If the DRC no-show then the case goes on... as long as it is funded for the tribunal to make a judgement based on the merits of the case. If the respondent doesn't pay their fees then it's up to AVZ keep the arbitration lights on (they won't automatically rule in favour of AVZ if the DRC don't pay though).Surely Nigel would have been obliged to inform share holders of the situation and passed the tin around if AVZ was short ? Looks to me like more stall and delay tactics . What I want to know is can we still put the case before ICSID even if the DRC are a no show . If we can then that's a huge win for AVZ . What is the point of f--king ICSID if the guilty party can just walk away and not be punished . It makes no sense . What we need now is the Locke funds to show these c--ts we can drag their arses to the ICSID . I suspect @geo_au's promised jump for joy announcement is in regard to funding .
The non-funding and other antics would of course all be taken into consideration in the final rulings.
