AVZ Discussion 2022

'I doubt anyone would think that'

Well it’s the logical action that would be taken by a party who only thought they could win if their opponents ran out of money after seeing said opponents get money one would think. Unless they think they can win, at least partially, for other reasons. The ’southern portion 95% of value’ comment isn’t the first time Nigel has tried to frame the idea of us only getting the non mica infested south as a positive outcome.

There were two other things that Nigel said at the AGM that really stuck out to me

‘The president now has a problem: either AVZ litigates or Zijin does’

I’ve been banging on about this for years now. And I don’t think the situation has really been appreciated by the majority of posters here. And as I have consistently said on this issue if I were in the DRC’s shoes I would take my chances in arbitration against the delisted exploration company that almost went bankrupt rather than the multi billion dollar market cap miner.

‘Expects legal proceedings to end 2026/2027’

This is the exact same time frame I mentioned a few months ago. Amazing the amount of dipshits that felt the need to attack me over this forecast when my main point was that management weren’t doing themselves any favours by not giving an accurate prediction of how long this will take. It’s a good thing that the majority of shareholders apart from the clowns still saying the ICSID will be done in 2025 now understands this fact im

The answer is extremely simple and the only ones that can't grasp their head around it are the one's that need to make the move - the DRC Government. A negotiated settlement would be the best outcome for everyone involved, i don't know what's taking them so long. Maybe they need someone with a backbone from the US to stand over them and show them how small they are.

I do genuinely ask the question.... How does Zijin litigate against the DRC in international courts without exposing its own complicit activities and willing fostering of and participation in corruption?
I would like to say that is the problem for the DRC and Zijin to solve, not AVZ.

Do not believe the BS the trolls try to spin here, on HC, or X.

The fact that they are still overactive is a pretty strong indication that certain parties are pretty nervous, each has their own reasons/interests in mind.

""AGM 2024 question time"""",is this a true indication who is really is nervous..."""""""MAYBE"""""""""ENFORCEMENT ISSUES"""""""

17/ Enforcement

Question 12
– Do you believe that after litigation, things will be in our favour

Nigel – Big question is enforcement. Maybe there will be a change of attitude or litigation will have to continue till end, and then look at enforcement

Just my shitty opinion, to be thrown in with all the other shitty opinions we've heard for the last 2 and a half years, but I think it's pretty clear none of the DRC or Chinese crooks involved give a flying fuck about a single court case, they're all in it together, the Chinese obviously have it over the DRC minions and thus far have it over us considering we've been robbed of an asset worth billions.

I cant help but think the Chinese have this well thought out and have their bases covered even in a worse case scenario they will all run off into the sunset after suing the DRC if theyre stripped of what they now claim is theirs, and the DRC official crooks invoved run the law in the DRC so none of them will be prosecuted, none, not a single one even if we win every court case. America dont care, Bidens a half-wit with dementia and Trump is going to protect anything the zionists tell him to protect, including Gertlers crimes and Israels blood diamond trade in Africa.

We can all stop talking bs about politics and who's going to jail, and America, Europe, this leader that leader blah blah blah, its all piss in the wind. None of the Chinese or DRC crooks will see as much as a fine let alone jail time (just like Gertler). If we win (and I bloody hope we do) all the crooks will continue to plead innocence and exonerate themselves in house, the international community will do fuck all, and we'll see more shitfights trying to recover our billions in damages, but bring it on. Screw them all.

Dont let my opinion ruffle your feathers too much, its just one arseholes opinion. I hope Im wrong and we see cash in our bank accounts before 2027 (or years later)

Oh and fuck two headed tommy, boatman, fatarse chinese gimps, and every other lame money worshipping vermin involved in the fraud. Im sure we'll see many more wild cards pulled from the Chinese arses as this carries on for the next couple of years. Will be interesting to get a verdict when Zijin have already started pulling product out of the ground. Watch the DRC go beyond bankrupt when theyre sued from every angle, but none of the DRC crooks will be around to face the music, theyll be in some French villa protected by some other arseholes theyve paid off

99,9% of the time justice in this life equals who has the most $'s and most political sway and lets face it China owns America on paper, they completely own the DRC, and day by day America becomes more of a fickle hypocritical loose cannon as it backs the war crimes of Israel and allows psychotic zionists to rule the white house

Yeah wasn't really looking to solve it for them

It was more of a comment as to how on earth could Zijin take the DRC to international court if they end up unhappy with the Manono outcome

Surely that would bring about the potential to massively expose (on an international stage) Zijin's own litany of wrongdoings in all of this shitty saga

Maybe they're not scared of that?

