AVZ Discussion 2022

I thought that Serge spoke quite well about the project. That's what he talked about. No mention of the issues or the Chinese.

He did mention at around the 17min mark, that they are finalise the documentation for the SEZ. But we all know that's been happening for ages lol
Thanks for the feedback Sammy, I had trouble getting the English translation and could only get the text in French.

As it is Serge who is saying they’re finalising the documentation for Manono SEZ, that’s very positive imo.

Didn’t the President say something along the lines of any Minister mentioned in the IGF reports for corruption would no longer work for him, as well as the “show me evidence” statement? We now have Minister of Mines and the Minister of Portfolio mentioned in the IGF reports re corruption prior to the expected cabinet reshuffle.

Perhaps the next department to be investigated (if it hasn’t happened already) will be CAMI and Mupande will be mentioned, which would remove him from CAMI and perhaps from his position with the Vuka Group as well.

Edit: Having now read the report in English I see the MoM was not implicated in corruption, but was merely the recipient of the report.

Well, I've already started. Nothing else has worked much to date, so may as well go for the head of the snake. 👍

On another unrelated matter, maybe it's a bit of a pop quiz or silly idea, I don't know........

Who knows who I am on Twitter?

Don't say it here on TSE, just message me direct. Will help me determine who is friend of foe and other things, if you have the time 😁

Cheers the Fox 🦊

PS. The old saying, you show me yours.........

In the short time since I posted the above question / challenge I’ve had quite a few send me a DM, thank you for that.

This challenge is turning out to be a bit of fun for me with the guesses around who I am on Twitter, thank you.

I promise to respond directly to each DM and confirm if you have guessed correctly or not and answer any questions that were also included if I’m able.

However, have to run out the door now, look forward responding to all DM’s later today.

Have a good day all 👍😁🦊

Try desktop site if your on mobile. Then sometimes you have to click the subtitles thing twice to get English to show up.

I watched it on my phone and if you have YouTube on in your mobile data you can watch the link on YouTube…. Hit CC for captions and then click on the cog wheel in the top right corner, then captions, then translate from French to English

Now I’m off for the weekend…. Hope you have a good weekend and enjoy the time off from having to work @John25

Thanks. When ICC was first mentioned not that long after AVZ went into voluntary suspension (yes Tommy voluntarily you dickhead) I researched expected timelines for a cases similar to what AVZ is handling and the average was 18 months.

Yes cases can be dismissed on lack of merit and be withdrawn and terminated for a number of reasons, however from start to finish 18 months seems the norm.

I suspect the 2024 comment in the AVZ update and supporting words around AVZ waiting for things to be sorted in the ICC will seriously put the wind up the DRC and Felix.

I’ve said to a few here offline for months that I believe the ICC is our endgame, if all else fails.

However, waiting for an ICC case where AVZ vs DRC won’t work out very well for the DRC and the bullshit dreams Felix spreads via every speech, every week, everywhere, (he should get an Oscar too) of being a battery manufacturing hub for the world is embarrassing. Felix looks more like a fool each day the Manono opportunity goes by and is wasted.

So to answer your question in short, I think so, yes. And also because 18 is the usual timeline to complete an ICC case.

Cheers The Fox 🦊
I for one would be very concerned if indeed we are relying on the conclusion of the ICC cases to proceed with the project launch, with ML/FID and thus construction awaiting this closure. I just can't see the DRC government accepting that delay given the strategic nature of the project and FT's trumpeting to the heavens of his EV battery development plans. Following the verbiage released in the latest ministerial decrees about the project being held hostage due to the ownership disputes within Dathcom, this shot-across-the-bow was I think setting up the grounds for a potential outright stripping of the licence by the authorities in the national interest, should this look like it will drag on for an extended period without resolution. Or at least the government trying to promote some path forward, with a warning attached to reinforce the message.

Hopefully IMO we can at least use the likely outcomes of the ICC cases as the basis for a negotiated settlement that can move us all forward which, whilst unappealing, would at least reduce the likelihood of an outright AVZ collapse. Yes this may all be part of the Chinese plan, pushing us towards a deal as the lesser of two evils (which they are very good at), though the risk of a negative outcome for AVZ remains real. I dont really buy into the claim that the DRC won't dare oust us due to the message this would send to the wider international investment community. If they feel they need to in order to get the project moving, they will, and can present their national interest justifications until the furore dies down.

