We’re all "classless bogans" according to the messiah, who continually repeats what he sees as his moment of glory, after getting completely fucked over by Santa Klaus.

AND, he’s now back as tendoji on the crapper, whispering to the classless bogans on there too.

Not really, that long winded article is similar to many others recently and the partial claim settlement probably relates to the €39 million as Xerof said.
It's really just more of the same but they've stretched out the word count to make their article look unique compared to all the others.
It's old news.

No chance. The ICSID is suspended. If a negotiated resolution is reached the penalties will not ever be enforced.

When I read some of the language in these articles, I see there is certainly potential for delays, but hopefully a fast resolution can occur.

Just going a little further with that if the peace deal is signed say on the 16th then the Kobold/AVZ deal goes live pretty much immediately ie announced to the market on the 20th. Given AVZ is a public company ( albeit unlisted ) it will be required for shareholders to vote on the disposal of our principal asset. 75 % of the vote is required to pass the resolution and as far as iam aware AVZ have to give 21 days notice for an EGM to vote on the resolution ( sale agreement)
If that is the case why was the ICSID only suspended to 23 June ??
If the whole deal blows up, we can imminently proceed with the icsid. Or put new pressure on the parties. Seems like a reasonable approach to me to suspend just for the minimum time frame.

We dont have a good track record with suspending things for a "minimum timeframe", but yeah think we all just want out of here with a fair price (including the said partial compensation), to me there's no way that partial compensation is referring to the $39m euro we are owed, that makes zero sense to me considering they already owe more than that with interest and the ongoing fines, even disregarding that it would still make no sense to me in the grand scope of things, Kobold cant possibly be talking about compensating an extra measley few mill, when we want billions, even Nige would laugh at that shit

We dont have a good track record with suspending things for a "minimum timeframe", but yeah think we all just want out of here with a fair price (including the said partial compensation), to me there's no way that partial compensation is referring to the $39m euro we are owed, that makes zero sense to me considering they already owe more than that with interest and the ongoing fines, even disregarding that it would still make no sense to me in the grand scope of things, Kobold cant possibly be talking about compensating an extra measley few mill, when we want billions, even Nige would laugh at that shit

Exploration expenditure, plus partial claim settlement, including interest to date plus US1.5b, being the only published figure mentioned anywhere

Which I hasten to add drew the very cool response from AVZ - non-binding agreement

and someone said the ISCID is suspended and if finally dropped, the partial award won’t be able to be claimed. Well, Nigel would say thats absolute rubbish. It’s an Award already made, and Nigel will be trying to collect as mush of every penny of anything due as he can

The desperation of Tshedeski to get the minerals for security signed off to save his personal wealth and political position will enable the deal to go through.
Rwanda would have analysed the consequences of going against the military strength of US.
Would be absolutely foolish IMO.
Best to get some processing benefits from trade in critical minerals than be militarily overcome in short time.
Hence minerals for security will be signed off.
Felix has re arranged his puppets
/ close at hand for Kobold to benefit with Manono.
Just need to wait what the final " fair compensation " is made known to shareholders.

Hi @Yaseen, what price does you think AVZ will be offered if the Kobold buyout actually happens. Do you think its passable that the whole deal is likly to fall though & AVZ will haff to restart the ICSID case? Intrested in your thoughts. SS

We've reviewed our travel advice for the Democratic Republic of the Congo (DRC) and continue to advise do not travel due to the volatile security situation and the threat of conflict, violent protests, terrorism and kidnapping.

The security situation is volatile across the country. Conflict in Eastern DRC has escalated. Violent demonstrations and protests may occur in Kinshasa and other locations. Airlines may suspended flights to and from Kinshasa and other options to depart the DRC may close with little or no warning. If you're in an affected area, shelter in place until it's safe to leave. Always exercise extreme caution. Monitor local media for updates, arrange effective personal safety measures and ensure travel documents are up to date (see 'Safety').

The hard-working Thérèse Kayikwamba Wagner, former Minister of State for Foreign Affairs, and her colleague for Mines, Kizito Pakabomba Kapinga Mulume, along with the Chairman of Gécamines SA, Guy-Robert Lukama Nkunzi, are the three musketeers appointed by President Tshisekedi to negotiate the final adjustments to the barter deal, critical minerals for security, between the DRC and the United States.

Before the end of the summer, the sky of strategic relations amidst the mining transactions between the US and the DRC is unlikely to be clouded by a single cloud.

The three-headed special coordination body established by Fatshi's primary mission is to discuss each clause of the "minerals for military support" deal with the US administration.

To ensure its success, Félix Tshisekedi has strengthened the Kayikwamba-Kizito-Lukama coordination body with high-level legal experts, including Pascal Agboyibor, a partner at ASAFO & CO, internationally renowned for his expertise in the energy, mining, infrastructure, and project development sectors in Africa.

