These words were uttered in July 1805 by Anna Pavlovna Scherer, a distinguished lady of the court, and confidential maid-of-honour to the Empress Marya Fyodorovna. It was her greeting to Prince Vassily, a man high in rank and office, who was the first to arrive at her soirée. Anna Pavlovna had been coughing for the last few days; she had an attack of la grippe, as she said—grippe was then a new word only used by a few people. In the notes she had sent round in the morning by a footman in red livery, she had written to all indiscriminately:

“If you have nothing better to do, count (or prince), and if the prospect of spending an evening with a poor invalid is not too alarming to you, I shall be charmed to see you at my house between 7 and 10. Annette Scherer.”

“Heavens! what a violent outburst!” the prince responded, not in the least disconcerted at such a reception. He was wearing an embroidered court uniform, stockings and slippers, and had stars on his breast, and a bright smile on his flat face.

He spoke in that elaborately choice French, in which our forefathers not only spoke but thought, and with those slow, patronising intonations peculiar to a man of importance who has grown old in court society. He went up to Anna Pavlovna, kissed her hand, presenting her with a view of his perfumed, shining bald head, and complacently settled himself on the sofa.

“First of all, tell me how you are, dear friend. Relieve a friend’s anxiety,” he said, with no change of his voice and tone, in which indifference, and even irony, was perceptible through the veil of courtesy and sympathy.

“How can one be well when one is in moral suffering? How can one help being worried in these times, if one has any feeling?” said Anna Pavlovna. “You’ll spend the whole evening with me, I hope?”

“And the fête at the English ambassador’s? To-day is Wednesday. I must put in an appearance there,” said the prince. “My daughter is coming to fetch me and take me there.”

“I thought to-day’s fête had been put off. I confess that all these festivities and fireworks are beginning to pall.”
“If they had known that it was your wish, the fête would have been put off,” said the prince, from habit, like a wound-up clock, saying things he did not even wish to be believed.

“Don’t tease me. Well, what has been decided in regard to the Novosiltsov dispatch? You know everything.”

“What is there to tell?” said the prince in a tired, listless tone. “What has been decided? It has been decided that Bonaparte has burnt his ships, and I think that we are about to burn ours.”

Prince Vassily always spoke languidly, like an actor repeating his part in an old play. Anna Pavlovna Scherer, in spite of her forty years, was on the contrary brimming over with excitement and impulsiveness. To be enthusiastic had become her pose in society, and at times even when she had, indeed, no inclination to be so, she was enthusiastic so as not to disappoint the expectations of those who knew her. The affected smile which played continually about Anna Pavlovna’s face, out of keeping as it was with her faded looks, expressed a spoilt child’s continual consciousness of a charming failing of which she had neither the wish nor the power to correct herself, which, indeed, she saw no need to correct.

The desperation of Tshedeski to get the minerals for security signed off to save his personal wealth and political position will enable the deal to go through.
Rwanda would have analysed the consequences of going against the military strength of US.
Would be absolutely foolish IMO.
Best to get some processing benefits from trade in critical minerals than be militarily overcome in short time.

The hard-working Thérèse Kayikwamba Wagner, former Minister of State for Foreign Affairs, and her colleague for Mines, Kizito Pakabomba Kapinga Mulume, along with the Chairman of Gécamines SA, Guy-Robert Lukama Nkunzi, are the three musketeers appointed by President Tshisekedi to negotiate the final adjustments to the barter deal, critical minerals for security, between the DRC and the United States.

Before the end of the summer, the sky of strategic relations amidst the mining transactions between the US and the DRC is unlikely to be clouded by a single cloud.

The three-headed special coordination body established by Fatshi's primary mission is to discuss each clause of the "minerals for military support" deal with the US administration.

To ensure its success, Félix Tshisekedi has strengthened the Kayikwamba-Kizito-Lukama coordination body with high-level legal experts, including Pascal Agboyibor, a partner at ASAFO & CO, internationally renowned for his expertise in the energy, mining, infrastructure, and project development sectors in Africa.

The coordination body will also be supported by a technical secretariat composed of 22 experts whose essential role will be to produce regular reports on the progress of the negotiations, as well as the results of the implementation of the agreement in preparation.

The state-owned mining company, Cominière SA, and the Mining Registry (Cami) are also among these technical experts. Within the civil society movement, fingers are crossed in the hope that "American contracts would not contain leonine and obscure clauses like Chinese contracts."

In the initial draft of Chinese contracts presented to the National Assembly by the then Minister of ITPR, the late Pierre Lumbi O'kongo, a certain Kabale, not otherwise identified, appeared in the notes like a hair in the soup.

Speaker Vital Kamerhe L.K. Kingi was unable to prevent elected officials from the opposition, then led by the MLC, from heaping more harsh criticism on Chinese contracts.

