No. Nigel would not say that. Nigel would say that what YOU are saying is absolute rubbish.

Do you not understand that the proposal is for AVZ to sell its commercial interest in the project to Kobold? If this occurs, the ICSID arbitration will be ended completely. There will be no partial award. The funds to purchase AVZ's interests will come from Kobold. The DRC Government and Cominiere will pay nothing.

I don't think ICC will be ongoing. Once a negotiated settlement is reached I would say ALL arbitration is dropped. No ICSID, no ICC, no partial awards.

The arbitration was just a tool to get the DRC Government to the negotiation table.

and to be clear, it was Xerof who suggested the 39 plus million euro partial award related to ICSID, NOT me.

Yes i do agree the ICC cases will definately have to be dropped otherwise Kobold will be unable to proceed. My comment re the 39 million euro was based purely on your post i read and not within the context of your exchange with @Xerof.
I think we all talking about the same thing and the awarded amount plus sunk costs plus project value based on the DFS etc would all be part of Nigels negotiating platform in trying to come to a number perceived as fair value to both sides. As far as DRC and Cominiere not coming up with any cash yes i also agree but they sure as shit have to wind back a lot of the crap they have put in place to make the deal work. I reckon it is also quite likely that Zijin will be involved in the fair compensation to AVZ.
Everyone knows the actual real legal position here ie AVZ owns 75% of PR13359 and Cominiere owns 25% of which AVZ has FROR of 15 % of Cominieres holding. Kobold knows this, Massad Boulos and his team know this, ICSID knows this ICC knows this Zijin knows this , Cominiere knows this and Felix knows this.
This is definately a complex mess but fingers crossed the security for minerals deal gets signed of next weekend followed closely by the AVZ Kobold deal

With ICSID only suspended until 23-Jun, I suspect the AVZ-KoBold deal could follow swiftly after the peace agreement expected in the week of 15-21 June. Given this timeline, I’m not taking any chances—a few weeks ago, I resigned from work, with my last day set for 11-Jun. On the same day, I will transition my SMSF from accumulation mode to pension mode.

I had been planning to retire soon anyway, but kept delaying to wrap up everything at work. Now, with the imminent KoBold-AVZ deal, I finally have the motivation to stop postponing—especially since I’ve already delayed for too long.

Hi Slippery,
From what little we know I can only assume Kobold has thus far attempted to throw some lowball offers at us, perhaps around the AUD$1 mark per share plus some royalties at best. We can all only hope that Nige is negotiating for a much better deal than that, that is for at least ATH AUD$1.37min to also save any possible class actions against the board.

To me, I believe we have most the cards, even if it does involve going the long road through the courts, therefore we should push for US$1.50min or tell them a polite "No", they (or someone else) will then either eventually cave in to our 'fair price' or they wont get what they want and will have to sit there and watch us go through the courts for the next couple of years or potentially lose the resource to a higher bidder, and I think they want this bad enough to not let that happen.

Honestly it's just too hard to say atm, all we really know is Africa is as wild as it gets, and right now absolutely anything is possible. I think we've all been through too much drama over the last few years to sit here now and pretend that we know exactly what will happen

When you first blew in here, my first thoughts were that you were a little OTT.
Not for one moment did I suspect your agenda or motives though I 100% UNDERSTAND why others did.
I DMd one poster asking him to lay off you and why I thought they should and also in the interests of thread harmony. I did not necessarily think that they were going too far. No reply but I think they did wind it down.

Now lets get a few things very straight.
I am not a gatekeeper - nobody else is either. We are refugees from the crapper and have a tacit agreement to call out misbehaviour. It works extremely well, folks have apologised and for example some language has stopped as have girlie pics and some sexism.
I won't labour the point about the fantastic info', intel' and analysis that appears here on a daily basis.
Now it doesn't matter whether you, I or anyone else agree with this thread MO and the resulting decisions, that is what we have agreed to do and it has generally stoppped Crapper MkII, whilst maintaining humour and human interest.

So let's forget $121 as I presume Rio price was a joke.
Your prices vary between $1.38 + an undefined figure, and $3.41 which is almost 2.5 times as large.
What would you do if any reserve was not hit in the auction?

So yes enough of that.

What is not understandable is you outing grudges a year later.

Phew, just read the news of the LA riots, with US marines on high alert...WTF! And around the globe things are also escalating as Trump can't seem to take a trick right now.

The bright spot on the horizon is the peace signing ceremony in Washington. But boy, I'm holding my breath watching things going to shit real fast, hoping we can make these last few hurdles.

Yet super grateful AVZ is first cab off the rank, once the deal is signed. For that will be just the start of an incredibly difficult path for the US in managing the peace to attract western investors:

The credibility of the US minerals deal is uncertain. Much will depend on Washington’s ability to manage regional political tensions and convert high level promises into tangible investments.

Good luck with that because I'll be long gone by then, sitting in the sun telling the grand kids about our great escape. Phew.

With trade cratering we have nervous bond markets and historians looking for historic precedents that might hint at the economic future. For all intents and purposes, the US is finished (that’s a different discussion for a different forum) - my concern right now is the U.S dollar cratering hard and fast affecting our (USD-demonimated) buy-out.

The US$ ponzi scheme probably has a long way to go before collapse ( famous last words? ).
In times of financial turmoil, US$ usually strengthens.

Agree though, US is cooked.
