So does this mean the pressure is now on the DRC Gov to have a binding MoU signed by December 11 (pending no delays lol), otherwise they risk starting having an emergency injunction ruled against them and presumably daily fines or other consequences aswell?

From memory last year Nigel stated that the north was split originally as a condition of obtaining the mining licence. I remember getting the impression at the roadshow that we were basically tricked into relinquishing it. When managements impression was that it'd be split but still retained. Something along those lines.I've said all year that the waiver was the original sin of suspension. Mining code is very clear. Once waived area goes back to the state for tender process.

This question begs further investigation though. He might be ready to come more clean about it this year since upsetting the sensibilities of the DRC government might not be so much of an issue.

Whilst I am always cautious and amused by these articles, it is funny to see what sort of things are going to get thrown in to the mix when the other side gets desperate.
It covers:
-It covers the Feasibility study being illegal, because Cominiere didn't approve it.
-It covers AVZ not having the required 40% of capital in the bank account (circa $220m USD)
-It covers the north portion being relinquished potential insider trading with AJN.
-It covers the Feasibility being further illegal regarding the hydroelectric power plan ownership.
It finishes with a strong sentence:
"In light of the above, Dathcom's MOU was withdrawn for reasonable and legitimate reasons, and the ICSID arbitration initiated by AVZ has no future in the face of these facts."
