of the Republic and parliamentarians to get involved in the fight against corruption by facilitating the revision of certain articles of the organic law of the Court of Auditors.
