The outcome of World Bank projects in the Democratic Republic of Congo was at the center of discussions on Tuesday at the Cité de l'Union Africaine between a delegation from this institution and the Head of State, learned on Wednesday June 21. 2023 ACP Presidency.

“We discussed the partnership between the WB and the DRC. It is a growing partnership.

We discussed ways to ensure that all ongoing projects in the DRC can lead to positive results for the country,” said World Bank Vice President for Eastern and Southern Africa, Victoria Kwakwa, and head of the delegation, on a working visit to Kinshasa from June 17 to 24, 2023.


She acknowledged that the DRC is facing a situation of insecurity marked by armed conflicts and especially Rwandan aggression, via the M23, thus preventing it for several years from taking off properly or making its growth visible.

"Thus, to support the stabilization and development efforts of the DRC, the Board of Directors of the World Bank approved last year a new country partnership framework, running from 2022 to 2026", recalled a source of the Presidency.

“This instrument should support the Congolese government's strategic priorities and important governance reforms,” she added.

World Bank suspends $1bn worth of project funding in Congo​

The World Bank has suspended funding for humanitarian and development projects in Democratic Republic of Congo worth more than $1 billion after the government dissolved the project fund without warning, the lender said.

The suspension will affect more than 600,000 beneficiaries, including victims of sexual violence, the World Bank told Congo's finance minister last week in a letter seen by Reuters. A World Bank spokesperson confirmed its authenticity.

The letter also said that the bank was still waiting for documentation on the status of $91 million which had already been advanced for the projects out of the total $1.04 billion.

On May 4, Congolese President Felix Tshisekedi dissolved the structure, the "Social Fund of the Democratic Republic of Congo", by presidential order and created another public fund.

The change was due to "the evolution of the legal framework governing public institutions," according to his statement.

In the letter dated May 12, the World Bank's director of operations for the country, Albert Zeufack, said the institution had found out about the decision in the press.

"Before being able to continue to commit the project funds, the government and the World Bank should agree on transitional measures... in order to ensure that the funds are used for the intended purposes," he said in the letter.

A spokesperson for Congo's finance ministry said he was waiting for the go-ahead from the presidency before he could comment.

Presidential spokesperson Tina Salama denied any suspension of funding and said there would be transitional management of the fund. "I think arrangements have been made," she said. She did not respond to questions about the $91 million.

One of the fund's beneficiaries was the Panzi Foundation led by Denis Mukwege, a Congolese gynaecologist who won the 2018 Nobel Peace Prize for his work with victims of sexual violence.

"It's a catastrophe for the victims," Mukwege told Reuters. He said he had been warned a few days before that expenses incurred on his programme would stop being reimbursed. A programme coordinator said that he had had to turn victims away.

The abrupt decision to change the financing structure was an example of poor governance, said Valery Madianga, the director of a Congolese organisation specialising in public finance auditing.
"How can it be ... that a public service, which signed a $1 billion programme contract with the World Bank, has been dissolved or has changed its social purpose without the latter being aware of it?" he said.

Four of Congo's main opposition politicians wrote to the leaders of the International Monetary Fund, the World Bank and the African Development Bank last week asking them to conduct an audit of their funds in Congo, saying they suspected misuse.

Corruption in the DRC remains, it's just under a different government


Why the DRC is a dangerous place to invest. The DRC government and mining sectors are rife with bribes, corruption and extortion. In the last two years alone, dozens of articles have been written on the corruption in the Congo by sources including NGOs, Civil Societies and mining and investment sites. These articles sound the alarm on the corruption in the DRC and its mining sector, including China's influence, mining fraud, money laundering, and extortion.

In April this year Media Congo released an article showing the Congo Study Group (GEC) and Ebuteli survey, with the Bureau d’études, de recherche et de consulting international found that the level of corruption has not changed. They found, in some cases the situation had got worse and that more than 77% of the public think that the country is affected by corruption.

In May this year the Frazer Institute ranked the DRC 82nd out of 83 countries for attractiveness to investors in the mining sector. Also in May this year, four of the DRC's main opposition politicians wrote to the IMF, World Bank and African Development Bank, asking them to conduct an audit of their funds in the Congo because they suspected misuse.

