Guess who the cat dragged in. My interpretation is that our X Lawyer saying that things went pear shape because Nigel would allow agreements to be re-negotiated at the expense of AVZ.

Based on auto translate he claims:

1) After AVZ bought their share of the project and completed the feasibility study the Congolese wanted to renegotiate the price they'd previously accepted and wanted AVZ to share the project with a bunch of other companies. I interpret this to mean dividing our project amongst others who wanted ongoing payments rather than just a once off extra payment. Head of CAMI used to do this, nothing got approval unless a few percent of the project was given to a minor company owned by someone he controlled, allowing him to skim profits from the project every year. AVZ refused, problems follwed.

2) He says the escrow account (that he neglects to mention he controlled) was used to bribe Congolese officials in an attempt to obtain our mining permit. If our own lawyer was making the claim that certainly explains the AFP raid. Not saying I believe him mind you, I figure he stole the money, aligned with Cominiere, and spun that story to try and deflect justice.

He speaks in such a way as to say that AVZ were bad because they didn't share the project with a bunch of other companies that wanted a slice after AVZ paid for their shares and bore all the costs proving up the resource.

These other companies had no part in the process and only turned up once the project economics were known. My guess is these other companies were just shells existing only to skim profits for politically connected Congolese.

My impression from the way they speak is they both think that's how things work. That these other companies were entitled to a slice and AVZ were in fact bad for not sharing. There's mention of how strict AVZ was in their corporate governance as if that's a bad thing. They also say that whenever AVZ met with the Congolese there was s policy of always having at least four representatives from AVZ present.

Sounds to me like our board tried hard to avoid being incriminated by conduct the people they were dealing with expected as just part of doing business in Congo. When they didn't get their expected slice the Congolese turned coat and screwed over AVZ all the while thinking themselves justified.

You could reply to the Minister of Mines querying how he expects any international investor to trust the people videoed in the room with billions of dollars and show him this video


As @Carlos Danger says, that video with Lukusa and Mills Tshibangu is old. Tshibangu released a lot of video interviews in the past, all full of bullshit

A few things I’m pretty sure of is that the DRC is really desperate for foreign investment and assistance with security from the US, and they are going out of their way to convince other countries they are endeavouring to clean up their mining sector and show it is transparent and has good governance.

The US is also desperate for critical minerals and has already committed billions to the Lobito Corridor to transport critical minerals back to the US. My thoughts have always been to expose the DRC corruption to put pressure on them and I still think it’s the only way to get what we are owed

You can however, use 'DRC' and 'lying, thieving, goat-fucking clowns' in a single sentence provided it's predicated with the phrase fuck off.

When I read @Rechnerhand post on Zijin’s reply (after Kibeya’s previous reply) it just reminds of their lies and attempts to cover up their corruption.

I don’t know for sure, but it seems Nigel is going via the legal and moral channels of using DLA Piper, taking their advice, being open to resolving our ownership rights through constructive discussion with the DRC government and letting the ICC and ICSID findings answer the questions posed by the BHRC and others.

As I said before, shareholders don’t have to abide by those limits, aside from the ICC and ICSID, we are the only ones actually putting the truth out there and calling out the corruption, and fortunately we’re not going to stop until we get paid out.

The more we post on their corruption, the more lies they have to tell to try and cover it up, and the more evidence the ICC and ICSID have on them.

The only thing I would add to your comment about predication, is that our comments should be followed up with this

That's a key part of Japan's entry into WW2. I don't recall much of what I learned on the subject but I think their coal supply was being restricted. Could well be something
From memory of history class Australia cut supply of iron ore to Japan as they were using it to build war ships and the like and they were increasingly seen as a threat.

Your recollection of the subject is better than mine. Professor Google mentions US sanctions particularly affecting oil, iron, and rubber supplies, all critical to their war effort against China.

Now we have US supply lines for minerals critical to the manufacture of tech components required to produce modern weapons. Sounds like history echoing.

We should probably hope the US can secure their critical minerals supply. Maybe our next T-shirt run ought to be "Vote yes on Greenland".
