The substantive examination before the court has included the location of the business and its impact on, among other things, human health, reindeer husbandry, water environments, species and Natura 2000 areas. The court has concluded that permits and species protection exemptions can be issued. Two important issues in the case have been the activity's impact on reindeer husbandry and the impact through emissions to water.

- That the water can be purified means that mining operations can be conducted without unacceptable risks for land and water environments. The terms of the judgment have been determined to guarantee this, says Per Lagervall, as a technically knowledgeable judge in the case.
- A mine always involves an intervention in the natural environment and an impact on reindeer husbandry. In this case, mining will only be allowed to take place the six months a year that the Sami villages are not in the area. The court has therefore concluded that mining operations and reindeer herding can coexist on the site, says Lena Nilsson, also a technically knowledgeable judge in the case.

Talga's application for permission was submitted to the court at the end of May 2020. The processing time from the time the application was received until the court announced its verdict has amounted to almost three years.

If they go for the highest grade first or simply mine more in the early years (MT said the yearly number is an average, not exactly to be followed), I can see them doing 30 kt/a anode with Vittangi's first stage operation.

During Wednesday morning, the verdict in the so-called Talgamålet came from the land and environment court. The court grants environmental permission to the battery node company Talga AB to start mining in Njunisvárri södra, which is located west of Vittangi in Kiruna municipality.
The area is a reindeer herding area for the Talma Sami village, and the Sami village has opposed the mining plans from the start.
But according to the court, it is possible to combine mining operations with reindeer herding with the justification that the actual mining of the graphite should take place during spring, summer and autumn. Not in winter when the reindeer are grazing in the area.
Nils Johánas Allas, chairman of Talma, is saddened.
- Yesterday was the first day of spring, today is the second and nice weather and then comes this bad news. They will have other activities there during the winter, you can't move there with the reindeer and have them grazing there, he says.
What do you think about appealing to a higher court?
- I don't know that yet, we'll see when we've talked together.
The company applies for several areas
In this area, the company is applying for a processing concession for four areas. But they have only applied for an environmental permit for one of them and it is the one that was granted permission in the judgment. In Vittangi, mining opponents are disappointed.

I am happy that the Sami can continue to let the so-called reindeer eat the grass in the area during winter time. We can coexist with this mine and the expansion as well. Its a question of will and respect towards each other. If the Sami stop being rediculous with their arguments, we can and should be friendly neighbors.

Also, to give a bit of perspective.. farm animals can and do live next to industrial installations. For example, look at these cows:



Sure, the cows might not be very amused about the rockets.. but they live their to this day and SpaceX conducts engine tests that are equally noisy on a daily bases. The notion that the existance of the mine makes so-called Reindeer herding impossible is just plain false. The reindeer will get used to the trucks and processing sounds of the refinary. I get it, they wouldnt be way less amused if actual blasting were to happen while they are there, but thats reserved for the summer time.

Does anyone here know if there is public domain access to the full 200 page court judgement or has this only been issued to the main proponents? DYOR but, if Australia’s own L&E courts are anything to go by, a successful appellant would need to prove an error in law in that document to overturn the Umea L&E Court’s decision not new untested information. It would also be interesting to us all to read which of the contested conditions noted in the CAB document*) were included in the judgement.

The co authors are the Chair persons of two organisations dogmatically opposed to any mining even outside Sámi nobility land granted by the Swedish King to the Sámi in the 1800s.

This is the first sighting of the final battlefield in the future Supreme court challenge based on UN charter on rights of Indigenous populations and their cultural practices.

Australia-based Talga Group has secured the environmental permit for its Nunasvaara South natural graphite mine in northern Sweden.
The permit for the natural graphite mine, which is part of the company’s vertically integrated Vittangi anode project, has been issued by the Swedish Land and Environment Court.
According to the battery anode and advanced materials company, the court’s positive decision included the grant of a Natura 2000 permit.
The permit is subject to a period of three weeks when appeals can be filed.
Talga stated that the environmental permit has been rewarded with conditions that align with its detailed feasibility study and permit application.
The Swedish Mining Inspectorate is anticipated to decide on Talga’s application for Nunasvaara South exploitation concession following the positive environmental permitting decision.
Remaining local permits are underway, stated the company.
Talga managing director Mark Thompson said: “This key approval is a significant achievement, and a major step in Talga establishing its Swedish natural graphite anode production.
“The approval is the culmination of extensive technical, environmental and social studies over many years and has followed a highly rigorous permitting process.

Talga, a mining company from Australia, has received the go-ahead to mine graphite in Kiruna municipality. The company wants to mine 120,000 tons of graphite per year, which will be used in battery manufacturing, as anode material.

The demand for graphite is considered to be high as it is an important part of electric car batteries. The majority of production is currently in China, but the EU now wants that to change. On Wednesday, the Land and Environmental Court in Umeå announced that Talga may open a graphite mine in Nunasvaara, outside Vittangi.

According to the ruling, the mining company may mine 120,000 tons of graphite per year. The graphite will be used to make material for anodes for batteries. A production that will take place in a new factory in Luleå.
The mine in Vittangi and the factory in Luleå will have a total of around 150 employees. If the environmental permit gains legal force, production in Vittangi could be up and running in 2025. But first any appeals must be awaited.
There are many indications that the affected Sami villages and the Nature Conservation Association will appeal. Three Sami villages participated in the court process. They stated that the mine will negatively affect reindeer husbandry, and that mining restricts the Sami's civil and political rights as indigenous people.
But the court made the assessment that the mine and reindeer husbandry can coexist as mining is limited to six months a year, when there are no reindeer in the area.
Mining of graphite in Vittangi is seen as part of the EU's endeavor that Europe should not be dependent on buying graphite from China.
The Australian Talga Group, which includes the Swedish Talga AB, is a global mining company that mines and enriches graphite ore into graphite and graphene products, products that are used for the manufacture of environmentally friendly solutions in batteries, carbon fiber composites and in coating many materials for increased durability.
In Nunasvaara, the company has found one of the world's best deposits of graphite.
- This graphite deposit is of absolute world class and of a rarely seen quality globally, perhaps the best ever. The Vittangi project has already shown, after existing tests, that it is the largest and most pure graphite deposits in Europe. The new area that we have now tested opens up even more long-term solutions, said Talga CEO Mark Thompson when the deposit was analyzed in 2019.
Now Talga can move forward with plans for mining and manufacturing anode material.

Australia-based Talga Group has secured the environmental permit for its Nunasvaara South natural graphite mine in northern Sweden.
The permit for the natural graphite mine, which is part of the company’s vertically integrated Vittangi anode project, has been issued by the Swedish Land and Environment Court.
According to the battery anode and advanced materials company, the court’s positive decision included the grant of a Natura 2000 permit.
The permit is subject to a period of three weeks when appeals can be filed.
Talga stated that the environmental permit has been rewarded with conditions that align with its detailed feasibility study and permit application.
The Swedish Mining Inspectorate is anticipated to decide on Talga’s application for Nunasvaara South exploitation concession following the positive environmental permitting decision.
Remaining local permits are underway, stated the company.
Talga managing director Mark Thompson said: “This key approval is a significant achievement, and a major step in Talga establishing its Swedish natural graphite anode production.
“The approval is the culmination of extensive technical, environmental and social studies over many years and has followed a highly rigorous permitting process.