In June this year the DRC's own National Business Climate Barometer (BNCA) involving 403 companies gave it a 37% success rating. Also in June this year the DRC was excluded from the list of investments of the French mining group ERAMET, sighting corruption in the DRC.

In July this year, non-compliance and flagrant violations of the DRC Mining Code were reported and Congolese civil society organizations and platforms specializing in mining issues (Justicia Asbl, LICOCO, RND Asbl, POM, MDR, GANVE, CDH, ESPOIR ONG, RCEN, CERN / CENCO, TPRDC, MAX IMPACT) have all shown concern.

Also in July, an article in the Africa Report on 4 July shows that a bill for sanctions against corruption in minerals trafficking in the DRC has been introduced in the US. With the appalling working conditions present in the DRC mining sector, and extremely opaque business climate that exists throughout the country, the bill aims to counter these abuses and calls for sanctions, including asset blocks on persons found to have facilitated child and forced labour in the DRC mining sector "including any official of the government of the DRC".

But the corruption is not just in the government and mining sectors, it's in other sectors such as the legal system, administration, police and infrastructure just to name a few. The DRC's own Inspector General of Finance recently stated over 145 thousand cases of civil servants and agents of the state had committed forgery and massive fraud.

Pourquoi la RDC est un endroit dangereux pour investir. Le gouvernement de la RDC et les secteurs miniers sont en proie à des pots-de-vin, à la corruption et à l'extorsion. Au cours des deux dernières années seulement, des dizaines d'articles ont été écrits sur la corruption au Congo par des sources telles que les ONG, les sociétés civiles et les sites d'exploitation minière et d'investissement. Ces articles sonnent l'alarme sur la corruption dans la RDC et son secteur minier, notamment l'influence de la Chine, la fraude minière, le blanchiment d'argent et l'extorsion.

En avril de cette année, Media Congo a publié un article montrant le Congo Study Group (GEC) et le Ebuteli Survey, avec le Bureau d’Études, De Recherche et de Consulting International ont constaté que le niveau de corruption n’a pas changé. Ils ont constaté que, dans certains cas, la situation s'était aggravée et que plus de 77% du public pense que le pays est affecté par la corruption.

Nothing has changed in the DRC


International investors need to be aware of the corruption in the DRC business & mining sectors. The DRC invites companies to invest in projects & once developed, removes their rights & sells them to Chinese companies.

DRC state mining companies like Cominiere still operate under the protection of the government, which ignores & changes both legislative & contract laws and allows companies like Cominiere to steal foreign developer’s projects and licences.

The DRC lacks the finance and expertise to build projects, but wants a greater percentage of their earnings on top of collecting tax and revenue from them.

It’s international developers & investors who

1) Do all the work developing the projects
2) Know how to build the mines and infrastructure
3) Create the jobs for local workers
4) Arrange the finances for development and construction and
5) Pay the costs related to the first 4 points

Felix Tshisekedi talks about win-win contracts but wants control over the entire production chain of minerals from investment, production and processing, to the sale of the final product and wants to give state actors more power.

Now Felix is asking countries to invest $30 billion in its battery metals industry, saying it could be worth $7 trillion by 2040, adding the DRC wants to capture 30% - 40% of that value.

The most alarming feature to emerge from the 2023 DRC - AFRICA Battery Metals Forum was how much corruption there is in the DRC mining and investment sectors.

Dathcom’s mining license revoked. Now a proposed MOU with AVZ Minerals stalled because of an illegal deal made between Zijin and Cominiere with the help of Chinese backers who are trying to takeover the BOD of AVZ. The MOU was said to provide a pathway forward for the long overdue Dathcom mining license after AVZ spent more than 6 years in the DRC developing Manono.

DRC state mining companies have continued to operate under the influence of China, and under the protection of the DRC government, which ignores and changes its own laws both legislative (mining code), and contract law (JV), and allows state companies like Cominiere to continue to commit illegal fraud and steal a foreign company's projects and licences from them.

The DRC lacks the expertise and finance to build projects yet wants a greater percentage in projects earnings on top of collecting tax and other revenue from them.

