Should we all send this to the AFR?
Need to include MoneyBags points in a previous post regarding the work AVZ have done to reach this point, it is gold. If some of the more gramatically gifted(retired) posters could create a generic letter that we could distribute widely I am sure it would be embraced by many. Possible recipients:

My perception is that the longer this problem lasts the weaker AVZ's position becomes. I feel that the DRC Govt. is now getting up steam to be reelected, and they need to shore up support even with corrupt officials. When you add the Chinese influence on the economy these factors diminish the importance of AVZ and Manono. Irrespective of AVZ's legal position ( which may be relatively strong ) the only solution i see is that AVZ needs to do deals with Dathomir and Comminiere. The strategy needs to be 51% of something is better than 75% of nothing.
Dathomir may be the easiest, and if AVZ assign their rights to Cath and they buy out Dathomir's 15% this removes one obstacle. The terms that AVZ has with Cath may include some reimbursement to AVZ on work completed to date. Cath then have 15% plus AVZ sale for 9% gives them the 24% of the project ( AVZ back to 51% ).
By isolating Comminiere with its 20 or 25% ( ? MMCS ) AVZ can remake its offer for the 10 or 15%. AVZ have then shown that in spite of corruption, they have made an attempt to finalise the shareholder issue. This gives the DRC Govt an excuse to support AVZ by overriding Comminiere if they are being obstinate. If that doesn't work they may have to accept Zijin as a partner.
The thrust of this scenario is to get the ML asap and be prepared to compromise. Without the ML AVZ is worth peanuts.
AVZ also has a number of issues to also finalise. The hydro power plant, The dismissal of the outstanding fine and gaol warrant against its Director, the collaboration agreement and the SEZ.

Even if AVZ gets past this ML situation i still see pressure being applied for a takeover of Dathcom. My impression is that Chinese interests already have a strong holding in AVZ. To counteract this block AVZ needs to get more outside support from possible US or Europe corporations.

The next couple of months will be interesting and we can only hope that shareholders get some reward for their investment.

If we get shafted will the legal action we take put further delays on the project ? Would give us some leverage if it does .
Nigel allegedly said at one of the roadshows that if the DRC government took the tenement off us then we would seek 10b in damages at the ICC

My conclusion from that is if we get shafted then the project will go ahead without us

I agree the longer we wait the weaker AVZ's position becomes

It's already taken too long which is partly the reason for the DRC now forcing our hand

There needs to be a watertight and appropriate deal done to move the project forward, AVZ trading again and the mine progressed

AVZ shareholders need a mechanism to be able to sell their stock if they so wish.....God knows we've been made to suffer enough

It is absolutely futile for AVZ to continue to hold out and rely on the law to provide the correct outcome here

The DRC has proven to the whole world that the letter of the law there means absolutely nothing and that legal rights and good legal title are concepts that are unenforceable and can simply vanish at the stroke of a corrupt ministers pen

From what I can see ICC rulings mean fuck all and are not enforceable

You might win the case but you'll never see the money

Ok cheers . I thought that would be the case . So it's basically now or never. Court case would take years with no guarantee SH will see any money . F--k that .

Time for legal action is over.
The goal posts have been set .
Come up with an amicable solution .
You have all of the tenement to work with .
Over 100 year mine life.
At 10 mtpa Zijin and all else will make a very good profit.
Courts equate to potentially loosing rights..
Nigel and lawyers want to take the risk .... Certainly retail shareholders would not risk it.

It would also be useful to adapt this a little to simply highlight the corruption and the struggle that AVZ have been through in an attempt to gather support from relevant Australian government agencies. I just use his words again with the most spotlight on the cancellation part of the license’s not the nothern part. But you are right the cancellation of the decree’s have a impact of the nothern part. But in the end I’m not sure if they got added together automatically in the case all license’s got canceled. When this Klaus cancellations shit isn’t true then of cource the license is one part again. But who knows what cominiere/zijin/klaus negotiate secretly in the dark. Or better who they pay to get what they want.

And you are right about the part the drc want to move with the project forward. But again who knows if they don’t use the violation of the jv contract between dathomir and cominiere to kick us out? The Chinese have massive influence and the usa just started to invest. And of course without avz and giving it the Chinese the project would be running for 3 years already. And it looks like the Chinese have learned to hold the drc tight they have to make better deals with it.

If nigel would be smart….we would never be in this situation. The next few months will show what paths we still can gohe reports

The reports about NF at RS and AGM, paint a picture of an incredibly arrogant man.
That is a huge worry as it invariably is a mask for incompetence.
His actions upto now would not contradict that.
