The way I see that is they're talking about a technicality though.

The ICC will be making a ruling on the ownership dispute.
The outcome of which is only to say weather Zijin can use the ICC dispute process or not.
They are not ruling to make any ownership claims official.

So technically, no not game over, but I think we can all agree it pretty much will be.
If they cant get ICC to agree they own 15%, how can they hope to win that argument under any other official means?

I think I have done more work than anyone here proving Zijin's claims are bullshit and that Cominiere clearly violated AVZ pre-emptive rights to the 15%

But AVZ have made it pretty clear there could be further proceedings that determine whether the transfer of shares was effective. I don't think Zijin will give up that easily.

Have you seen Giddyup's post on the crapper re Dathomir? I must say I had noted that no EGM had ever been held for the 5% SPA, but my concerns were dissipated after their comprehensive comments in the response to ASX. Perhaps not as straightforward?

I read that and to be honest he sounds like he's weaving his text in a manner to sew doubt with very little real facts to back up the tone he sets.
There's something to it perhaps, but he's going to great effort to make it sound much worse and forboding.
It looks and smells like a Geist to me.

Agreed they'll do anything they can, but with an ICC ruling stating they don't own shit % in Dathcom now pinned to their faces, any future claims to the contrary are barely worthy of concern IMO.
Maybe they should sue Cominiere.

The answer to Giddyup's question about enforing Dathomir's intention to be bound to the contract they signed is the same as Zijin's reasoning for their ICC case about being recognised in Dathcom imo

I'm not 100% sure about how exactly AVZ will enforce their pre-emptive rights to the 15%. Most of the announcements about this matter referred to ongoing discussions with DRC government officials. My guess would be this is a violation of the Dathcom JVA and we will need to initiate ICC proceedings under Article 11 but clearly that hasn't happened yet.

@Roon feel free to develop this discussion. I was pleased to see Giddyup actually delivered on his thoughts quite comprehensively

It's a mess and there's no good way to bring clarity for them in a legal sense.
They could only use a DRC court to claim ownership if the DRC were saying they don't own anything.
So they use ICC to force AVZ to recognise them.

But if ICC rule against them, then they cant use ICC.
If the DRC tell them to fuck off, then they might initiate proceedings in a DRC court.
But if the Government have told them to fuck off already, DRC being corrupt as it is, there's no way a DRC judge will rule against the government, and I'm sure Zijin knows that.
Zijin has and will use blackmail to try to achieve their goals. Once you go dark, you have to stay there.
Which is AVZ's saving grace, being law abiding. (Cue heavenly choir voices)

Now with apparent support for AVZ by the government, and rightly so ffs, they're screwed.
They might be able to cause damage on their way out of course. And that's concerneing.

Yes by extension (secretly) they tried to blackmail cominière and green grub in the letter that was leaked and made public. This couldn't be looked on favourably in arbitration surely and hopefully can be used against them.
