Lovely morning in Melbourne today, I had much to think about when out on my walk.

Please indulge another post of mine just thinking out loud.

We're collectively being sued for damages, but what damages? It's not mentioned in the announcement.
IF AVZ have been removed as claimed by CKK, then what is there to sue?
Why have AVZ pointed out the fact that the claimed amounts add up to Z and Coms claimed ownership in a valuation of the company at $5.66B?

I can't help but think (ever the optimist) that AVZ have secured Manono and Com and Z are out. But it can not yet be announced, finalizing stages ect...
So Com and Z are sueing for their claimed ownership valuations.

AVZ have to anounce the ICC request, but can't yet announce the win for Manono, so this is what we get.

Why would AVZ mention this specifically...

"it appears on face value that the
amount of the damages claims is based on Jin Cheng holding a 15% interest
and Cominière a 10% interest in Dathcom, thus suggesting that the Claimants
are valuing the entirety of the Manono Project at US$5.66 billion"

To the optimist, this looks like a wink.
Why would they make this particular observation in an official announcement?
To me they're telling us they want to be payed out.... which means we might have won.

Gods I don't know, I'm just thinking out loud. There's missing information about this ICC request announcement.

Am I utterly crazy thinking this?

The only legitimate valuation metrics for the Manono project are contained within AVZs DFS.

Cominiere is on record suggesting AVZ has done nothing to value add to the project, however todays actions by Jin Cheng and Cominiere indicate a contrary position.

Is Cominiere seriously proposing that AVZ has simultaneously added value AND done nothing?
It's blatantly obvious that Cominière and Jin Chen just did some value adding.

Hopefully they realise, they just admitted Jules A's claim that Jin Chen grossly underpaid and Cominière's scandalous sale (theft) with nothing to show.

Not only that.... AVZ had nothing to do with that transaction.

How is Cominière going to explain this fancy footwork?

Will FT try to sweep this under the carpet, if this transaction is made public on every possible Congolese media outlet?

Can't look very promising for a president aspiring a second term as President of the DRC!

I don't recall- it awas zillions. But it's irrelevant as debt is in US$

Point is what's to stop the west saying to Sri Lanka (upto their necks in Chinese debt) or anyone else 'Come and join our gang and we'll ignore your debt to PRC and that will stop them keeping your people in poverty?'

International debts don't need to be paid if the creditor has no leverage and if there is no reputational loss / sanctions then there is no incentive to pay.

Personally I think there is relevance in the fact that because they are bums that don't pay their debts they now have to constantly print pesos which is driving their inflation

Yeah sure they may not need to pay their debts internationally but it severely limits who will lend to them in the future and that can cause massive problems domestically. As the old government of Sri Lanka found out lmao

Exactly, and to extend that further, if the west started to dramatically reduce their export reliance from China , like Australia are finally doing aka new trade agreements with UK & India etc, then Chinas 350% debt / GDP ratio will burn them to a crisp.

COMINIERE claiming for 10%, Z for 15%, leaves a clear 75%, which even if you went with the Green Mamba declaration of DATHOMIR 15% and AVZ 60%, infers MMCS are out via an ICC determination.

So, where is it? Surely our fossickers on the ground in DRC should be able to get a copy of it, if it has been resolved

John, technically, without the issuance of the ML, wouldn't the 10% still remain with COMINIERE?

Would be great to see the documents to see if Dathomir is still considered.

Sir Les doesn’t have the credibility of real person name, Constantin Garlas and so reach. Also, I gather the Congolese like Constantin. The Germans always seem respected where ever they go.

The reason this concerns me is that I have been made aware of potential ICC action by Cominiere against AVZ - if this turns out to be true (it is heresay at the moment) then I think others would share the same concern - though i am uncertain what Cominiere could possible be filing at ICC.
Few tidbits from me:
  • I have confirmed that Zijin and Comniniere's joint case for damages was submitted on/around the 28th of April to the ICC - it is not impacted by the emergency arbitration ruling.
  • The favourable AVZ ruling at ICC emergency arbitration stops Cominiere from terminating JVA at DRC local court, it also stops them from any shenanigans like when MMCS had their license revoked (ie, Cominiere sold to Dathomir, new JV was established, and new licenses were issued for a new tenement)
  • The acknowledgement by Zijin on the value of the project will bite them in the ass and is proof that they underpaid for their supposed 15% - they supposedly even cited our feasibility study in the ICC claim to justify the value.
  • If the original ICC case by Zijin flops then this second case would also flop, since the precedence would be that Zijin as a non-shareholder, doesn't even have the right to bring either ICC case. (the conflict in schedule seems even more suspect now...)
    • In this event, not sure if the case would be then trimmed down to just Cominiere's damages, but this is a pretty nifty way for Zijin to bankroll the legal proceedings IMO - the lead counsel for the newest case are Zijin's legal team

This ICC nonsense means one of two things for me.
1) Simply a delay tactic. Maybe they hoping the election goes a certain way that will favor them
2) That they have failed having AVZ kicked out through back channel negotiations ( a nice way to say to say their corruption has failed to achieve the desired results ) and that now they resorting to the good old Hail Mary plays.

Im going with 2 so in a round about way this is good news for us.

Zijin do not need to include Cominiere in their current ICC case since the first case is still pending. However as I mentioned above, this seems like a failsafe to ensure the case is heard even if ICC determines it doesn't have jurisdiction given Zijin are a bunch of rat fucking scumbags. If the original case had kept its jurisdiction hearing, then Zijin wouldn't be able to bring this case and Cominiere would have to go it alone (if at all)

Given the way the latest ICC claim is structured, I also believe Zijin is attempting to drag Dathomir into the case.... AVZ's ann is pretty good though since it puts a spotlight on those actors who are in cahoots. If Dathomir does jump on board, it just confirms what we've all known about, that Dathomir, Cominiere and Zijin are all giving each other the reach around, trying to fuck AVZ.

After his failure to acquire 15% of Dathcom at the undervalued price of Usd33M according to @IgfRdc, Zijin, and his accomplice in the sell-off Cominiere, seized the Court of Arbitration claiming USD 850M in damages from a project carried out by @AvzMinerals without financial contribution from another.
