On another note the up coming ICC .
I'm I right to assume that if it is proven Jin Cheng does not have the right to Instigate the ICC arbitration proceedings against AVZI as it is not a shareholder in Dathcom as conclusive evidence shown and proven that the 15% was an illegal sale by Comminiere.
What happens then to the 15% .
Will it revert back to Comminiere or will the state take control ?

According to AVZ whether the sale of the 15% from Cominiere to Jin Cheng was effective will need to be determined in separate proceedings. What that looks like I'm not 100% sure but my guess is we would need to initiate a dispute under Article 11 of the Dathcom JVA at the ICC about whether Article 9 of the JVA was followed during the purported sale. We did begin proceedings to have the sale reversed within the DRC but withdrew our action because it was taking too long.

We have probably been prevented from filing our own claim on this matter at the ICC so far because of the Jin Cheng vs AVZI case. Although the precedent from the current case will make any future hearings on this matter a slam dunk if it goes in our favour especially considering the court is looking at factors like the IGF report.

Slam dunk indeed as according to IGF report Dathcom legally hold 60% in the project now and with majority ownership meets the requirement for ML to be issued.
75% once S Cong issue resolved.

Not completely sure but I don't think so. I remember Nigel saying something about the DRC 10% being ceded after award of the ML. There's nothing in Article 9 of the Dathcom JVA about waiting until after the ML and we transferred the 15% from Dathomir back in 2021 upon completion of contract terms so unlikely Cominiere's extra 15% would be treated any differently.

Yeah I don't hold LTR but it shows how strong the market is for lithium deposits. Also shows the value in holding firm against initial takeover offers to get a better price. No doubt Nigel and the team at AVZ are taking notes considering the significant difference in the metrics of each project.

From memory, Albermarle intially offered TO of LTR around 2.50 - 2.60, which was swiftly rejected.

So LTR bod holding out for a measly 20% extra and accept ?....

They sold out their shareholders for cheap, whilst stating they were going to production and beyond .....

Offer in March was for 2.50 which was a 63.9% premium to last trading price at the time and came after 2 previous offers had been rejected and not disclosed to the market

So Jin Cheng postponed the last hearing about 1 month before the scheduled hearing date - we should be hearing from them very soon with another excuse. It will be "early October" in a months time. I hope there Is a massive penalty for postponing/cancelling an ICC case close to the hearing date?
