It looks like a document to extend the EP for 13359 right?
It's currently listed under Cominierie, it has been for a while, and yes we as AVZ inverstors don't like this, it's been a worrying thing for us.
AVZ BoD recently explained what's going on with it and provided a reasonable explaination (better late than never). Fighting bastards indeed.

Whatever this is we will find out in time.
I don't find it to be something immmediately frightening, though no I don't like it.

You're very quick to incite panic and call something bad Roon.
It just looks like a licence extension.

This reasoning is solid.

Just for some clarity:
  1. late 2022 Cominiere writes to MOM requesting termination of JVA because they have hurt feelings
  2. MOM cancels pending PE in ministerial decree 0000031, citing unharmonious relations (this is fucking laughable and not a valid reason for termination, one of the main points of argument for ICSID)
  3. Cominiere uses 0000031 and the belief that 13359 has been returned to Cominiere to file for termination at a local DRC court - they claim that because Dathcom has lost its asset, the JV no longer has reason to exist
  4. AVZ leadership sniff out this shitfuckery and obtains an emergency injunction (EI) against Cominiere
  5. Cominiere believes it has not breached ICC injunction, because it filed to terminate before EI was handed down
  6. With all this going on Cominiere also applied for a court order to have CAMI records updated, which was granted by the looks of it.
This hopefully clears things up, a lot of this is Cominiere acting under its own snack land fantasy scenarios, and the DRC legal system is so fucking outdated, they just go about doing whatever the fuck they want.

AVZ have the proceedings in motion for the outcome Carlos has pointed out, MOM comes over the top, which I stake my ambidextrous left/right them/they/it pronoun testicle on.

PS Cominiere's entire operational process is based on what it wants to believe, with utter disregard for what actually is. Hence what i said about the hydro plant as well, they just doing whatever the fuck they want.
Best take on the current situation so far

In my opinion, the recent claims and documents from MMGA raise some (more ethical) concerns. The scope of what's happened here is deliberately (and IMO obviously) being kept from us

Let's not forget that MMGA is not exactly known for its integrity. They are led by Peter Hulich, who was previously a director and has been linked to questionable people and questionable practices, including issues with his date of birth. Furthermore, there have been questions about the identity of a mole within the company leaking information. These claims have been made by shareholders and have not been denied, none of the claims by shareholders have in fact been denied.

It's also worth noting that MMGA appears to be backed by the same Chinese entities that are causing issues in the DRC for us/AVZ.

We need to consider whether these individuals are acting in the best interest of the shareholders or if they're simply motivated by personal gain. It's important to keep things in perspective as long-term suffering AVZ shareholders. On evidence so far it would seem quite conclusive.

Our BOD is currently facing a range of challenges from every which way. We were warned about a potential disinformation campaign from MMGA, and it seems to be in full swing as we approach the Annual General Meeting (AGM). MMGA's proposals are non-existent their qualifications for the task at hand are sorely lacking as too their experience in country. Vote NO against MMGA !!

If these documents are indeed genuine, it raises obvious questions about more violations of the DRC mining laws by those involved. We're also making progress with the ICC, and have the ICSID looming overheard both of which have the power to render any forged documents or paid-off local court decisions irrelevant.

Despite some setbacks, such as the (false) loss of our ML decree due to DRC mining code breaches, we've taken steps to protect our interests through legal channels. Even if MOM appears to be against us, the ICC rulings will likely force them to correct their mistakes.

The current situation from MMGA and Comineire seems fraught with contradictions and information gaps. The increase in accusations and misinformation might be a sign that we're getting closer to a resolution.

I suppose the question is whether the ICC or some form of MOU will come first?

Had to completely rework it as the original was strewn and plied with a bountiful excess of swearing that was linguistically beautiful, so much so it took away from the message. Oh what could have been. Basically it was crude as fuck.

Either we're going to be part of a major historical precedent destroying corruption in the DRC or we're getting rat fucked and the MoU is just a smokescreen for them to buy more time for a settlement. Beijing has cracked the whip imo

It would only give us more ammunition to win the case. It just doesn't make sense. And then why would Comineire continue to be fighting us? Why would they not just ignore us and keep their mouth shut while they continue to attempt refurbishing the hydro plant. IMO they are on the back foot and it isn't long until the ICC hearing decision arrives.

All I'm saying is, it seems very suss especially with Tommy's article. We know from past experiences that the detractors tend to time things when it benefits them.

I will admit the AGM is gonna be wild and I for one am excited 😂

Let's not forget there is an official ASX Announcement stating that Nigel has had a conversation with the president.

Then consider that Tommy the twat released his article today and now all of a sudden these documents show up on twitter and through MMGA.....

Remember what Nigel said last AGM "don't believe everything you see on social media". I'm not saying to not interrogate things, but it all seems VERY suspect.

Also, as other mentioned, if Comineire already had control, why are they doing everything they can to continue fighting us. It just doesn't make sense. What makes sense is they are on the back foot.

We can't keep the chronological order of things straight most of the time, there's so much documentation and FUD floating around.
How long will the claims and counterclaims take to sort through it all in court?

We will find out anyhow if it's real or not.

It would hardly be a surprise if it isn't real with all the deception & fraudulent behaviour already displayed.

If it is real could definitely explanations for that too, meaning it gets reversed.

Ive lieterally woken up, looked at this and said to myself theyre comparing the 2 docs to see if the white one is a fake?

So apologies if im wrong - been a big week. lol

My thoughts:

if you were going to forge it you would try to match the font style of the order number. Such a deliberate change in style of the numbering - you wouldnt do this on a forgery i doubt? Or this tells me they are updating their systems to now include the order numbers digitally instead of with a stamp.

it has marks where its stapled on the second page but wheres the staple mark on the first page if assuming the 2 pages were stapled together.

shadow at the edge of the paper and a few small imperfections but the only thing that annoys me is the signature at the bottom of the first page on the new one is different to the style of the other ones first page, i.e, its centred and almost level meaning its very deliberate and signed carefully wheras the first one was done in a rush.

Morning ladies and gents, some great analysis so far - trying not to panic as that's certainly what the detractors want.

Nice to see Minoli earning her keep and having a meeting with Felix (first time i've seen that);

The shitfuckery has ramped up exponentially since management we're forced to acknowledge the existence of MoU discussions last week (tommy article, MMGA new dossier and fatal documents popping up within 3 days).

ICC on the burn, MMGA desperate to get on our board (with no asset) and new highly qualified Directors having recently been hired (less enthused about that). ICSID discovery also commences soon as well I believe.

I'm Trying to keep a level head although it's fucking scary, always remember Nigel has 50M + AUD to lose if this goes to nothing.

Last announcement said that AVZ will look at Cominiere breach of ICC ruling at a later date. Why? Why not now? Get a ruling for 50k a day now. Start the tally. Put pressure back on them. Fight fire with fire

Interesting if both there at the same time. Could be why AvZ haven't released a picture of the meeting 🤔
