So was the catalyst for launching the ICSID the 14 day period needed for the MoM to grant us our right of appeal on the cancellation of the ML followed by the 3 month period for absence of arbitration approval or objection by the DRC?
Nigel's letter (Specifically Section 14) on the 3rd of February 2023 is the appeal. I'm guessing there's no other paperwork involved. The MoM is not allowed to cancel acquired rights unless the holder doesn't appeal, the appeal is time barred or the appeal is rejected under Article 290 of the mining code. Franck Fwamba says the response to this has a 14 day time limit but I can't find the legislation for that.
According to Franck Fwamba the MoM just ignored us. Under Article 319 of the mining code this leads to arbitration under the ICSID convention. As Dathcom is a national of the state for legal purposes we would would have needed to provide 3 arbitration options to the DRC government and when we presumably received no response to that either after 3 months we then had 30 days in which to tell them which arbitral tribunal we had chosen.
Which adds up to around mid May as the earliest we could have applied for the ICSID and our claim was processed by them in early June. AVZ said in the October 9th announcement that the DRC government only took an interest in talking to us again when it received the ICSID paperwork. Seems the delay in launching our claim was more procedural than anything else imo

In short, it appears AVZ has been outplayed with the DRC proceeding to divy up our tenement whilst leaving us with a hobsons choice: drop the legal action and take what is left, or get nothing at all. No surprise really given the jurisdiction we're in. Time to face reality. AIMO.

Mr Carrick, in his new role as executive chairman of Perth-based AGR Ltd, confirmed yesterday the company had secured $US20 million ($38 million) in equity backing from the world's biggest uranium miner, Canada's Cameco Corp, to finance development of a gold mine at the Boroo project in Mongolia.
The finalisation of the Cameco deal, under which the Toronto- and New York-listed mining giant will emerge with a 52 per cent stake in AGR, coincided with the completition of a syndication process for a $US33 million project financing facility with Macquarie Bank.
The deal is a coup for AGR after Resolute walked away from a scrip merger proposal last year. Mr Carrick has been working on the Boroo financing deal since his departure from Resolute in February last year.
His departure followed a sharp erosion in the value of Resolute shares which gave control of the company to Sydney investor Duncan Saville via a significant holding of converting preference shares. Mr Carrick's successor at Resolute, Peter Sullivan, said in a statement that Resolute had advanced $3.2 million to AGR in the past two years in loans and the provision of technical services an amount he expected would be repaid within 30 days from the proceeds of the Cameco share placement.

Why have the DRC/China jumped the gun here ? Why didn't they wait until after the AGM to steal the project from us ? Were they not confident the MMGA would get up? By stealing it now SH may cling to MMGA as a last hope / nothing left to lose option ? MMGA then betray AVZ take their snack bags and run . Looking forward to an update from Nigel in the coming days .

The purpose of MMGA is either a cheap out of court settlement at the ICSID, a cheap sale of our 75% of Dathcom or to drop all arbitration and let Zijin have the north and proceed with whatever is left of our claim to RD. Zijin are clearly happy with just the north and MMGA agreeing to proceed with the south would mean they or the DRC government don't have to pay us anything.
An additional consideration is that MMGA and their goons on social media are constantly talking about resumption of trade for AVZ. Bin Guo clearly needs his money and I suspect some of the others behind this do too so that is a key reason why they have acted now. Also doing it through the AGM avoids needing the 5% to launch an EGM which could only be achieved by MMGA with Chinese names which FIRB would deny.

Yes I think RD is definitely still on the table albeit clearly smaller than last time and we would need to sign a waiver so would never have the ability to claim any of the rest back imo
This deal is what Zijin want. That's the offer they made to Cominiere in exchange for giving up all claims to the purported transfer of the 15%. And clearly Zijin are the ones that have most influence within the corridors of power in the DRC. We can't even get a reply to appeals that we have rights to within the mining code without involving the gringos. Zijin could have easily taken the whole tenement. Extremely convenient that the bit we drilled is still sitting there ready to be used as a bargaining chip imo
Ok , so you are confident there is something on the table for AVZ re RD . Are SH better off if Nigel accepts the RD compromise Or are SH better off going to ICSID ? If AVZ would like to pay me a nice salary I'll go either way . Otherwise take the compromise and lets move forward . I know there are those that would rather lose all their money rather than compromise . I'd suggest they have peanuts invested . IMO
