According to insiders in Washington, there is an explanation for this leniency: the US has an agenda. Indeed, the United States is prepared to turn a blind eye to hastily organized elections in the DRC, however contentious, and will fund them no matter what. In return, however, Washington expects Kinshasa to subject the export of raw materials such as cobalt, copper and lithium to China to significantly stricter conditions.

Yes seen a little bit of MOM being in the news lately backtracking, good chance we are next. On evidence of her behaviour it seems she was not a champion of AVZ, but simply sided with whoever was 'winning', naughty lawyer.

The quiet before the storm at the moment, although I wonder if there is a storm in the offices of the AVZ lawyers with Zijin panicking and trying to come to a deal before ICC?
Zijin couldn't possibly offer what at this stage would be our requirements as they have backed themselves so strongly into their little corner with Comineire and Dathomir.:unsure:

Looking forward to hearing from Franck hopefully around 6th on what's been happening in the courtroom. Will the ICC revelations be a catalyst for the DRC to finally take action? Or will they ignore again like the IGF? How much evidence is enough?

Should be a good few weeks.

If we win our cases at the ICC then the MoM's reasoning in the new decrees will be laughed out of the ICSID especially given the IGF report and the fact that conflicts between shareholders is unknown as a reason for cancellation of a PE in the DRC mining code. Let them eat pineapples just won't cut it anymore imo. Given the need and urgency.

I doubt the ICSID has the power to compel heads of state and their ministers to testify in a civil case. Interestingly the President, Prime Minister and the MoM of the DRC are no longer listed as party representatives in the ICSID case information and have been replaced by lawyers. It would seem their titles being there was simply a stop gap until legal representation could be organised for the respondent which is the DRC state itself despite what trolls might say about us suing the president and his ministers personally.

Just legal representation is my guess . Lets not even go down that route .It will take years . Then where does it go after that ? If something is on offer, does Nigel take a guaranteed outcome for share holders now OR does he roll the dice for an uncertain outcome years from now ? The Cone of Silence days are numbered .

I have not posted for a while because the content of most discussions seem to be responding to unfounded comments from trolls and non holders.
I lose track of the conversation point behind the new threads that appear, now that I have many on ignore because they are not offering information of relevance to our cause.
What I am looking forward to is the Agenda being released for the upcoming AGM and what business shareholders may be asked to vote on, before any nominations for the Board are considered.
Could shareholders be asked to consider a TO offer ($Price per share). We can only hope more information comes to the surface later this week before/after the ICC Tribunal. I still think the only outcome for Zijin to be involved is to put forward an attractive take over offer to end this saga. China is looking to have almost full control the Lithium market in the world (if it doesn't already) and that of Rare Earth minerals. Getting hold of the biggest and highest grade deposits in the the DRC will advance that cause to the extent they can also extend their monopoly by building more Processing and refining facilities. So Zijin, stop messing around and come up with a good price that will put an end to this saga. The alternative will be to have your brand shamed on the International stage and that of Cominiere and DRC officials.
The corruption that exists within the DRC will never go away in the short term and there will still be many within Govt. looking for brown paper bags to disrupt AVZ from being able to go Mining despite our persistence in following the DRC mining code. We will never get to mine Manono without disruptions.
Lets hope one of the items of business for the AGM is to vote on a TO price per share. As shareholders we then get to decide.

What constitutes a reasonable offer will be determined by the ICC proceedings and there isn't currently one that is worthy of presentation to shareholders given the expected outcomes of the cases imo

An AVZ win in the jurisdictional challenge will be absolutely devastating to Zijin's attempts to get into Dathcom legally without paying up due to the precedent set. If they are going to buy us out then a reasonable offer will come after this Friday imo

AVZ management spelled out pretty clearly what their 'medium term' plan is in the going concern fine print. Without the correct action being taken by the MoM and with only low ball offers on the table there really isn't anything else they can do unless they are willing to cede control of Manono to China and proceed with minority ownership. Which should be obvious by now they aren't.

I really wonder how the AGM will play out. I can't see it being all that informative unless the commercial deadlock has been broken, court cases resolved, and ML awarded beforehand.

Current status and next steps:

If the company is under threat from "internal" conspirators (MMGA and collaborators) presumably those parties will be represented within the attendees (rats in the ranks). Given that, I would imagine that the BOD will be loathe to say anything for risk of revealing strategy to the enemy (same logic as the voluntary suspension and comms blackout).

Dealings with DRC Government:

As above, they won't divulge details. We'll just get "very advanced discussions".

Legal proceedings:
They won't be able to say anything more than what's available on ICC and ICSID sites.

Remuneration/bonuses:
Do BODs at any AGM really provide any meaningful response to shareholders' questions on such topics? My mind goes back to the one of the previous AVZ AGMs where this came up, and Nigel handballed the question to Hjulich, who gave some kind of non-answer. They all had disdainful /dismissive expressions on their faces. Will it really be any different this time (apart from H providing the answer 😂).


This isn't meant to be a whinge or criticism, just my thoughts on what can realistically be expected to happen at the AGM, in the interests of managing further psychological damage due to repeated deflation of great expectations.
