What future for the "contract of the century" between the DRC and China?

During these four days of visit, the first in Beijing for Félix Tshsiekedi since the beginning of his mandate in 2019, Kinshasa's objective is to put back on track the Sino-Congolese relationship blunted by the "contract of the century" passed he 15 years ago under the Kabila era.

A "mines against infrastructure" contract that turned into a fiasco.

The DRC and the Congolese are the big losers of this contract considered leonine and that the number one Congolese will try to renegotiate from this Friday.

It is first of all the story of a mega-contract by Sicomines, Sino-Congolaise des Mines, a joint venture set up in the former Katanga with the Congolese public company, Gécamines and the GEC, the Group of Chinese companies.

The former Kabila presidency was its architect. Cobalt and copper mines against roads, railroads, etc.

That was on paper, because in reality: the contract of the century was rather the heist of the century, according to Jean-Pierre Okenda, director of extractive industries at Resource Matters: "It's the scam of the century.

For what ?


Basically, China agrees to make available a line of credit: 6 billion US dollars.

It was reduced by half after the intervention of the IMF which was afraid of a debt, that the project was not sustainable.

And so there was this money.

And on the other hand, China needed access to minerals, and so the DRC said it had very large reserves: at the time, Gécamines estimated the reserves at 10 million tons of copper, 600,000 tons of cobalt.

That's what that deal looked like.

A deal that remained a dead letter or almost

Roads, Kakobola and Katende hydroelectric dams, thousands of social housing units, 145 health centers...

All these projects had to be done.

But fifteen years later, the amount actually invested by the Chinese side has remained minimal, according to Jean-Pierre Okenda: "We are in 2023 and we realize today that China has only spent 30%, or 822 millions of dollars in infrastructure.

This figure is given by an official Congolese report.

The General Inspectorate of Finance released a damning report: "squandering", "selling off", "economic colonialism".

The IGF estimates that for Sicomines, the Katangese mines have been a cash machine: 10 billion dollars.

The Congolese president goes on the offensive with Beijing

A task force within the framework of an ad hoc commission made up of ministers, the presidential cabinet and members of civil society resulted a week ago in a document that we were able to consult.

It was designed as a basis for negotiations with Beijing.

First lesson: Kinshasa wants to reverse the shareholder balance of power within Sicomines and go from 32% currently held by Gécamines to 70% for the public company and the Congolese authorities

It is the key idea of renegotiation that seems to be in view during this state visit.

Even if sources contacted by RFI within the delegation present in Beijing affirm that it is rather necessary to rebuild the Sino-Congolese relationship.

The pressure is immense on the Congolese authorities.

The Congolese company which has been denouncing this Chinese contract for more than ten years, the Westerners, the Americans and the Europeans or even the Extractive Industries Transparency Initiative (Itie) everyone is pushing for Kinshasa to remain within this framework of negotiations.

Welcoming the government's initiative to want to renegotiate, it is also really essential to put in place guarantees to ensure that in the end these negotiations are beneficial to Congo and to the state-owned company", indicates Jean-Pierre Okenda

Towards compensation?

The DRC could claim 2.2 billion dollars as required in this negotiation document.

Still, for another Congolese civil society actor, Jean-Claude Mputu of Congo Not for Sale, the timing is far from trivial: "The strongest weapon of Congolese power is its mineral wealth , in particular strategic minerals for the energy transition.

So all the means are good to use it, for electoral reasons [...] because we realize that the West is very observant on the elections, we should perhaps avoid putting too much pressure on China, and at least have an ally for the last few months.

Beyond this contract, Kinshasa clearly comes to find support.

After the bilateral meeting earlier with President Xi Jinping, Felix Tshisekedi will go tomorrow to Norinco, an arms dealer, then to Huawei in Shenzen on Sunday before leaving Hong Kong at the end of this State visit.

China opposes interference by external forces in internal affairs of African countries

Strengthening Africa's capacity to fight terrorism

China says it is willing to work with Africa to achieve common security.

Qin Gang assured that his country will continue to adhere to the concept of common, comprehensive, cooperative and sustainable security, will unite to implement the global security initiative proposed by President Xi Jinping.

In this context, Beijing intends to support the optimization of UN efforts to maintain stability and promote peace in Africa, and strengthen Africa's capacity to fight terrorism and maintain stability.

"China will appease burning issues in Africa and the world and encourage the international community to work together to address food and energy security, climate change and natural disasters, infectious disease prevention and control, and other non-traditional security challenges,” he stressed.

