What's the go with h00ts on HC?

He seems to be posting / have an agenda with AVZ...

What a rollercoaster of a week it's been. My first thoughts were to take a TO offer for the whole lot because Zijin will no doubt affect the construction timeline if they "lose" their share.

Then I was of the opinion to fuck Zijin and take this thing to ICC as long as it takes, but as everyone has suggested the MoM may be threatening lose of Dathcom ownership and Felix would have stepped in by now if he is to save the day.

It is looking more and more like there may not be around any of this without Zijin's involvement and the Dathomir claim is hanging around like a bad smell. Dathomir don't want to be involved with the project they just want money and Zijin just want to be involved no matter what so now Nigel needs to make his money.

- AVZ still have "legal title to 75%"
- Comineire sell 10% to Zijin and out of good faith they pay $100M to DRC for it. (Zijin also agree to pay 15% CAPEX).
- Comineire concede the remaining 5% to AVZ out of good faith (AVZ pay $50M)
- Zijin pay $50M to Dathomir as a condition of negotiation.
- All parties close ICC cases and sign conditions to not allow anymore ownership claims.
- AVZ only sell 9% to CATH (with a condition to still pay the $240M upfront but $150M under project payback conditions)

AVZ 71% / CATH 9% / ZIJIN 10% / DRC GOV 10%

No more ownership disputes.
No more concern about losing the northern half of 13359.
No interference from Zijin during construction as it is in their interests to succeed.

At a quick look the suggestion doesn’t look too bad providing it’s all legally waterproof as (even though we all hate) Zigin, if they could build the infrastructure quicker than anyone and if it got us to production in a year rather than two….

Well there’s your $5 minimum share price in a year…. ($10 the year after @Nuts 😉)

Construction times are not my area of knowledgeable though, and @JAG would have to be the foreman.

Dathomir aren’t owed a single cent, if you looked into the detail you would find that out.

Dathomir aren't owed a single cent but if we don't have to pay them and they still end up going away, who really cares.

I might also add that if the negotiations went trough like that:

AVZ removes suspension and retail holders with money locked up can sell instead of having it hostage for another 12 months.
AVZ through Zijin will have access to good communications with Incompetent DRC Gov officials (which seems to be the majority)

It will not be in Zijins interest to fuck around the mine build because the quicker it is built, the quicker they start printing money.

So much speculation around but as it stands all we can do is wait it out for more news from the company, which under the current circumstances better be in bloody short order!
The board better be there in the DRC themselves sorting this shit out!
Personally i think they have been a bit arrogant regarding the situation and considering the jurisdiction probably not the best approach.

Over the last 6 years in the DRC, AVZ have carried out Soil Sampling, Field Mapping, Consulting, Drilling, Metallurgical Testing, Completing a FEED Study, Environmental Study and Impact Assessment Reports including Groundwater Management, a 160 page Definitive Feasibility Study, a SEZ Agreement, Tendering for Mining Infrastructure, Legally Obtaining and Paying For an Increased Share of Dathcom, Obtaining Several Offtake Agreements for both Lithium and Tin, Raising Capital, Negotiating Funding with Pan African DFI’s and a Funding and Offtake Agreement with CATH, Presenting at the Battery Minerals Conference, Legally Fulfilling all Requirements to Obtain the Mining License, Including Receiving the Ministerial Decree to Award the Mining License and producing an 85 page Sustainability Report, Spending millions of dollars and Supporting the Local Community….

Now corrupt State owned Cominiere is working with the Minister of Mines and Director General of the DRC Mining Cadastre (CAMI) to deny granting AVZ Minerals a Mining License also allowing Chinese ZinGin to illegally acquire 15% of Dathcom as stated in DRC Inspector General report.

Remember this if you are thinking of investing in mining in the DRC

I think the MoM can re-assign 13359 away from Dathcom.
However AVZ's ownership of Dathcom has nothing to do with MoM. It is of course a hollow win.

Just a minor thing to consider.

IMO IMO IMO

Taking 13359 away from Dathcom, after all its work carried out on the lease over the last 6 years, including proving the resource, will raise internationally lots of eyebrows and would do the DRC not a good service.

Re-considering a proven (by its own financial agency) fraudulent transaction, is politically a much smarter strategy.
Negatives of this move is less brown bags.

Haha has trying to still bring some humour to this place otherwise what's the point!

Felix wanted win win partnerships.

AVZ - Would end up with 71% instead of original planned 66%, as well as no more ownership issues and still with the same amount of money upfront from CATH
DATHOMIR - Paid out from a corrupt Zijin
Zijin - 10% ownership in the project for a total of $150M
Comineire - paid the $100M from Zijin
DRC - Project moving forward with no more squabbles.

The timing of the release of the decrees was so Nigel had to race away from Capetown to keep the gates shut.

That is clear as Klondike.
