Jin Cheng Mining Company, a subsidiary of the Chinese mining giant, ZIJIN Mining, which claims to own 15% of the shares (of COMINIERE) in the Manono lithium joint venture in the province of Tanganyika in the Democratic Republic of Congo.
The purchase of this 15% of Congolese lithium was done illegally and trampled on the law of the country and joint venture agreements, according to the IGF (General Inspectorate of Finance), organ of the presidency of the republic, headed by the charismatic , Jules Alingete .

- the sale price judged by the IGF to be derisory given the value of lithium on the international market at the time of the sale, US$2,200,000 for 1% of the sale than the US$10,000,000 on the market;
- There is in particular an audio attributed to the former ad interim general director, Célestin Kibeya who was appointed by presidential order as now the general director of COMINIERE, who would ask a “commission agent” in the sale of the 15%, to reveal on the invoice 33,440,000 $US than the 35,500,000 $US that the Chinese of ZIJIN will actually pay, therefore a difference of 2,060,000 $US which will disappear from the coffers of the Congolese State.

A hearing on AVZI's objection to jurisdiction was held on October 5 and 6, 2023 before the arbitral tribunal in Paris, the parties' lawyers will review and agree on the transcripts, and AVZ and Jing Cheng will submit briefs after the audience.
The sole arbitrator will determine a procedural timetable in the coming weeks, with the company providing an update.
As previously stated, AVZ is confident that the challenge to AVZI's jurisdiction will be successful, which will confirm that Jin Cheng has no right to initiate the ICC arbitration proceeding against AVZI based on the agreement concluded between the two parties on the grounds that he is a purported shareholder of Dathcom.

They mean the Cominiere ICC case, which is intended to rule on whether the purported transfer of Cominiere's 15% is valid or whether we should be able to apply our right of refusal, and also to the Dathomir ICC case, which us intended to rule on the validity of the earlier transfer of Dathcom shares to AVZ. determine, the issue of ownership of shares in Dathcom, which will be determined by the ICC"

AVZ have stated that this current ICC case with Zijin to determine Juristiction will not determine the 15% ownership issue.
So like me I'm sure people have been wonder what will determine the 15% ownership issue? There had been no notice of court cases yet regarding this.
It seem's they've just told us it will be the ICC, and the case has yet to be lodged.
I'm guessing that immediately after the current ruling is handed down, and assuming it's in our favor, we instigate action at the ICC to assert Zijin has no ownership in Dathcom, while holding the juristiction ruling in our hot little hands. Or Zijin may simply concede.
One would imagine this action wouldn't take very long to resolve.
And also thank you to the AVZ board for the shoutout to us in the announcement.

EDIT: It's just occured to me that they are referring to Dathomir's 15% at the ICC so I'm wrong here in regards to AVZ saying that Zijin's 15% will be determined at the ICC.
However I won't delete this because I think you could fairly deduce from all this that it's probably how it will be happening anyway.
So consider it just my ponderings.

The 15% that Cominiere purportedly sold to Zijin in breach of our pre-emptive right and at a price that would have robbed the DRC people of 120m USD (except that traitor CKK who would have personally benefited from rat fucking his own country) will be determined in the case brought by AVZ against Cominiere at the ICC if the jurisdictional challenge against Zijin is successful as explained in the announcement on September 27th.They mean the Cominiere ICC case, which is intended to rule on whether the purported transfer of Cominiere's 15% is valid or whether we should be able to apply our right of refusal, and also to the Dathomir ICC case, which us intended to rule on the validity of the earlier transfer of Dathcom shares to AVZ.
