“AVZ has triggered this action.
We encourage AVZ to show greater cooperation with other Dathcom shareholders,” said Ms Chen Chen, Zijin Mining’s in-house legal counsel.

“It is regrettable that AVZ has caused the Manono project to stall.
Zijin will continue to work closely with relevant parties to progress the development of the Manono Project, to the benefit of local DRC communities.”

AVZ’s board ordered DLA Piper’s review on June 2 after being alarmed by Mr Ferguson’s authorisation of the “base” $US1 million cash payment and proposal to offer an additional $US5 million in cash and shares as a “success” fee to Mr Mihigo if he helped AVZ successfully obtain a mining licence.


By June 22, DLA Piper advised AVZ’s board to reject the plan to offer an additional $US5 million to Mr Mihigo, with a conclusion Mr Mihigo was acceptable as a consultant after ordering a specialist risk assessment. DLA Piper also recommended the $US1 million cash payment to Mr Mihigo is properly documented.
