A good sign that the strategy has had an impact is that all our opponents are calling for the termination of the arbitration cases. Whilst its a shame it's gotten this far, this is obviously the only viable strategy remaining. Let's see what the DRC posits as the way forward towards a ML, I can't see us withdrawing these cases (particularly ICSID) without some relatively solid guarantees.

Good morning AVZingers!

I noticed something interesting in the recent announcement.

"AVZ notes that the Lubumbashi High Court did not have jurisdiction to determine, and did not
determine,
the issue of ownership of shares in Dathcom, which will be determined by the ICC"

"...which will be determined by the ICC"


AVZ have stated that this current ICC case with Zijin to determine Juristiction will not determine the 15% ownership issue.
So like me I'm sure people have been wonder what will determine the 15% ownership issue? There had been no notice of court cases yet regarding this.

It seem's they've just told us it will be the ICC, and the case has yet to be lodged.

I'm guessing that immediately after the current ruling is handed down, and assuming it's in our favor, we instigate action at the ICC to assert Zijin has no ownership in Dathcom, while holding the juristiction ruling in our hot little hands. Or Zijin may simply concede.
One would imagine this action wouldn't take very long to resolve.

And also thank you to the AVZ board for the shoutout to us in the announcement.

EDIT: It's just occured to me that they are referring to Dathomir's 15% at the ICC so I'm wrong here in regards to AVZ saying that Zijin's 15% will be determined at the ICC.
However I won't delete this because I think you could fairly deduce from all this that it's probably how it will be happening anyway.
So consider it just my ponderings. :)
If the ruling is that #FuckZijin is not part of Dathcom it has far greater meaning than “just” a jurisdictional ruling. All other actions are predicated on #FuckZijin having ownership so the jurisdictional ruling is a rug-pull of mammoth proportions. Win this and the other #FuckZijin cases die a wicked death.

The 15% that Cominiere purportedly sold to Zijin in breach of our pre-emptive right and at a price that would have robbed the DRC people of 120m USD (except that traitor CKK who would have personally benefited from rat fucking his own country) will be determined in the case brought by AVZ against Cominiere at the ICC if the jurisdictional challenge against Zijin is successful as explained in the announcement on September 27th.

The Dathomir matter will also be handled by the ICC in accordance with the Dathcom JVA and all known history of contract law

Felix may have some bigger fish to fry in terms of election issues such as civil unrest/violence/poverty etc. there is no doubt announcing the go ahead for one of the largest mining operations on the planet will be a rather large feather in the cap and a vote winner as election time approaches. Many thanks to the MMGA crew for being a wonderful catalyst in providing these updates and mustering the troops behind the AVZ BOD!! Job well done. We know you are reading this!

If they still wish to contact me, I will let them know my feelings in not to misunderstanding way.
As far as I am concerned I hope they will not show their stupid faces at the AGM.
