AVZ Discussion 2022

it would be good if someone with an X account asked them directly if they were associated with, or acting on behalf of, Kobold.
Social media is social media.

I don't have a clue who August is, he could be the mayor of Timbuktu.

So Cath gave US$20 million to AVZ to fight their legal cases, did the wrong dd and can kiss their money goodbye, because AVZ can not get 13359 back and no lease, no ML.
I think Mr. Pei would throttle his legal advisers and elevate them from the ground by their testicles, if that was the case.

I don't think the Chinese are stupid, they started making fire crackers a long time ago.

They got 13359 North for US$33 million in mars bars and timtams, don't give a fuck and are happily building their mine.
It is not them who created this problem, but the Congolese under the guidance of CKK, mind you a stand in for a stand in, the ideal fall guy.

The Chinese are smarter than Kobold and Kobold has AI, not only that, according to August the yanks have all the cards.
Pity they don't have the real Trump card, Manono.

Nigel makes it very clear in the appeal letter that triggered the ICSID arbitration under the DRC mining code that the main purpose of the appeal is the ‘survival of the acquired rights’ for Dathcom

This has obviously now changed in that Dathcom recognise the cancellation decree and are seeking the PE for the entirety of 13359

So it’s a bit complex in this case due to the waiver and other purported partial relinquishment of 13359 by Cominiere giving the north as 15775 to Manono Lithium with different parameters than the original split

But the revival (survival enacted under law) of acquired rights for an applicant under the DRC mining code is 100% possible imo

August’s other point that KoBold will be granted a new licence makes absolutely no sense under the DRC mining code as they would need to go through the DFS process again before applying for a new PE

complex and maybe fake news about seeking all of the 13359 tenement back to Dathcom .
Or situation has changed from the USA seeking all of the tenement and no Zijin / Comminiere involvement in Manono for minerals for security.
Tightening the pressure against corruption and obtaining all the benefits from Manono.
As the MOU signed by NIgel and Kobold was to get the South returned and allow Zijin the North?
and a takeover at fair value paid by Kobold.

Yes an MOU only but agreeing to delay court proceeding .?
AVZ surely would have been given positive conditions to agree to that.

August is just one of a long list, who in the espionage world would be called 'sleeper agents'.

They rock up in the interweb and start posting supportive posts for side A.
These gradually become more frequent as they grow their audience/ followers and gain more credibility.
Then when the lay of the land changes, or they need it to change, they continue with their well reasoned arguments to flip 180 to side B.

There is usually a simple reason why their new argument is fatally flawed. Often, it's an omission.

In this case it is that DRC acted illegally.

I would bet that even in North Korea, illegal governmental acts could be reversed.

He's full of scheisser.

What puzzles me is why their every post is dissected when everyone knows their game?

You can tell which side a player is on by the direction they kick the ball.

August knows the ICSID process will prevent anyone (except Chinese) getting their hands on Manono . Kobold prides themselves on being ethical . They can't partake in corrupt activities . When the ICSID exposes the DRC Government for massive Corruption re Manono Kobold will have no choice but to walk away . August seems to be developing a chip on his shoulder .

Come on PT, in modern football they often kick the ball back to build a new attack, did you forget?:rolleyes::rolleyes::rolleyes:;)

Even during an attack they do it to confuse the enemy, it is called a tickie back.

But on social media, unless you have met the people, you simply don't know who you are dealing with.

So whatever August says, is whatever August says, words on a screen, and that is the end of it.
It wont spoil my shiraz.

A quick question to Grok also tells me Felix can overturn the cancelled licence, especially considering the reform he's supposedly promising the yanks, and in fact I'd honestly assume it's a given and a must, so for August (with all due respect to him) he seems to either be slightly mislead or there's possibly another agenda at play. I'd give him the benefit of the doubt for now

Very interesting " Exceptional circumstances"
Country being overtaken by Rwanda and loosing political support would be exceptional circumstances faced by DRC .
SO does PR 13359 licence get returned to Dathcom for the South and the waiver stand for the North?
Considering that now the tenement is under Cominiere in the mining Cadastre .
Logic says that the South is returned to Dathcom and then Kobold pays fair value in a take over.
But can logic exist with DRC .
IMO yes when Exceptional CIrcumstances forces you to act.

I'm not getting hung up over the semantics of Kiki's tweet, ie 'reinstated'. That's the formal path of what should occur. Just as important is the co-related security agreement.

Hence the pressure is on Felix to make an executive decision on Manono, one way or another. For he would know full well Trump's attitude to closing a deal:

"Spare me the details, sort that shit out".

To remind, here's Marco Rubio recently laying out the US approach to foreign deals. In his cabinet report to Trump Rubio also lauds special envoy Boulos and the DRC/Rwanda deal:

Kobold certainly sound as if they are forward planning with confidence, however you can clearly see building frustration in her face.
Love this comment from Serge @ 44:15 'What I'll say to investors is.... if you come into the DRC make sure you do things by the book.' 🤣

-This minerals-for-security-and-development agreement places Kinshasa under scrutiny, particularly in terms of mining governance and transparency—key conditions for attracting U.S. private sector investment.

-Washington’s stance is firm: access to the DRC’s mineral wealth must be underpinned by responsible governance, as emphasized in recent U.S. executive orders that link critical mineral security directly to national economic resilience.

-Mr. Boulos has been clear: any partnership must adhere to principles of good mining governance and financial transparency.

-This represents a significant test for the Congolese government, some members of which have been criticized for mismanaging public resources.

-The manipulation of mining cadastre records (CAMI) to reassign valid concessions is also under scrutiny.

-The ongoing dispute between Australia’s AVZ Minerals and Cominière over the Manono lithium project serves as a case in point, highlighting governance failures in how mining rights were handled and reassigned.

-As negotiations continue, the U.S. is pushing for reforms in the management of mining titles, urging Congo to clarify the role of its private mining sector.

-To date, the Congolese companies that will partner with American firms under this deal remain unidentified.
[I am guessing Cominiere is out]

It just doesn't make sense to stiff AVZ or leave Manono locked up in a legal quagmire with the above goals in mind.

Still getting mentions in the American media cycle is a good sign imo.

In recent weeks, two U.S. companies opened doors to production in the region. Nathan Trotter, a U.S. firm, signed a letter of intent with Rwanda-based Trinity Metals, which owns Rwanda's largest tin mine. And KoBold Metals, which uses Artificial Intelligence to further energy transition and is backed by billionaire Bill Gates, brokered a deal to buy Australia’s AVZ Minerals’ interest in Congo's Manono lithium deposits.
