And whats the requirement to lodge a class action on behalf of ALL shareholders (that purchased between those dates) on an opt out basis? Surely they cant run a lawsuit on behalf of people that dont support this without some kind of majority support??

Think about what Mupande has done here. He has used Felix's name to engage in corrupt activities for personal gain that is holding up development of the planned battery value chain. Tshisekedi's main two platforms for his presidency are fighting corruption and transforming the DRC economy into a renewables powerhouse. Does anyone here really think this problem wasn't brought up when Felix was in the oval office last week?

The funniest thing in all of this is Klaus and Cong sold their AVZ shares while lithium prices tanked because Nigel wouldn't flip the tenement. They then got salty when the price went parabolic (which anyone with a brain saw coming) and used Mupande to stop the licence process to try get back in the project by crashing the AVZ share price. If they had just done nothing and not sold their AVZ shares instead of being dickheads they would have made more money and none of us would be going through this crap.

It's too late to be scared. It's time to kill.

I reckon it would possibly be the Exchange Traded Funds and some of the big players who came into the cap raise

Looking for an avenue to recoup what might be potential losses

Im still keeping an eye on things mate. I said my bit and a lot didnt agree with what i had to say, and ive had nothing more to add since.

It doesnt surprise me that this action has been commenced. Ive had no involvement in establishing it .... but the basis of the action seems in line with my issues surrounding poor Corporate Governance and non disclosure of material information.

The ETF Funds and Index Funds who have also been locked in this situation with the rest of us could be the ones behind it...but thats just a guess.

Hopefully it spurs the company into action and gets us trading again.

Last weeks announcement in response to AFR article could also have been in expectation of this action looming?

If a court finds AVZ in breach of ASX and ASIC disclosure and misleading conduct laws, then that has further implications for Directors and Company Secretary who traded shares during that period whilst in possession of information not released to the market.

Also, has implications for the Resolutions at the 2021 AGM to grant generous benefits for remuneration, termination benefits and performance rights, as if its found they were voted on whilst a court finds shareholders were misled and not fully informed in accordance with the law then i think those resolutions would have to be annulled??

But I did see that it was absolutely a looming possibility.....you only had to piece together all the shit we've uncovered and the timeframes to realise there was potentially material information withheld from the market

I'm not in control of it and it fucking kills me if it's the case

The fact I posted some questions and had a discussion about it on the Crapper means fucking nothing

Omnibridge didn't magically read a random dick called Winenut yesterday on the Crapper and suddenly decide to launch a fucking class action

The chance of me recouping my losses through a class action is just about NIL and getting anything out of it to be honest would make me feel about as happy as receiving thirty pieces of fucking silver

You have to opt out if you don't want to be involved

The specific shareholders affected (it's not every shareholder) are captured within the defined constraints detailed in the Omnibridge notice

I've been in this position before with CBA and opted "out" of the action

If you're affected and you stay "in" there will be a number of conditions that you will be agreeing to

These conditions will also be listed in the Omnibridge notice

It's a shit pile wrapped up in a clusterfuck that you will have to navigate if affected

Winenut you've been banging on about class action the last week or more ; not sure what gets into holder heads, but if you want a chance to keep their investment, why on earth would holders start to heckle for class action on these sites. Not wino's fault, this was bound to happen. Anyone who couldn't see disclosure was a potential issue has rocks in their farken head!
Chinese own a fair percentage of this company and anyone who bought volume during the stated period is likely to be pissed with this situation.
It's a massive fuck up by management who denied the reality of what was going on for many months. Corrupt Kangaroo court or not.

Everyone should note that a Class Action has not been filed as yet.

It is merely an Investigation by OB and JWS to determine if a Class Action would have any chance of success and how much OB and JWS could make in fees from running a case.

They will only file an action if they see the case being solid and the damages and fees being high....as they are taking the financial risk on running it.

Could be a warning shot from the big funds to AVZ to get things sorted and quick??
