My excuse, I've resumed my second job after 5 years not playing - gigs Friday and Saturday nights this weekend. Not those two guys - I'm on the left.

Got a cheeky Marshall for the lead/rhythm guitarist...noice (wonder if he matches a Gibson with that?)

Nice vintage looking kit for the drummer too. Not sure but possibly a Ludwig or Gretsch???????...mmmm

Both gigs went well, Wino. I have a couple of nice vintage basses but that one's a Jap Fender that doubles as a defensive weapon for pub gigs. Gat player is a Strat man - that his small rig ... on Saturday night it was Laney head + Marshall quaddy. Not the drummer's kit - that's a house kit because the load in is a bastard down a narrow flight of stairs.

At my age I'm a bit out of practice with the late night side of things, so getting home sober at 3am two nights in a row was a shock to the system. The Friday night was a 4 setter so it was a tough initiation back into gigging after a long break.

Here's a short vid from Friday night - the crowd were into it for sure ....

Sparrow, this is a huge battle win for AVZ in this long drawn out war

ICC are basically saying to Cominiere that any attempts to follow thru with their actions ( termination of Dathcom JV ) plus 15% transfer to Zijin, will result in them getting punished 50k a day until final deliberations are made by ICC.

Cominiere also has to pay emergency court costs as a result.

Its a BIG FUCK YOU and more than likely precedence to a big AVZ win down the track.

Over to you Felix .............get some common sense together ASAP before your country gets even more embarrassed via the international community!!

I know what you mean at our age on the late nights and staying sober 'cause you have to drive your gear home.....ouch

I did 3 nights at the Fringe in Adelaide and it took me a bloody week to recover!!

Would AVZ if/when victorious in ICC cases and granted license etc. pursue compensation against Cominiere for stalling and also defamation for blatant, provable publicly-stated lies about AVZ over the last year? And if so would todays ICC ruling prompt Cominiere to ‘throw in the towel’ to avoid having to potentially pay [further] damages in future?
Great to finally see things starting to happen.

We already had the phone call released, only Zijin would have done that as a threat.

So IMHO CKK and whoever else is being blackmailed by Zijin, will never give up causing trouble for AVZ, because Zijin will expose them if they don't.
And since a government minister is implicated in all this, it just makes it all the more difficult to resolve without it being obvious to the world, that the DRC government are utterly corrupt.
That IMHO is why we havent seen any decisive action yet.
It's a huge mess, and china is holding the DRC's face to the hot coals.
But as much as we want to despise china for what they're doing, it's actually the DRC who allowed this to happen.
However the DRC is a victim of it's past, so its not really their fault, change takes a long time.
It is what it is, and we chose to risk our money in this place. 🤷‍♂️

It's so glareingly obvious what's going on, everyone sees it.

But it's just my opinion, who really knows man.

Was about to say something very similar.

Would add that Com./CKK will probably be offered immunity (if this falls our way) to spill the beans and save government face/demonstrate a clean up prior to the election.

The potentia fly in the ointment is their glorious leader's visit to the home of corruption.

On 24/4/23 Reuters reported :
An adviser to Democratic Republic of Congo's President Felix Tshisekedi, who requested anonymity as he was not officially authorised to speak on the subject, told Reuters that the negotiations should bring "around $2 to 3 billion" to the country.
He added that Tshisekedi is expected to travel to China in the coming weeks "to seal the renewal of Chinese contracts".


Does anyone know if Felix is still going to China in May? Will Manono also be on his agenda? Hopefully he'll say "force Zijin to renegg on purported purchase of 15% from Cominiere".

Apologies for being off topic, has anyone had a market valuation report done for the financial year 22 by an independent valuer? If so who did you use? My SMSF auditor has requested one for my AVZ shares & I'm not having much luck finding someone. Any help would be greatly appreciated.

Dont think Cominiere are meant to hold any shares long term. Once the ML was given they were to find a buyer for 15% and transfer the remaining 10% to the Government as per the DRC laws.

The right of first refusal relates to the 15% Cominiere sold to Zijin

Under the right of first refusal in the JV agreement AVZ had to be offered the opportunity to purchase that 15% before a transaction was undertaken with any other party

If an offer was made by Zijin to purchase that 15% Cominiere had to advise AVZ under the terms of the JV agreement so that AVZ had its ROFR respected....ie AVZ had to be given the opportunity to purchase that 15% before anyone else could undertake that transaction

IF AVZ chose not to purchase the 15% and advised Cominiere of such then under the terms of the JVA Cominiere could enter into the sale transaction with another party

If I've got that wrong in any way happy for any of the legal eagles to provide clarity

Yeh I know. But I mean the 24% AVZ plans to sell to CATH.
Ive seen counter arguments that AVZ have no right to sell it to CATH and must offer it to other JV partners first.
I can't link any references, it's just things I've read long ago and apparently one of the arguments raised by cominiere?? Perhaps the reason this 24% CATH deal keeps being postponed, idk

Interesting, if so then Cominiere is really in the shit. If Zijin lose ICC case they can still expose corrupt players to save face/deflect blame. Everything for them both is really riding on illegally kicking AVZ out of the project, which they’ve failed to do, or Zijin winning the ICC case which is only really feasible if they can bribe the arbitrators.

Best scenario for them both imo is back off and Cominiere get a deal done with AVZ, Zijin out of project but can still demand their money back from Cominiere through blackmail - and then once payed they both move on like it never happened lol
