The lanterns of the Battery Metals DRC-Africa forum died this Thursday, September 21, 2023 in Kinshasa, after two days of intense work. In several panels, exchanges were heated in view of the creation of wealth in the value chain of the battery metal industry in the Democratic Republic of Congo, the Republic of Zambia and Africa in general.

During these two days, discussions focused on several points mainly on the battery and metals industry to ensure a sustainable, transparent and responsible supply chain in the DRC, including the establishment of a reliable financial system for the valorization of the battery metal value chain; promoting the production of batteries as a springboard for economic development for the energy transition.

Also, the strengthening of regional cooperation through free trade agreements; the development of the battery industry in the DRC that will contribute to job creation and poverty reduction; and the linking of mobility projects, investors and EV manufacturers, were discussed.

After several explanations in the discussion panels that led to a clash of ideas, the Congolese DRC Battery Council (CCB) through its Deputy Director General, Vuko Kakule made a list of recommendations and guidelines by inviting the Government of the Republic and all actors to appropriate them.

These include:
- In accordance with the DRC mining code, the establishment of a General Industry Law that would be called the "Industry Code";
- Pool efforts between African states such as the DRC and Zambia and ensure that investments in the mining sector and the processing industry are effective for their knowledge, skills and technology in order to perpetuate the creation of wealth in the value chain of the battery metals industry in Africa in general and in the DRC in particular in a privileged partnership;
- Provide own means of mutualization between the DRC and Zambia while drawing inspiration from Chinese, European and American models;
— Pursue geological and mining research to improve knowledge of mineral resources;
- Measure and certify the mining deposit according to profitable processes and economic plans;
- Improve the governance of the mining sector by strengthening the capacities of state actors;
  • Etc.
Organized by VUKA Group, this Battery Metals DRC-Africa forum has seen the presence of several personalities in the mining sector from all over the DRC and Zambia. He turned for two days around the theme: "Creating wealth in the value chain of the battery metal industry in the DRC and Africa.

The mining licence was cancelled without any legal basis in an act of the prince. Conflicts between shareholders of a JV as a reason for cancellation of a granted PE is not listed in the DRC Mining Code. The reasons allowed for forfeiture are the 'non- payment of surface rights' and 'the non-start of the works' which is not the case for Dathcom.

Article 48 of the DRC mining code states 'The mining and/or quarry rights may be withdrawn or brought back, without retroactive effect, by the granting authority in the event of illegality during the granting, in three months following the publication of the award decision in the Official Journal or, failing that, within three months following the date of becoming aware of its existence, either at the request of an injured third party, or at the granting authority initiative.' None of these apply either.

The cadastral, environmental, technical and compliance favourable opinions remain valid to this day and have never been declared illegal and no reason or illegality in the granting procedure has emerged. This is completely abnormal and legally untenable.

Not sure what else you want AVZ management to do other than seek a remedy through international arbitration unless you want to give control of Manono to China. Maybe I answered my own question just now as well as yours.

On Wednesday, September 20, around 1 p.m. Kinshasa time, during the session dedicated to stakeholder interventions entitled “What you need to know about the batteries and metals industry”, Mr. Serge Ngandu, Director of Corporate Affairs of AVZ Minerals RDC, presenting the project to the audience, declared, regarding the Manono lithium project, that “discussions are very advanced with the Government of the DRC today on this very sustainable project, economically profitable with a clear vision on clean energy and community development.” And continued: “AVZ is committed to developing the Manono project according to the highest ESG standards and becoming a significant contributor to the global lithium-ion battery value chain. ”

Before this exercise, Mr. Serge Ngandu had started by presenting the DATHCOM MINING SA project to the investors present in the room but unfortunately, he had expressly talked about the para-public COMINIERE SA.

An attitude which provoked the anger of Célestin Kibeya Kabemba, formerly its General Director present in the Capitol of the Kin Plazza by Rotana hotel like all the other partners, investors, experts and researchers interested in this mega project.

Taking the first floor in the part devoted to the question and answer game, the boss of COMINIERE SA promptly asked (demanded) the Director of Corporate Affairs of AVZ to correct his remarks and above all, not to ignore the existence of COMINIERE SA as representative of the interests of the Congolese State in the Manono project. Before asserting that DATHCOM has already been legally dissolved. The same applies to the termination of the Joint Venture contract between AVZ and DATHCOM MINING SA, which is in the process of being liquidated for the benefit of COMINIERE SA since April 4, 2023. It is a young company created on April 12, 2010 following the decision of the General Assembly of shareholders namely, the Ministry of the Portfolio and the National Institute of Social Security (INSS), currently the National Social Security Fund (CNSS) . The share capital of COMINIERE SA is 90% held by the Congolese State through the Ministry of Portfolio and 10% by the CNSS.
