Another thing. Article 11.1 (c) of the Dathcom JVA clearly states that any dispute among parties to the JVA must be settled by 3 arbitrators at the ICC. The fact that Zijin sought only 1 arbitrator and the ICC agreed is already an admission by Zijin and the ICC that Jin Cheng are not a party of Dathcom imo

Also a wise move on AVZ lawyers behalf to place that stipulation in the JV. Three arbitrators are far harder for a chinese influence to bribe.

I have no idea why they wanted only 1. Most likely because they thought it would be easier to bribe 1 rather than 3. But they clearly didn't read the JVA which they claim to be part of or they would have requested 3 like AVZ did. It's a colossal fuck up on their behalf imo

Agreed on the bribery aspect too. Pretty sure when it was all announced we all wanted 3 arbitrators to try and make it harder for bribery to affect the proceedings

The US won’t be able to cut China out of the critical minerals supply chain even as Washington seeks to diversify its sources of the ingredients that go into everything from electric vehicle batteries to solar panels, a top Biden official said on Friday.

“This is not about China,” Jose Fernandez, the US under secretary for economic growth and the environment, told a briefing in New York. “We are perfectly happy to work with them on this and right now we purchase many of the minerals from Chinese companies. It’s about diversifying.”

China’s key role in the processing of raw minerals means it will remain a key US partner, Fernandez said, especially because those minerals are a crucial component for the batteries that power electric vehicles. The broader use of EVs is a central tenet of the administration’s climate change efforts.
“The world needs them to be involved — the broader picture is climate change, and we’re not going to solve the climate crisis without the involvement of the PRC,” he said, referring to the country’s formal name, the People’s Republic of China.
Fernandez leads a State Department initiative called the Minerals Security Partnership, which aims to help funnel foreign investment and western expertise into the mining sectors of developing nations that help supply key raw materials such as lithium, manganese and cobalt.
“China is the second-largest economy in the world, a major trading partner of the US,” he said. “We will continue working with them while pursuing our interests and protecting our companies and criticizing them when we feel they should be criticized.”

The amount of recent conferences is doing more damage to my brains than 10 bottles of tequila.

We see the normal show as we are approaching the ICC hearing, there must be some nervous people running around in the DRC.

The bloody MoP and MoM don't know anymore which bloody conference to go to and the government planes are fully booked out with all them conferences happening at the same time.

The Private Sector Subcontracting Regulatory Authority (ARSP) has published on its website (www.arsp.cd) the list of 1200 companies operating in Kinshasa and removed from the subcontracting market after violating the law on subcontracting in the DRC.

The DG of this public institution, Miguel Kashal, specified that it was at the end of the inspections carried out by judicial police officers that these companies were listed as "illegal" with regard to subcontracting.
"We launched judicial police officers on the ground and at the end of the control. We deregistered 1200 subcontracting companies, which were not eligible for the subcontracting market. They were companies that worked illegally and most of which were paid abroad, something that constitutes a loss of income for the country's tax administration and escapes the repatriation of capital to our country, "said the DG of the ARSP.
Some of these companies have been deregistered for non-compliance with the law in the constitution of their articles, with foreign shareholders holding more than 51% of the shares in violation of the requirements of the Subcontracting Act and the regulatory acts in force.

In addition, the ARSP notes that it has discovered several cases of fraud against the law, including the name-name phenomenon that promotes listed partners who actually have no part, and all these companies will be notified by September 25, 2023.

According to the AARSP, the DRC loses about $8 billion each year due to violations of the subcontracting law in the private sector.
