I feel it's been long since verified that Jens is completely full of shit and has no idea what he's talking about.

Personally I reckon the company focus should be on how exactly to extract the damages out of the DRC and hopefully zijin once we win the arbitration cases. I hope our lawyers are working on that pre-emptively.

The damage is already done considering that Zijin have already stolen and developed the north and are expected to start production early next year.
DRC have destroyed AVZ's prospects to the point we have nothing to sell, they've revoked the licence and stolen the entire deposit and our assets.

I don't hold much hope in the minerals for security deal and its tiresome scratching to cling on to grim hope time and again as our position worsens over time. The time arbitration takes and the lack of enforcible action to prevent DRC/zijin from continued development has completely ruined us. Management need to figure out how to go about viably making sure we can enforce the damages bill after all this is said and done imo.

Hey mate i think what Jens is saying is absolutely correct but it certainaly is not new news. The mining licence has been on hold for 3.5 years and the ML agreement / framework has already been completed by Kobold. Problem is it seems Kobold have reneged on the original agreement with us and come in with a very lowball offer. The agreement where AVZ sells its commercial interest to Kobold for fair value. In the agreement there is no mention as to how the parties go about establishing fair value. For me it seems unlikely that Nigel would have signed that agreement unless in their discussions both parties were close to an agreed price. Given that it seems Kobold have reneged on the original deal . At this point with no news otherwise we can only assume the Kobold / AVZ framework agreement is still live but now appears unlikely to proceed
Who knows what effect the pending signing of the peace agreement and economic agreements ( DRC Rawanda US ) will have on the situation
Positive thing is that Kobold did get to sign an agreement with DRC including the purchase of our commercial interest so hopefully some larger more financially able entity is able to do the same and get the deal done.
Few assumptions in what i have said as we dont have access to the details of the DRC/ Kobold and AVZ/ Kobold agreements

AVZ is reported as saying legal still working towards tabling evidence for ISCID (sf120 I think on crapper). Jens (on X) is saying it’s on hold whilst AVZ/DRC/US State Dept work on ML agreement etc for INCOMING BIDDERS/KEEN PARTIES

1. AVZ and DRC in the same room is news
2. ISCID on hold (again) is news to me
3. I suppose working on evidence/on hold could be compatible and technically possible

I no longer rate Kobold as a ‘keen party'

I agree that Jens and August are both just speculating and neither of them know anything not available to the rest of us.

So for what it's worth I'll do the same. It looks to me that AVZ are seeking to have our rights recognised and damages quantified by the international courts because:
  • It's clear the DRC is unlikely to recognise our rights or pay any settlement.
  • Other countries have signed the same treaties binding them to recognise ICC and ICSID rulings.
  • The eventual rulings may help us obtain an exploitation permit (unlikely).
  • Failing that we can sue any other party that infringes on our rights (assuming they are bound by the same treaties).
I don't expect to ever see any money from the DRC and AVZ would be foolish to accept a financial settlement from them because they'll reneg and we'll be back in arbitration having accepted the loss of our rights to Manono. The only thing we may get from DRC is our permit but that's unlikely because it requires them acknowledging their own criminality.

If we're lucky we may get a commercially acceptable agreement from a third party once our rights are ratified by the international courts. Otherwise we'll be starting arbitration against Zijin and they have assets we can eventually lay claim to.

In the meantime expect a few more years of waiting so find something meaningful to do with the time and don't pay too much attention to online speculation. Including from me.

Personally I hope we achieve an agreement to sell our rights to mine Manono whilst retaining our rights to sue Zijin and Dathomir, because I'd rather not let justice slide.

Alternatively I'd push lady justice down the stairs wearing her blindfold in exchange for exclusive rights to process all product from Manono in perpetuity, in a 50/50 split with CATH provided our share of the construction costs are completely free carried.

The mining rights are ceded back to the state over time and I gather value adding can be more profitable. So maybe this would be acceptable.

I think after years of trolling AVZ using a dozen different aliases across multiple platforms Shane finally realised that his class action strategy (and the rest of it) didn't have legs. His HKTD probably told him that CATH is going to table an offer at some point and he's wasting his time. It's pretty clear that he didn't pass the message onto to Leonard. Never forget these arse wipes and their part in all of this.

As a boy I loved The Adventures of Rocky and Bullwinkle, and particularly Mr Peabody's wayback machine, Boris & Natasha and the dog that sniggered.

When I was about six, I tried building a wayback machine in the old man's garage, but I closest I got to a working prototype was shorting fuses in the family truckster. Maybe after this Manono shit-fight is finalised I can finish it, and do a Putin on that odious grub Kibeya.

I've spent the last few years building a time machine but it only works to go forward at normal speed. If only I could get the backward function working. Then I could go back and not waste my time on it.