It took more than 15 years for the incorruptible Jules Alingete Key, then head of the IGF department, to return to the infamous contracts and force the consortium of Chinese companies (Sinohydro, Crec, and Afrexim Bank) to rebalance the financial package in favor of the DRC, with an additional US$7 billion allocated to road infrastructure construction.

As with the revisiting of the Chinese contract under the leadership of the IGF, Félix Tshisekedi insisted on transparency in the negotiations and compliance with the Congolese legal framework (particularly the mining code and regulations), as well as the certainty that the deal with the US, in addition to security guarantees, would also offer definite economic benefits for the DRC.

So, a win-win situation!

And according to analysts who spoke to Ouragan.cd, the presence of delegates from Cominière SA is justified by Mr. Tshisekedi's desire to offer the lithium mining operation in Manono, a 19-hour drive from Bukavu, to the American group KoBold Metals, co-owned by billionaires Bill Gates and Jeff Bezos.

KoBold has apparently convinced the Australian company AVZ to drop legal proceedings against Cominière and join the new pact.

KoBold is a young mining company that gained notoriety in 2022 by investing in the development of a copper deposit in Zambia.

"The company aims to harness new technologies, particularly artificial intelligence, to explore strategic minerals needed for the energy transition."

In 2023, its CEO, Kurt House, stated that the DRC is probably "the best place in the world" for the materials his company is looking for.

It's highly likely that the American firm KoBold would find imitators on Wall Street.


However, for many civil society organizations specializing in the extractive sector, Guy-Robert Lukama is considered the Albert Yuma of the regime, as he holds multiple positions and negotiates contracts considered as murky as those of Joseph Kabila.

And his presence among Congolese negotiators arouses suspicion.

The United States has targeted a wide range of minerals, which are, in fact, being swallowed up in other, better-known places, such as copper, cobalt, or lithium.

Since April 15, 2024, Uncle Sam has increased to fifty (50) the list of minerals it considers critical or strategic.

These are: aluminum, antimony, arsenic, barite, beryllium, bismuth, cerium, cesium, chromium, cobalt, dysprosium, erbium, europium, fluorspar, gadolinium, gallium, germanium, graphite, hafnium, holmium, indium, iridium, lanthanum, lithium, lutetium, magnesium, manganese, neodymium, nickel, niobium, palladium, platinum, praseodymium, rhodium, rubidium, ruthenium, samarium, scandium, tantalum, tellurium, terbium, thulium, tin, titanium, tungsten, vanadium, ytterbium, yttrium, zinc and zirconium.

All these minerals, if not their indices, are found in the Gecamines concessions.

Do you not understand that the proposal is for AVZ to sell its commercial interest in the project to Kobold? If this occurs, the ICSID arbitration will be ended completely. There will be no partial award. The funds to purchase AVZ's interests will come from Kobold. The DRC Government and Cominiere will pay nothing.

Hi Leah there has already been a partial award to AVZ . The amount of 39 plus million euro award was on 10th March. This is a part liquidation and the 50,000 euro per day penalty is ongoing. This was awarded by the ICC not the ICSID. At the moment ICSID is temporarily suspended but ICC cases are ongoing

I don't think ICC will be ongoing. Once a negotiated settlement is reached I would say ALL arbitration is dropped. No ICSID, no ICC, no partial awards.

The arbitration was just a tool to get the DRC Government to the negotiation table.

and to be clear, it was Xerof who suggested the 39 plus million euro partial award related to ICSID, NOT me.

Yes i do agree the ICC cases will definately have to be dropped otherwise Kobold will be unable to proceed. My comment re the 39 million euro was based purely on your post i read and not within the context of your exchange with @Xerof.
I think we all talking about the same thing and the awarded amount plus sunk costs plus project value based on the DFS etc would all be part of Nigels negotiating platform in trying to come to a number perceived as fair value to both sides. As far as DRC and Cominiere not coming up with any cash yes i also agree but they sure as shit have to wind back a lot of the crap they have put in place to make the deal work. I reckon it is also quite likely that Zijin will be involved in the fair compensation to AVZ.
Everyone knows the actual real legal position here ie AVZ owns 75% of PR13359 and Cominiere owns 25% of which AVZ has FROR of 15 % of Cominieres holding. Kobold knows this, Massad Boulos and his team know this, ICSID knows this ICC knows this Zijin knows this , Cominiere knows this and Felix knows this.
This is definately a complex mess but fingers crossed the security for minerals deal gets signed of next weekend followed closely by the AVZ Kobold deal

With ICSID only suspended until 23-Jun, I suspect the AVZ-KoBold deal could follow swiftly after the peace agreement expected in the week of 15-21 June. Given this timeline, I’m not taking any chances—a few weeks ago, I resigned from work, with my last day set for 11-Jun. On the same day, I will transition my SMSF from accumulation mode to pension mode.

I had been planning to retire soon anyway, but kept delaying to wrap up everything at work. Now, with the imminent KoBold-AVZ deal, I finally have the motivation to stop postponing—especially since I’ve already delayed for too long.
