AVZ did not allow themselves to be out manoeuvred, it was pure corruption and I don’t know how you defend that when the corruption come from DRC government officials, chinese would not manage to get this far without colluding and bribing judges and mining officials.

Yeah I agree corruption is the basis of the problem. I'm not trying to defend that.

But AVZ management should have been savvy to the games being played. Especially given the reputation of the people they were dealing with.

The mining code says that once the favourable opinions are given then the ministerial decree should be issued for the same amount of carrés.

AVZ management agreed to the partition. This was not something that was a surprise to them when they announced the ministerial decree on May 4th and we traded for 3 days after.

Overall I'm basing my view on what Nigel said about Felix telling him that he never asked for the partition. If that isn't true then we are completely fucked.

But isn't the issue around what contained in the exploitation decree / licence offering and how it's contrary to what the mining code says .....understanding is that decree issued ; Management were aware of the North / South split ( exploitation / exploration both under AVZ ) , weren't overly happy, but happy enough to roll with it and contimued trading only for the handbrake to be pulled ,as CAMIs North is being remembered / revoked and ready to accept new applications” plan was rolled out on the benchtop and AVZ were told ye nah, the direction came from Felix, but you guys can make an application too.

That direction never came from Felix and AVZs legal eagles went back to recite the mining code for the umpteenth time.

It's not difficult for someone to asking for the mining application and process book run a calculation on the time between decree and ML in a frame ; they’d all be less than a month, but AVZ IS 8+ months ; I'm pretty sure if that was just the case then DG could be ordered by Felix to press the buttons or find a job in Maccas, as all the data is there

If AVZ had agreed to run with what was presented, then we’d be trading now and no doubt the northern section would probably already have been locked away and registered under AJN/ Congo resources in lightening speed .

Did AVZ bring CAMI to court just to get the licence released and get the calculator excuse...was it before, during of after that when the revoked part flushed out..? .who knows

Now my reply to wombat, as to if ML would be granted if we just agreed to the cut ; I responded yes, I've zero doubt that at the time that would have been correct ; but obviously we don't know how far this has gone up the ladder and what one way valves have been opened I.e. AVZ standing firm and looking for what rightful Dathcom are entitled to and wanting North and South..... That's exactly what is be doing, fuck Klaus, DG, MoP, Zijin and Co. Fwiw if it came out that northern area was gone to others, the is be looking for the best opportunity to sell out in the short term / medium term; I've no doubts that the Chinese would fick AVZ up by opening up Carrier in no time ;they’d have their licence with a 10 page application in less time than it would take us to build the plant ; DG would make sure of that .

If AVZ had of brought CAMi to court to get DG to release the licence alone and the excuse was his calculator was broken ; the court would have issued a date for it to be resolved by...assuming all things were legit and in line with the codes....problem is from my understanding, it wasn't in line with the code and that's what's caused the 8 month + delay and not DGs calculator

Your comment also suggests that it probably wasn't just a court case To get the license release without any issues involved - “It's only a misunderstanding because Nigel was talking about the process before the ministerial decree. We can't have a court order to issue the licence anymore because we already legally have the licence that management agreed to.”

• An area which was excluded under the Ministerial Decree to award the Mining Licence will be renewed under a new 5-year Exploration Licence to Dathcom with discussions regarding the terms of the ongoing joint venture under discussion with the DRC Government
• Completion of US$240M cornerstone investment with Suzhou CATH Energy Technologies5 extended by mutual agreement to 31 July 2022
• Request for arbitation received from Jin Cheng Mining Company Limited, the DRC arm of Zijin Mining Corporation

Nice post MB On the money honey issue, I was of the belief there is still the US50m facility available to draw down on out of the US if needed. Do you or anyone else have any information that changes the availability of these funds? I recall a poster confirming Nigel stated / confirmed these funds are still available at one of the road shows.

Sure, there is a risk to the company if it borrowers and then continues to spend money hand over fist.

AVZ has not decided to consolidate spending as yet, this can still happen and bring the spend down considerably. Suspend drilling, reduce non-essential expenditure all available to bring overheads down not dissimilar to putting a mine on care and maintenance, accept it is the company on care and maintenance. Capital can still be secured via SPP while in suspension, and there are some serious players in the T20 that might like a preferential deal for more equity.

In saying all the above, I don't think the Chinese will bunker in for the long haul here, but if they do, AVZ has many leavers to use if a siege actually does take place, however unlikely.

If it comes down to survival of the company I'm quite certain funds from various sources will be available to keep the company in the game. Don't forget the inability of AVZ not being able to fill off takes and how this will affect more Chinese battery and EV makers then just the Zijin looters,

IMO AVZ have the upper hand on the long game due to market forces and in short a lot more Chinese industry will benefit from Manono coming online quicker then some thieving miners will like Zijin.

All conjecture of coarse, however there is always a Yin to the Yang and AVZ sits nicely in the middle of both IMO.

AVZ management have done a great job at proving the resource. Especially sticking through it during the dark days after Klaus rat fucked us. But they have definitely dropped the ball by allowing themselves to be out maneuvered by Mupande and the rest of the jackals. Although there are positive signs they are succeeding at fighting back.

They are paid top dollar because of their experience in Africa. Considering what we now know I'm extremely confident that I would have seen this shit coming a mile away if I was on the board. And the only time I've ever been to Africa was visiting Morocco as a kid. Unbelievable that the partition of the tenement was allowed to happen with management's consent.

Was that about the time that NF came out and dissed the northern section saying it “had high Mica content” (or similar)? That comment had me seriously grinding my teeth…

I believe that Mupande has already signed off on the entirety of 13359 as a PE for us but the only pens he has in his office are the invisible ink. Rumour has it that Nige has been trying to get the UV light on the scanned version sent to Perth since November.