Membership of the African Union in the G20

The country Xi Jinping is in favor of the reform of the system of global governance to strengthen the presence of Africa in international institutions.

In this regard, China pledged to strengthen timely strategic communication with the African side on major international and regional issues, firmly support Africa's righteous proposals, translate the common demands of China and Africa in joint actions and jointly safeguard the common interests of developing countries.

"China will fully support South Africa in hosting this year's BRICS summit, continue to promote the G20 to include the African Union as an equal member, and continue to muster the mighty power of unity and revitalization of developing countries," said Qin Gang.

The Middle Kingdom also expressed its readiness to work with its African friends to continue to join hands and move forward courageously, to build a high-level Sino-African community with a shared future and to permanently create a better future for China-Africa relations. :unsure: :sick: :rolleyes:

While on the subject of Felix's visit to Beijing, I'm kinda encouraged by the lack of media coverage of lithium in general and Manono in particular.

While Manono was undoubtedly discussed in corridor meetings, that it failed to get traction in the media may be a positive. To me it indicates that neither the DCR government nor Zijin Mining/Jin Cheng Mining are on sufficiently solid ground to make a public statement. It seems they are prepared to let the ICC cases run their course, rather than precipitate an eye-watering damages claim by AVZ.

Visiting China since Wednesday, May 24, Congolese Head of State Félix Antoine Tshisekedi Tshilombo met with his Chinese counterpart Xi Jinping on Friday, May 26 at the Grand Palace of the People.

During this meeting marked by the solemnity including a parade of honor and the impact of 21 gunshots, the DRC and China signed 4 memorandums of understanding that are spread in various fields.

This is the memorandum of understanding on the investment and ecological exploitation of natural resources, the memorandum on exchange and cooperation in information but also on cooperation in the development of the digital economy.

To this is also added the memorandum of understanding on the promotion of the development of green growth and a Cooperation Agreement between the two national television channels, the CGTN of China and the RTNC of the DRC.

Head of State Félix Tshisekedi and his counterpart exchanged to strengthen their partnership, to create more opportunities for two countries.

ICC case was pushed back until July from April correct?
Apart from settling the mining license, the rest of this garbage could most likely play out for a number of years....

China-DRC: head-to-head Félix Tshisekedi - Xi Jinping in Beijing marked by the signing of several agreements

President Félix-Antoine Tshisekedi and his Chinese counterpart, Xi Jinping, met this Friday, May 26, 2023 in Beijing on the new strategic partnership between the DRC and China.

Felix Tshisekedi was welcomed with all the honors this Friday on the esplanade of the great People's Palace in Beijing by his host, Xi Jinping.

National anthems, 21 cannon shots, brass band, military parade and children's greetings, to mark this state visit by the Congolese president.

Aid of 1 million USD for Kalehe

On this occasion, the Chinese President underlined his desire to consolidate “pragmatic cooperation” with the DRC.

He congratulated President Tshisekedi for his national and regional leadership in consolidating peace, development and stability in Africa and in the DRC in particular.

According to Xi Jinping, China will release an emergency aid of 1 million dollars to help the victims of Kalehe, victims of the torrential rains.

President Xi Jinping also expressed his willingness to develop bilateral cooperation.

"I am of the view that we need to create more opportunities between our countries and move bilateral relations towards a comprehensive strategic partnership," he said.

For his part, Felix Tshisekedi praised the great achievements made by China during the last ten years under Xi Jinping.

The Congolese President wished that the two countries take a new step in the partnership which unites them for the benefit of their respective peoples, while welcoming the values common to both countries.

Signature of 4 memoranda

The solemn ceremony this Friday was marked by the signing of 4 bilateral cooperation memoranda on:

investment and ecological exploitation of natural resources, information exchange and cooperation
cooperation in the development of the digital economy
promoting the development of green growth and
a cooperation agreement between the two national television channels, CGTN and RTNC.

Head of State Félix Tshisekedi and his delegation also took part in the dinner offered in their honor by the Chinese President in the evening.

This Saturday, he will be visiting Shanghai for economic meetings in this second Chinese city.

Hoping to be all wrapped up before ICC hearing scheduled for the 2nd of July.
I tend to agree. I have always held the view that negotiations will be done well ahead of scheduled ICC arbirations, and an agreed settlement will be tabled at the ICC hearing in order to have regulatory oversight and the imprimatur of the highest commercial appeals court.

After a year of treading water, I too want this resolved sooner rather than later.
