That’s another matter and I don’t think that that would play in issuing of a new decree tbh ; that Dathomir case , I’d be very surprised if that finds any legs what so ever, but yes it still appears to be a ghosting issue which needs to be cleared off the table . There’s an impending ICC case to deal with that thankfully.

Best case scenario here and a lubed up Avenue would be Zijin issuing offical letter stating that it has no legal holding on the 15% and from there everything should move on with AVZ issuing a sum ; if zijin or other choose to come in at a higher price , we’ll there’s nothing we can do about that as everything is above board

In AVZ announcement, there are two Decrees. Must be 00031 and 00032 according to Acaj. They have shown 00031 somewhere however did not see 00032

I really don't get this.

Did AVZ agree to split the northern sector of 13359?
Did AJN then apply for the Northern Sector of 13359
Is not Nigel a 10% stakeholder in AJN?
How is this NOT a conflict of interest by Nigel?

How are they able to still present this to investors if 13359 is no longer split?

All of the above is apparently true.

Nigel's holding of 10% of AJN is not a conflict because he says it isn't, the guys never said anything misleading before after all.

I will be frank - this is a mess as I psoted before. This could have been totally resolved way back if the DRC government simply stepped in and it hasn't. I repeat it hasn't, and that is a fact. If corruption was the basis of how Zijin got 15% it should have just been dealt with immediately by the DRC government and said corruption has occurred and we are reversing everything today so that this gets to mining this side of 2025 - refer Post #:65456320

The fact nothing has been done, and in effect the Ann essentially say between the lines AVZ sort this out and get this to mining orelse we may take another action implies basically AVZ accept the situation to get this to mining immediately and therefore you currently have 60% and move on. Get this to mining fullstop is the message here and we are not doing anything to resolve the ownership dispute - the 15% AVZ is lost even under this announcement and basically AVZ would have to take legal action to get to 75% and that means time, again means time. I do recall the dispute around change of ownership here a while back when AVZ got the tenement which was lack of exploration effort on the part of the previous owner, so DRC wants this at mining to repeat, so Dathcom now has to get it to mining and that means the dispute on ownership has to be settled quick fast, and so IMO the only way it can be settled quick fast is for AVZ to walk away from its 75% claim. It is obvious AVZ was blindsighted by this announcement as well.

Sort it out or face the consequences is the message in Ann. Hope I am wrong, but there is minimal in this announcement that I like given the legalistic nature of it and the difficulty in understanding the legal jargon in it, but the intent is clear too me. The telling paragraphs of the announcement are the DRC comment - resolve the issue and get it to mining. The only way this will get to mining early and the legal issues go away is AVZ conceed which implied too me crime can pay in the DRC, unfortunately. This mess could have been sorted out by the DRC government - corruption can be addressed immediately if a government had the will especially when seeking to show the world DRC is open for business and sovereign risk is low. Clearly the DRC govermnment has 'words' that are not accompanied by actions.

All IMO and hope I am wrong, but after nearly a year and this I am not confident AVZ will get its 75% and the consequences of not getting this to mining appear stark IMO in this announcement.

I am sure a lot here will disagree with this post, but that is how I am reading it. In plain English AVZ should state what does the announcement actually mean to AVZ in terms of its ownership stake, and what actions can the DRC government take if mining is delayed here by ownership issues?? I recognise others have interpreted the Ann differently, so interpretations will differ based on the Ann and it is possible my interpretation is based on the fact I am quite annoyed in reading it. Time to mellow.

Why is Scarpa saying (MoP says) "Ziljin have 15%"? I thought someone reported "MoP says Dathomir's claim to 15% still stands"?? I'm confused??

Surely management at least consulted Cominiere before agreeing to partition the tenement on Dathcom's behalf. As long as they did there shouldn't be an issue because we control Dathcom. Interesting it doesn't mention that the waiver was not allowed under law, because that would mean the MoM was negligent in her duties.

I'm thinking they were possibly mislead with the idea being they needed to give up the north to then apply for the a renewal PR licence for 5 years. This obviously didn't happen and they have been fighting for it since.

Who knows, the whole thing makes one's head hurt because it's so stupid. This cominière letter is obviously choc full of lies but there is also some truth thrown in there as well. You can't blame management for not wanting to deal with them but at the same time management has shown almost equal buffoonery and questionable behaviours in going to the extent of making an application to waiver part of 13359 (the part with high mica content :rolleyes:)
Fallen for the trap of JFMK? Maybe but Nigel meets witk Klaus in Germany and then this happens. :unsure:
Seems like the lot if them need to sit down in a room with their lawyers including MOM and JFMK and hash out some sort of binding solution for a path forward. One where AVZ isn't liable for the corruption of the other parties but can side step it and move forward with the mine and the Hydro plant. Something like that, who the fuck knows.
Basically bend over and cop it up the ass, pay some more money and then fucking sell whatever percentage we've got left pronto imo.
However these DRC criminals come across as a vindictive lot and it's just as likely this is the start of them trying to push out AVZ altogether and fortify their means of embezzlement of State funds.

Lets be real here, Cominiere don't want to mine, they don't want to build a mine in Manono, they have no interest or capacity.
They have also fraudulently sold 15% off to Zijin for peanuts, while not giving us our contracted ROFR. They have no interest in the mining.

So how about we as in DATHCOM hold a meeting of Serious DATHCOM holders - as in who's here after the ML is given, who's going to mine this and pay for it and build it (you dickheads)

Ok so who do we have then, well that's AVZ 51% and that's DRC state 10% and CATH 24% with the remaining 15% unaccounted for UNLESS you would like to give us our ROFR - nah didn't think so dickheads, so the 15% is rescinded as it was illegal and remains floating.

At this meeting we shall discuss these 'continuing tensions', we shall discuss how to get this thing moving fast as we are now behind schedule from mining to SEZ, we shall also in each other's company discuss the 15% who wants it and agree upon decisions made at that meeting while acknowledging AVZ has ROFR.

This is IMO is what needs to be done with Felix and Antoinette together in a meeting room. They are hypocrites of the highest order if not corrupt/useless/incompetent, a meeting is critically required where basically this gets hashed out before anyone leaves the room. Even if we arrange that 'meeting' to happen at a later date in Cape Town, it needs to happen.

What do you peeps think ?

I think the concept in principle is pretty reasonable and well thought through but I think you are being a bit naive about how easy it is to get an audience with the most highest levels of State.

Nigel should of got someone to fill in for him , & explain to the conference why he couldn't be there ( laid bare to all what the fuck AVZ has been / has to deal with ) , because he needs to be back finding out what is exactly going on .
This is exactly what should have happened. A fill in, explaining wtf is happening there, asking infront of everyone for Felix to sort out the corruption and illegal interference. Then get on with a quick presentation.

I were there in Melbourne Roadshow,

after all, my thought is:

if cath just want the proudct, don't care about the percentage of ownership, then just reduce their pecentage to 9%

and if dathomir want 50million more, just pay it. and let this mf go away.

if zijin want that 15%, just give it to them.

then the structure is AVZ 66% Cath 9%, zijin 15% goverment 10%. we still hold 66% with controlling interest.

Please start the project and print money asap. :mad:
now, seems this is the best scenario
