Cominiere and the recent ICC case

It appears up until now, that DRC state owned Cominiere has operated with impunity under the protection of the government, and that legislative and contract laws have been changed or ignored.

It also appears that mining companies foreign to the DRC have had their mining rights removed once they have developed a project from a Exploration Permit (PR) to an Exploitation Permit (PE)

It is also well known that though the DRC has lots of minerals, it is lacking in the finance and expertise to build projects…. yet it wants a greater percentage of earnings from those projects on top of collecting tax and other revenue from them.

Let’s not forget that it is other developers & investors that

1) Do all the work developing the projects
2) Know how to build the mines and infrastructure
3) Create jobs for local workers
4) Arrange the finances for development and construction
5) Incur the costs related to the first 4 points

Felix Tshisekedi talks about win-win contracts on one hand, and on the other hand wants to control the entire production chain from the investment, to production, to processing, to the sale of the final product.

Felix also wants to give state actors (like Cominiere for example) more power, while at the same time is asking foreign investors, miners and manufacturers to invest $30 billion in the DRC’s battery manufacturing industry.

The DRC invites foreign investors, saying it’s battery metals industry could be worth $7 trillion by 2040, adding the DRC wants to capture 30% - 40% of that value.

In referring to the 2023 DRC - AFRICA Battery Metals Forum, one feature that was highlighted following of the event was how much corruption is in the mining sectors.

I guess Felix has an opportunity now to show he is serious about cleaning up this corruption by signing the MOU he has discussed with AVZ’s executive team and granting the Mining License.

This then could demonstrate to other countries and investors that the DRC is a safer place to invest $30 billion in projects than what was highlighted at the 2023 DRC Battery Metals Forum
Felix is not going to do anything between now and the election IMO .Only 2 months away . If he loses it's not his problem . It will become more obvious if nothing changes between now and the AGM . MoU ? Are they f--king serious ? Time wasting ? Where's the ML ?

Felix is on tender ground with the upcoming election , complete inaction despite alot of promises in almost 4 yrs is culpable, just cant imagine he is entirely stupid to just sit on his hands and prey for reelection without striking a major blow.

Better late than never, if he was to award the ML to AVZ before reelection, he will achieve 2 things for his people to resonate, that the battery hub vision is real and that the corrupt actors that stalled the battery vision for nearly 17 months , ripped off the DRC coffers in the process with the ROFR 15% , delayed future royalties thus future prosperity, wont get away with their bad deeds.

Now that would be a major boon for his re election prospects, failure to do so, then he risks being a one term govt, much the same path way as Albanese is going down

In early August, a large shareholder was approached by Leonard Math on behalf of Peter Huljich and others, to see if they were interested in gathering other large shareholders and backing them to overthrow the current BOD. If they could not get 5% for an EGM, they would nominate for BOD positions

Peter Huljich was not at the meeting as he told Leonard Math he could not be seen in attendance because of a restraint of trade clause from when he departed AVZ. Simon Cong and Guy Loando are backing this along with certain Chinese companies.

Peter Huljich and Leonard Math are acting as their front men. One key point was…. No Asian sounding names were to vote for an EGM as this would attract the interest of FIRB.

I wonder how the 24% deal with CATH still stands, if apparently Yibin Tiany is a backer of Fat Tail Holdings?

If it appears that Cath is playing games, I am pretty happy, in that case that AVZ gives Cath a big fat 'fuck you too'.

The $240 million deal was too low in my eyes to start with.

24% x $12 = $2.88 x 3.5 billion shares = about US$1,000 million, not US$240 million.
At the end we are not married with Cath.

SO FUKKUM!!

If you ever worked with Chinese people, especially in Asia and Africa, you are well aware they can be the worst racists people in the world.
The majority despises anything other than the Chinese race.
I am not sorry to say this, it is an observation I made.
I never liked that attitude, I was brought up all are equal.
It was a disturbing observation, but sometimes you cannot choose the people you have to work with and have your thoughts.

Watching a doco on Amazon and here is the comment from the local about Chinese companies in the DRC... "The Chinese they knock down the price for the government. They bribe the ministers and in return get the contracts to rebuild the roads. But they don't know anything about it. They're just here to steal our mineral resources."

It's the exact valuation of the DFS. We don't want to be seen as SpEcUlAtOrS now do we.

CATH are buying 24% of Dathcom not 24% of AVZ