I don't know

But it would be like the stupid fkn dope grower with a nice hydro setup and lights in his back shed calling in the cops cause someone broke in and stole his fkn plants.......

Haha, that's nothing compared to what's awaiting DRC's kleptocrats and Beijing's baggage handlers.

Carlos are you still of the belief if we let the North go we can resolve these matters and move forward with Roche Dure ?

Re your comment , taking on AVZ rather than Zijin . Zijin will have the DRC Gov over a barrel if brown paper bags changed hands . Celestine Kibeya tape was a warning shot . imo
Perhaps the additional pressure should be put on Zijin / China
Prevent goods being exported once found guilty of corruption.
China does not control the railway or ports .

I'm noticing a lot of moderation recently for posts that would normally make it through to the keeper:unsure:

An interesting, albeit off topic, question came to mind, who owns thestockexchange.com.au or for that matter that other place that cannot be mentioned?

"Thestockexchange.com.au is a free service that boasts real-time AI (artificial intelligence) moderation of posts for negativity and harassment. The site is limited to most popular stocks, top rated posts, and most discussed threads. Background checking of posters history is available. The search function accesses posts on specific stocks."

So Zeebot is an actual bot? 🤫

PS. In case this is my "last post", pun intended, so long and it's been nice getting to know you guys & gals.

"I would take my chances in arbitration against the delisted exploration company that almost went bankrupt rather than the multi billion dollar market cap miner."

You're assuming that
  1. in both situations the DRC has an equal chance of losing
  2. The outcome is equally bad
0. I for one don't think zijin is going to litigate in any serious manner. They know full well their entire modus operandi requires operating in legal gray areas and obfuscation. Do you think Zijin would willingly subject themselves to interrogation by ICISID or similar?

1. Zijin may take the chance to using some litigation to try and screw some concessions out of DRC, but they were being dodgy from the start so it's a gamble for them whether they'll get anything, especially if they have to pursue it in local courts (ie avoid international dispute resolution)

2. In such a situation, the penalities for Zijin not getting a portion of the northern tenement which it knew it didn't have the rights to aquire would be peanuts compared to what DRC faces in it's cases with AVZ.

So yes, Zijin a much more formidable opponent to fight, but it would be a very different fight with very different outcomes.

Hi all,

This is completely unrelated to my previous post. Something I just came across that I thought would be a nice reminder to us all about what we're fighting for and the reward that waits on the other side...

1000034139.jpg

With the exception of greenbushes and pilganoora, EVERYTHING else looks like CRUMBS in comparison (the former look merely 'small'). We're not going through this shit-show just for any old deposit.

I love that they had to break the scale in order to even fit it onto their chart.

Anyway, it's been a bit rough on here lately, I hope this is a nice little reminder of the potential upside we still have, and a little bit more energy to keep up the fight.

Have a Merry Christmas everyone!!!

• AVZ expects to drawdown a first tranche of funds during December 2024. •

The facility will provide funding for legal fees incurred by AVZ and its related entities, including expert fees, local law support, investigation costs, arbitration and court fees and related activities

The DRC files criminal charges against Apple over 'conflict minerals'

The Democratic Republic of the Congo (DRC) has filed criminal complaints against tech giant Apple’s subsidiaries in France and Belgium over the use of “conflict minerals” in their supply chains.

Lawyers representing the Central African country, claimed in a statement this week that Apple’s subsidiaries in Europe are using conflict minerals sourced in sub-Saharan Africa and accused the company of “using deceptive commercial practices to assure consumers that the tech giant’s supply chains are clean”.

So, the DRC kleptocrats, who rule one of the world's most corrupt countries and with an abysmal record of human rights violations, forced relocations, misappropriation and arbitrary expropriation without compensation think that Apple is using conflict materials in its supply chain.

What fucking hypocrisy.

Cheers

Merry Xmas to all the good and decent members here.

Would DRC be questioned if they pay for the fees for this case themselves at least or ICSID admin just reject the application because DRC have outstanding fees and fines if any to be paid?

Yes this was Announced by AVZ in DEC 2024
Just ongoing advents everywhere..?

Company Statement AFP Investigation AVZ Minerals Limited (“AVZ”, “the Company”) acknowledges that, as referred to in recent media reports, the Australian Federal Police (AFP) have executed search warrants in respect of allegations of bribery related to the Manono Lithium Project in the Democratic Republic of Congo.

AVZ previously obtained legal advice in relation to the management of the bribery and corruption risk associated with doing business in the DRC. That advice was leaked to and reported by the media in February 2023.
