I think CATH will provide litigation funding to the end to ensure they don't loose the value of the 10% (thereabouts) holding in AVZ to the Americans.

This time they've stated:
"The Australian has reported that AVZ might walk away with up to $1.5bn and a royalty. However, KoBold clearly wants to pay far less in cash upfront given the risks in the DRC and the depressed lithium market."

Not clearly! what's the source? It's all fucking bullshit!
AVZ would have rejected that figure if it even exists.

Sam, you know I keep copies of everything that comes out about AVZ. I’m not really interested in following KoBold’s bullshit anymore, I believe the best thing to do is wait for AVZ’s announcements and trust that Nigel and DLA Piper have the legal high ground and the will to continue fighting for our best outcome.

Perth-based AVZ Minerals’ Congo lithium hopes hinge on US envoy’s talks

AVZ and KoBold representatives want to nail down a deal on the future of the southern portion of the Manono deposit from the talks starting on Tuesday.

If all goes well, AVZ could on-sell the Manono interest for up to $US1.5bn ($2.38bn) plus a royalty. But there is no assurance of any outcome, favourable or otherwise.

A deal will depend on the US standing up for AVZ’s legal claim over Manono, which AVZ has separately tried to assert through international justice. It is understood California-based KoBold wants to see AVZ “appropriately compensated” for Manono.

The US has indicated it is willing to back AVZ retrieving the southern licence to minimise antagonising China.

KoBold first cast its eye over the southern part of the deposit last October. It was invited to assess the disputed project by DRC-owned mining company Cominiere, which is involved in a legal battle over the asset with AVZ.

The US wants any sale by AVZ to not be complicated by residual links to China’s CATL – the world’s biggest electric vehicle battery manufacturer, which in January provided $20m in funding to AVZ to help the company finance the legal battle for Manono. It is understood both the US and KoBold favour a change of ownership based on the DRC and AVZ discontinuing legal action.

  3. Commit $1 billion for project development over a 5-year timeframe
  4. Establish clear boundaries and operational independence between the two zones
This arrangement offers a pragmatic solution that acknowledges the political realities while allowing development to proceed after years of delays. The agreement requires several conditions to be met:
  • Formal regulatory approvals from DRC mining authorities
  • Resolution of pending arbitration cases
  • Environmental impact assessments
  • Community benefit agreements with local stakeholders

Then the agreement requirements including the first condition to be met being the formal regulatory approvals from DRC mining authorities, which could be what the signing last week was about

The next condition to be met being the resolution of pending arbitration cases.

My view is if KoBold offered us fair value a deal would have been done, so until they do, they won’t get past this condition

Maybe that explains things to shareholders here, maybe not, I don’t really know because all of those parties that are trying not to include us are so full of bullshit that, like I said before, in my view it’s best to wait for AVZ to announce things as our BOD are the only ones who are abiding by the international laws and not talking bullshit.

What I do like that KoBold has done, is make public statements that we can use to hold them accountable and great work by Nigel and DLA Piper putting KoBold’s agreements in the hands of the ICSID

Maybe it's because KoBold is now entering territory that is borderline illegal until they compensate us. It's not exactly ethical, and they don't want to promote it, but I think it's the only way this can be done. They have to obtain the mining licence first — which goes against the international court ruling — and then compensate AVZ. After that, everything becomes legal and they can promote it.
It might sound naive, especially after everything we've been through, but I just don’t believe they want to steal it. They’ve also publicly confirmed that, by stating that AVZ must be compensated.

I think you have clearly articulated what many of us have understood for some time.

Robust journalistic scrutiny and analysis are regularly replaced by mindless regurgitation of previous commentary. Social media commentary also tends to suffer the same fate, but posters can be forgiven for not having all the tools and networks that are available to journalists.

While some articles, such as those in the Australian and AFR seem to be agenda-driven and clearly lack credibility, journalistic commentary generally is just a dumbed down approach with a word changed here and there to give the impression of independence. However, most tend to be just lazy versions of previous articles.

Whenever I read, KoBold Metals - backed by billionaires Bill Gates and Jeff Bezos, I just jog on in the knowledge that the article is probably just another vacuous copy and paste of someone else's copy and paste.

Oh, it's payday whoopee.

Doing proper due diligence costs money. Are you going to spend a buttload researching everything, ready to put in a bid to AVZ if you think Kobold already have it sewn up? That's the angle Kobold have been playing, except half the field did their due diligence 2-3 years back and not only know the issues, but also who they need to grease and how much to make them go away.

I'll be quite surprised if the Chinese let this slip into US hands. They have worked very hard keeping their stranglehold on lithium supply. They have a solid record of manipulating lithium prices and trying to get Manono for nothing, but if their current options are to pay more or let it go to the US, I think they'd prefer to stump up the $$$ and keep it for themselves. The orange narcissist has the midas touch in reverse so I hold little hope of him getting this into US hands, but I believe his meddling has helped AVZ greatly.

It’s sobering to realise just how few people and organisations have acted with genuine integrity throughout this entire ordeal. Kiki has. Nigel and the current board have. Beyond that? Very slim pickings.

If there’s any criticism of Nigel and the board, it’s that they keep getting sucked in by these less-than-honorable operators — KoBold being the latest.

The world would be in far better shape if there were more Kikis.

I reckon you nailed it Kulturica. If Kobold want this resource then this is the only way to proceed. There is no way known they are going to finalise the agreement with AVZ without securing an ironclad agreement with DRC first. To acheive this requires the undoing of all the shitfuckery that DRC et al have previously put in place and it would be virtually impossible to achieve this legally without bringing down the whole DRC govt including Felix so it is in Kobolds and everyone else's best interest to keep these negotiations confidential. Once this is bedded down Kobold can negotiate suitable compensation with AVZ then proceed with development complying with all relevant laws of DRC and internationally
Meanwhile respectfully and rightly AVZ will keep the pressure on via ICSID to make sure we achieve a satisfactory outcome.
