Looks like the MMCS case is a non event, unless Cominiere didn’t give MMCS the formal notice to perform within 60 days in the event of serious & persistent non performance.





1/3 COMINIERE/MMCS 2013 contract:
19.3. Termination by COMINIERE

a) In the event of serious and persistent non-performance of one of the provisions of this Contract by MMCS, COMINIERE will give it formal notice to perform, as the case may be, within 60 days.

b) If at the end of the formal notice, MMCS has not remedied the non-performance of its obligations, COMINIERE will have the right to assert the provisions of article 82 and following Civil Code Book III.

c) The expenses incurred by MMCS to carry out the Study of the Feasibility remains his exclusive responsibility and the Feasibility Study becomes his property. MANOMIN must transfer to COMINIERE the titles and mining rights on the Property without financial consideration and MANOMIN will be dissolved and liquidated.

I dont frequent HC much at all these days, except tuning into respectful threads to garner knowledge then i might tune in to AVZ for a laugh, what a complete rabble, cess pool infested, a complete waste of time that thread, absolute chalk and cheese when compared to this thread, despite all the roller coaster emotions ( stress, fatigue, anger, bewilderment ), AVZ TSE still provides excellent intel ( right or wrong ), we stilll have a sense of humour, we still have a vent, we still have hope.

Its extremely commendable and we need ALL of that to continue if we are all to remain sane in 2023........

Twelve Congolese civil society organizations and platforms, in a statement released on Friday, January 13, called on the Congolese authorities to mobilize all around to settle the financial dispute that exists within the Société Commerciale et Minière du Congo (COMINIERE).

Indeed, a hearing relating to this financial dispute was scheduled, on Monday, January 16, at the International Court of Arbitration in the French capital, Paris.

"Our consortium calls on all Congolese parties involved in the resolution of this case to show patriotism, diligence and mobilization in implementing the Head of State's vision on such issues before it is late," reads the statement of these civil society organizations and platforms.

At the same time, they claimed to have retained some convincing facts relating to this case, including, among other things, the arrest of Acting Director General Athanase Mwamba by the courts, which is confirmed by this institution of good governance of the State; the request for the postponement to a later date, of the public hearing scheduled for Monday, January 16, by the Technical Director of for a while for reasons to be discovered by the Government of the Republic.

In addition, to settle this dispute, these civil society organizations and platforms have reminded all Congolese stakeholders, particularly the COMINIERE and the Ministry of the Portfolio, that international arbitrations, such as that on Congolese Lithium, now sought by everyone, cover billions of dollars and the fees for first-class firms that master the files are set at several million dollars; and, the procedures often last several
