They wanted a no ML discount below the all time high like Jens was suggesting which would open possibility of class action against bod without key legal cases (particularly Dathomir) being resolved imo
I guess we have our starting point . Kobold throw in a low ball offer . Next!

1. If Kobold want to get in early and pre-empt the legal hearings then they need to pay for the privilege. ICSID claims are a FLOOR.

2. If they don't the run the risk of losing it to CATH - and rightly so as CATH are the ones that have stumped up the legal fees and agreed to fight in our corner. Taking a stake in Green Lithium holdings ties their incentives to ours, same can't be said for Kobold.

3. Why is Graeme Johnston commenting on this at all? I would not have thought X would be the appropriate forum for the company to be making any sort of comment on these actions, and if they were I would not have thought GJ would be the right person to make them....

It's an odd comment.... but I still think Kobold wouldn't have gotten the ball rolling with this if they hadn't already decided they wanted the resource. They want it because they know the long-term value of it, and they aren't going to lose it to the Chinese just because they tried to low-ball AVZ

’Legal actions in the DRC’ is a very interesting comment for a guy facing 3 years in a Congolese jail if we don’t win against Dathomir at the ICC or Cong doesn’t admit the SPA’s were completed correctly imo

I agree its not a good look GJ is responding this way but I think that AVZ leadership want to let all interested parties know that the fight for the project's ownership is continuing to be relentlessly pursued. Keep in mind the Yanks can be just as ruthless and cut-throat as the Chinese. Last thing we need is Kobold thinking its more cost effective to pay 500Million in snacks to steal the south than pay 12 Billion for potentially the whole thing. They need to know that if they do they will be taken all the way to the supreme court in the US (if AVZ has the $$).

I’m a holder and hoping for a good result but truth is DRC is corrupt and Australia has zero leverage.
And, in any case, why would Australia be enthusiastic about helping a lithium project in DRC that will produce a large amount of lithium supply for China and undercut Australian Lithium producers?

Part of the opposition's 'delay delay delay' tactics, I feel.

Perhaps Zijin are suggesting to do anything they can to drag the proceedings to the right..Gives them more time to establish 'their' mine on the northern tenement area as a fact on the ground, and perhaps time for the talked-about deal with the US to potentially flop, getting them and the DRC a better strategic environment to address their inevitable loss than that currently percolating

Maybe I should attach the vid to my third correspondence to the senator the hon Penny Wong (aka Red Penny) when I remind her yet again that she has failed to respond in a meaningful way to any correspondence going back to 2022.

The only conclusion that I can draw for he failure to respond is that she and her department have a lot to hide.

Based on what you’ve shared last week, I spoke with one of our fellow SH members, who initially considered raising this issue in his interview with 4BC Radio Brisbane. But then we decided against it for now, as it might come across as government shaming right before the elections and possibly harm our cause as we are not sure if BoD is in favour of such move.

Though we haven’t dropped the idea completely. We may create a short video to name and shame officials who have failed to support Australian assets and businesses.

100% my own bullshit theory, but here’s what might be going down:
  1. Months ago, Kobold made a low-ball offer for the South, implying to AVZ that they didn’t have the funds to see the ICSID case through—essentially asking, why take the risk? It was a classic test-the-waters move, but AVZ swiftly rejected as they had other deals in the background.
  2. Now, with CATH in the picture, Kobold is back at the table, strategically planting media narratives about a deal being in progress. The goal, to pressure the Trump administration, the DRC government, and AVZ shareholders into playing ball and putting them in the picture for a longer term deal.
  3. The supposed deal is for the South only, requiring AVZ to forfeit any stake in the North. To Nigel, this was completely unacceptable, even if the price for the South was good, walking away with zero compensation for the North wasn’t an option.
  4. At this point, it’s a game of chicken. The DRC government must decide: do they risk the ICSID case ruling in AVZ’s favor for the North exposing themselves, or do they open themselves up to potential litigation and backlash to powerful individuals from Zijin—justified or not?
  5. For now, they’re taking a back seat, following protocol, and letting ICSID decide. If AVZ wins and regains its rights, the play is clear, strike a deal with Kobold for the South, while Zijin is forced to compensate AVZ for the North.
  6. Nigel has decided with all the fuckery from all sides, and no genuine offer of actual value on the table, the best course forward is to proceed with the ICSID to put an irrefutable value and compensation claim in place which can anchor all negotiation.

Exactly what I was suggesting in an earlier post

Didn't even think of the financial side for the Govt but you are correct could have been a huge generator of corporate tax revenue

NF has repeatedly said that we may have to forgo the North, and brushes it off as not a big deal due to the Mica