In any case I think we wouldn't necessarily be in a particularly bad position in a negotiation. We could probably reach an outcome which may satisfy most shareholders, paving the way to the resumption of Manono's development, though definitely not one that would please all here. I hope the email posted here that management were in the midst of negotiations is in fact the case, and that some sort of middle ground in weighted favor to AVZ could be found in the near term. Even though the government is largely at fault for our current predicament through its corrupt ministers supporting the hostile Chinese agenda, the wider government's 'patience' to leave Manono undeveloped probably also won't last forever, especially with those Chinese interests still being represented faithfully by the key actors we all know. FT doesn't seem in a rush to intervene either, so may be down to us.

The money was paid directly into Dathomir's bank account between the 16th and the 25th of August 2021. I'd imagine the escrow is being held by AVZ's lawyers or an independent third party lawyer and they were the ones that transferred it to Dathomir. Probs why that transaction was redacted in the interview with Christian Lukusa.

Dathomir returning the money to the account it came from is in itself acknowledgment of receiving the payment. I doubt it was Cong that organised the transfer to himself less than one month before the 12 month deadline for the second 10% agreement only to send it back around a week later. If he did he is even more cooked than I thought. More likely this was the final step of the contract obligation and Cong sent it back because he realised this meant the deal was complete imo

Cong's main argument is that he cancelled the agreements in May 2021 before he received the money. AVZ's argument is that we completed the transactions within the time frame by paying Dathomir into their nominated account. I'm not sure if that is the escrow or the bank account but I reckon we would have seen the escrow bank statement rather than Dathomir's bank statement in the video if that was how it was meant to be paid.

The next documents shown in the interview video appear to be an EGM confirmation for Dathomir regarding the contract for the 10% deal signed by Cong and the notary deed confirming this transaction is 'the expression of Dathomir's will'. The notary deed is crucial in contact law as it leaves no doubt that the party intended to be bound by the contract.

The EGM confirmation of the contract doesn't specify an account to be paid but it confirms that the agreement was signed on September 16th 2020 and that the transfer of the 10% of Dathcom to AVZ will be done on the 'date of execution'. AVZ's Q3 2021 quarterly is the first mention I can find of AVZ having completed the acquition of the 15% from Dathomir and holding 75% of Dathcom which management say was completed in August 2021.

Well you seem a lot more on top of it that I am, I'm only coming to assumptions based on what Nigel said.
Should have stopped listening to him years ago tbh.

When you click on that link in your post now Carlos, a YouTube clip of Mills Tshibangu comes on…. He he is one of the Twitter posters who have been criticising (if not trying to undermine) AVZ.

He is giving AVZ a right if reply via Christian Lukusa and it seems our attorney is doing a good job presenting the facts!

Getting a bit tired of watching all the translated sub titles but excellent to see Marius’s interviews being followed up by Lukusa’s

@Spikerama it looks like it would be an excellent time to post AVZ’s achievements to back up these interviews and just focus any criticism on Cominiere, Zigin and Dathomir’s illegal actions

Christian also mentioning how much money the DRC is losing every day by CAMI not granting our ML so obviously that moving graph of yours is an excellent reminder

Nice to see our representatives in the DRC doing a good job….

At the end Mills Tshibangu says the President is following this file and then Mills goes on to give praise to the MoP

A lot of people want justice, I’ll be happy if Felix gives us full ownership and the ML, but no doubt there’ll be others that won’t be happy until she goes…. Shareholder’s need to be realistic, it might not happen

Mills goes on to say that Felix wants further negotiations because he wants the DRC to get more out of it…. so hopefully we won’t get the continued winging about Nigel and the BOD when it’s obvious it’s the DRC politicians that are fucking us around

Fucken quiet in here tonight

Just had another look at that video I watched last night from Carlos's post and realised it was actually a right of reply interview with Christian Lukusa from 21/02/2023 so it was over a month ago and before the recent two Marius interviews.... It does at least tell us that Felix is well aware of our file

Fuck I hate wasting my time on fucken bullshit, especially when I want time off here

Perhaps might be a bit more effective in French to put on twitter?
If you feel like doing the hard yards I find a good process is to translate to French and then back to English to make sure it still makes sense, if not it then needs to be adjusted until it does. I'm only saying that because I cbf doing it myself right now & maybe you can't either... anyway.
I have a few posts on twitter and they're generally liked by a few shareholders, the real achievement is when some Congolese start liking the tweets and respond or retweet.

Thanks for the translation - I had a quick look over it without translating and assumed the MoM had been seized, in fact Jules was only seizing her attention to the report.
Yeah got to watch the translation from French, it's easy to misinterpret sometimes and particularly in brief posts on twitter.
