That article will be good news (ML granted in October) and Zijin to be included subject to ICC arbitrations (which they will lose badly) - might be all systems go upon receipt of ICC outcome?

Anyone undertaking work prior to AVZP commencement of refurbishment will just lose any time/$ investment made there as they will have no legal recourse imo.
You bet, but that’s not their game. They’ll initiate legal action to recover their costs - all at a reasonable price of course. But it’s not about the cost - it’s all for the delay and generally fucking us over reasons.

Hitachi Energy were out at the Piana Mwanga power station quoting on refurb last October (2022)
Their employee posted on twitter about going there for the work / quote.
If turbines are were removed illegally , very good chance they are doing the work
AVZ management could send them a polite letter , that their client that engaged them has no right to do so, and return the turbine
Its unlikely to have left DRC yet , AVZ also got quotes from GEC but work had to be done in Germany for re-wire.
Would imagine the same for Hitachi as the expertise is not in country

I can't speak for what's happening on the ground now but the Mpiana Mwanga power plant was returned to the Congolese state because Cominiere hadn't touched it in over 30 years. Another court battle I'm confident we can win but will just add to the delays. Sorry for the image quality on the decree but I don't have a better copy.

I would expect us to see an AVZ release addressing the Mpiana-Mwanga issue in the coming days, given the serious impact it would have to our plans as per DFS should we lose the ability to control this power facility. Another legal action inbound? I suspect so.

As I've said here many times my only interest is the truth. It's been almost 18 months and literally every document uncovered backs AVZ's position. My loyalty to AVZ's board comes from that fact and if there was evidence proving wrongdoing by them I wouldn't waste my time here anymore.

Zijin are about to get bitch slapped at the ICC. Cong is bound to the SPA's under every precedent of contract law and Dathcom passed every fucking hurdle in the mining code for the mining licence. If there was any dirt on AVZ we would have heard about it by now.

You parasites have nothing but brown paper bags and you know it

We shouldn’t have to rely on Twitter feeds. Nigel and our BODs reps should be on the ground right now. They should have at least one team member living on site. That’s what we pay them for. They suck down our cash and don’t employ anyone to be on site!! Just award themselves bonuses for sucking their own cocks.

Agreed we should have an $avz presence on ground - not pleasant but it's their job? Nigel and Ben in Kinshasa no doubt which is still a shithole i'd imagine. Not sure Graeme has been in country in several years? Michael Hughes used to be onsite and physically stopped a few Zijin fuckwits with a bulldozer, then he left the company for whatever reason.

So i can confirm Katamba is refurbing the hydroplant. It is the typical DRC operational model, where everyone disagrees to the ownership of some asset, and Cominiere just does whatever the fuck they want........

In reality, I don't see an issue with Cominiere and Zijin jumping the gun and starting on the refurbishment - the entire issue is a line of dominoes in my view.

After we win the jurisdictional ICC challenge, all the other ones with ZJ then get withdrawn (Confirmed withdrawal if Arbitrator rules in our favour), i'd say we follow up to provide irrevocable evidence on collusion between Cominiere and Zijin.

All their fucking JVs imploding would be the next step i think (with the icc case, the evidence for collusion cannot be ignored). Then we just legally reclaim the hydroplant with whatever halfassed refurb those cunts already did.

Nagging in the back of my mind similar to the split for north, but its all irrelevant and just more noise to distract from the actual first domino.