The coordination body will also be supported by a technical secretariat composed of 22 experts whose essential role will be to produce regular reports on the progress of the negotiations, as well as the results of the implementation of the agreement in preparation.

The state-owned mining company, Cominière SA, and the Mining Registry (Cami) are also among these technical experts. Within the civil society movement, fingers are crossed in the hope that "American contracts would not contain leonine and obscure clauses like Chinese contracts."

In the initial draft of Chinese contracts presented to the National Assembly by the then Minister of ITPR, the late Pierre Lumbi O'kongo, a certain Kabale, not otherwise identified, appeared in the notes like a hair in the soup.

Speaker Vital Kamerhe L.K. Kingi was unable to prevent elected officials from the opposition, then led by the MLC, from heaping more harsh criticism on Chinese contracts.

It took more than 15 years for the incorruptible Jules Alingete Key, then head of the IGF department, to return to the infamous contracts and force the consortium of Chinese companies (Sinohydro, Crec, and Afrexim Bank) to rebalance the financial package in favor of the DRC, with an additional US$7 billion allocated to road infrastructure construction.

As with the revisiting of the Chinese contract under the leadership of the IGF, Félix Tshisekedi insisted on transparency in the negotiations and compliance with the Congolese legal framework (particularly the mining code and regulations), as well as the certainty that the deal with the US, in addition to security guarantees, would also offer definite economic benefits for the DRC.

So, a win-win situation!

And according to analysts who spoke to Ouragan.cd, the presence of delegates from Cominière SA is justified by Mr. Tshisekedi's desire to offer the lithium mining operation in Manono, a 19-hour drive from Bukavu, to the American group KoBold Metals, co-owned by billionaires Bill Gates and Jeff Bezos.

KoBold has apparently convinced the Australian company AVZ to drop legal proceedings against Cominière and join the new pact.

KoBold is a young mining company that gained notoriety in 2022 by investing in the development of a copper deposit in Zambia.

"The company aims to harness new technologies, particularly artificial intelligence, to explore strategic minerals needed for the energy transition."

In 2023, its CEO, Kurt House, stated that the DRC is probably "the best place in the world" for the materials his company is looking for.

It's highly likely that the American firm KoBold would find imitators on Wall Street.


However, for many civil society organizations specializing in the extractive sector, Guy-Robert Lukama is considered the Albert Yuma of the regime, as he holds multiple positions and negotiates contracts considered as murky as those of Joseph Kabila.

And his presence among Congolese negotiators arouses suspicion.

The United States has targeted a wide range of minerals, which are, in fact, being swallowed up in other, better-known places, such as copper, cobalt, or lithium.

Since April 15, 2024, Uncle Sam has increased to fifty (50) the list of minerals it considers critical or strategic.

These are: aluminum, antimony, arsenic, barite, beryllium, bismuth, cerium, cesium, chromium, cobalt, dysprosium, erbium, europium, fluorspar, gadolinium, gallium, germanium, graphite, hafnium, holmium, indium, iridium, lanthanum, lithium, lutetium, magnesium, manganese, neodymium, nickel, niobium, palladium, platinum, praseodymium, rhodium, rubidium, ruthenium, samarium, scandium, tantalum, tellurium, terbium, thulium, tin, titanium, tungsten, vanadium, ytterbium, yttrium, zinc and zirconium.

All these minerals, if not their indices, are found in the Gecamines concessions.

No. Nigel would not say that. Nigel would say that what YOU are saying is absolute rubbish.

Do you not understand that the proposal is for AVZ to sell its commercial interest in the project to Kobold? If this occurs, the ICSID arbitration will be ended completely. There will be no partial award. The funds to purchase AVZ's interests will come from Kobold. The DRC Government and Cominiere will pay nothing.

Hi Leah there has already been a partial award to AVZ . The amount of 39 plus million euro award was on 10th March. This is a part liquidation and the 50,000 euro per day penalty is ongoing. This was awarded by the ICC not the ICSID. At the moment ICSID is temporarily suspended but ICC cases are ongoing

What I am disputing, is your assertion that the partial settlement referenced in the article from 8 May posted by Jongo, might relate to €39m awarded by ICSID. I don't think it does.

What I am also disputing, is that any partial award will be claimed or recouped from the DRC Government or Cominiere, once a negotiated resolution has been reached. It goes without saying that Nigel will attempt to obtain the highest value for the project which he can, taking into account lost earnings, future earning potential etc. This amount will be obtained from Kobold though and Kobold are not subject to any damages claim or partial award from arbitration etc. So yes, the partial award won't be claimed, AVZ will simply try to obtain the highest price they can from Kobold (a third party not subject to any partial award).

It was me that suggested that the partial award won't be claimed. You then say it is rubbish talk and respond to a post of mine asking if I am tense. This sounds like projecting.