AVZ Minerals legally acquired 75% ownership in Dathcom, followed the DRC Mining Code, legally paid for the Exploration Rights (PR13359) to explore Manono, and spent 6 years and millions of dollars developing the Manono project.

This included a Pre-Feasibility Study and a Definitive Feasibility Study that received a Favourable Technical Opinion following all legal requirements being fulfilled, including 7 Environmental Approval’s, Proof of Financial Capability and Favourable Cadastral Opinion.

This was followed by the Ministerial Decree to award the Mining License (PE) to Dathcom in April 2022 and was to have been followed by a Financial Investment Decision, Financial Close and the beginning of the project’s construction.

The Ministerial Decree to award the Mining License was granted in April 2022, but due to the illegal and fraudulent sale of shares by Cominiere to Zijin (outlined in the Inspector General of Finance's Report), the Mining License has been denied and AVZ Minerals has been removed from the tenement site on the CAMI Portal.

A recording of Celestin Kibeya Kabemba (Managing Director of Cominiere) has provided further evidence that he took a bribe from Zijin. The recording indicates that a price of $35million was negotiated (for the 15% in Dathcom who’s actual worth was $150million) and of that Celestin Kibeya Kabemba took a bribe of around $2million. The IGF report shows that the rest of the money was squandered.

Cominiere and Zijin aren’t the only parties complicit in this corrupt and fraudulent attempt to steal AVZ’s exploration and exploitation rights. Adele Kayinda Mahina (Minister of Portfolio) and Lisette Kabanga (now Chairman of Cominiere) were also involved in this illegal transfer of shares.

Simon Cong (Cong Maohuai - Dathomir) had sellers remorse after AVZ proved Manono’s worth and sought to influence the DRC Judicial System in an effort to revoke the shares AVZ Minerals legally acquired from Dathomir.

All these officials have acted with impunity under the watchful eyes of Antoinette N'Samba Kalambayi (Minister of Mines) as well as CAMI.

Cela comprenait une étude de préfaisabilité et une étude de faisabilité définitive qui a reçu un avis technique favorable suite à toutes les exigences légales remplies, notamment 7 approbation environnementale, preuve de capacité financière et opinion cadastrale favorable.

Cela a été suivi par le décret ministériel pour attribuer le permis d'extraction (PE) à Dathcom en avril 2022 et devait avoir été suivi d'une décision d'investissement financier, d'une clôture financière et du début de la construction du projet.

Le décret ministériel pour attribuer le permis d'extraction a été accordé en avril 2022, mais en raison de la vente illégale et frauduleuse d'actions par Cominière à Zijin (décrite dans l'inspecteur général du rapport de Finance), la licence minière a été refusée et Avz Minerals a été supprimé du site d'immeubles sur le portail Cami.

Un enregistrement de Celestin Kibeya Kabemba (directeur général de Cominière) a fourni des preuves supplémentaires qu'il a pris un pot-de-vin de Zijin. L'enregistrement indique qu'un prix de 35 millions de dollars a été négocié (pour les 15% à Dathcom dont la valeur réelle était de 150 millions de dollars) et de ce Celestin Kibeya Kabemba a pris un pot-de-vin d'environ 2 millions de dollars. Le rapport de l'IGF montre que le reste de l'argent a été gaspillé.

Cominière et Zijin ne sont pas les seuls parties complices de cette tentative corrompue et frauduleuse de voler les droits d'exploration et d'exploitation d'Avz. Adele Kayinda Mahina (ministre du Portefeuille) et Lisette Kabanga (maintenant président de Cominière) ont également été impliquées dans ce transfert illégal d'actions.

Simon Cong (Cong MAOHUAI - Dathomir) avait des remords de vendeurs après que Avz a prouvé la valeur de Manono et a cherché à influencer le système judiciaire de la RDC dans le but de révoquer les actions Avz Minerals acquises légalement de Dathomir.

Tous ces fonctionnaires ont agi en toute impunité sous les yeux vigilants d'Antoinette N'samba Kalambayi (ministre des Mines) ainsi que de Cami.
