AVZ Discussion 2022

Great news!
I'm guessing a pineapple is worth $5 (dunno 'cos never buy them). So that means that at 1c we're receiving 50,000% of the value of our shares.
Just hope there's not a glut which would lower the re-sale value.
Maybe a staggering issue will occur, actually I'm sure it will.
There's gonna be a lot of sore botties
Carrick gets 15 million of the fucking things. I knew he knew more than we thought he knew

Lots of long timelines in that update that can for sure be demotivating.

But lets remember the more likely outcome is still a negotiated agreement with DRC. Keeping the court cases going is our main leverage in that respect but I think it unlikely the DRC would let it get that far given they know for sure they don't have a leg to stand on.

Our leverage is the courts.
The DRC wants a compromise, and their leverage is time - ie a solution is found sooner than it would be through the courts.

Closer we get to the court hearing, the more the DRC's leverage decreases.
June 2025 9 months away. Lets round it up to a year for an outcome from the hearing.
By that point we also have outcomes on many of the other cases too.

After putting up with ALREADY YEARS of getting screwed around by the DRC, how much time leverage do you think it would require for AVZ not to see out the court cases? I'm not a lawyer or involved with any behind the scenes discussions, but after all this can you imagine AVZ making a major compromise less the 6 months out from the massive additional leverage of having ICC cases delivered in our favour? I couldn't.

All of that is to say, we have already waited a FK%&NG LONG time.
So there needs to be a LONG time advantage to warrant a compromise that would involve ceasing legal action.
Court dates are NOT ALL THAT LONG away.
So hopefully (with a Manono-sized grain of salt) a resolution is much closer.

Comments from debos hint that there's more going on behind the scenes.
Comments from USA officals have made their involvment and position even more explicit.
Fingers crossed.

Hopefully it is not something like: "the next ministerial shuffle is on the run" or "DRC want to attract Australian investors for mining operations" :D

Funny, we heard the same a few months ago and plenty of times before that too.

I'm surprised anyone would even voice this type of hearsay any more instead of simply keeping it to themselves.

DRC/China has lied, cheated and stolen from every angle. They have destroyed every promising development to date as well as stolen all of our assets, our prospects to restore the power plant, coming up to three years of our development time, the camp we built, the water, our core samples, $20 million out of the bank and the list goes on. People would do well to remember that.

Management have not even been able to secure the fabled MOU which we know from experience would mean nothing anyway.

The winky winky inside crew has been proven absolutely full of shit as they jump the gun time and again.

Other than the slow gruelling arbitrations we have absolutely zero official evidence of any remotely positive progress.

We can hope you are right but your vague assurance that people will be jumping for joy at some mysterious expected announcement 'in a few weeks' is irresponsible and frankly pretty irritating and offensive because a few weeks is a lot of time for everything to go wrong in the shit hole that is the DRC just as it always has to date.

As if you've been entrusted with some sort of privileged information even though you are clearly stupid and untrustworthy enough to go and blab it on social media. Get a life and some common sense

Same goes for all the desperadoes who can't process the actual reality of our situation.

And anybody who tells me you may have to apologise, you can fuck off because the point is that this type of self-aggrandizing posting is irresponsible and stupid in the first place. Plus anyone who likes it is also a fuckwit imo.

I liked geo’s post haha

He has usually been pretty spot on so let’s give him the benefit of the doubt for now

And that’s coming from someone that has stuck their neck out more than most to call bullshit on Chinese whispers and attempts to silence anyone with fair criticism of management or their messengers

Do you feel big and good about yourself now?

If that sends you into a spiral you might be best giving tse, x and hc a rest for a while....

Dunno how anyone can think an announcement is going to be positive now unless it’s 1. Getting your money back 2. Getting X amount per share.
Everything else is complete bullshit and the past two years proves this

Hey Lenny, what I make out of it is on the list you go for a free copy of Contract Law for DUMMIES with Cong and sydneyguy

You’re a disgrace to CA’s everywhere fat boy

Oh and by the way, that article you keep copy and pasting is wrong. ‘The clerk’ aka Papalas Musagi Wabulasa’s sentence wasn’t suspended it was cancelled as the appeal judge found that his conviction was not established 'in fact as in law' LMFAO

I can't recall seeing anything about GJ's appeal. Did he get the same courtesy as PAPALAS?

Need for immediate arrest stopped. Dathcom’s damages bill reduced from 50m to 25m.

This is now pending appeal to the DRC Supreme Court which is on hold while the ICC does its thing

Important to remember that this was a criminal trial and appeal regarding whether the creation of the updated share certificate was valid. Even the original judge repeatedly says that this needs to go through arbitration to determine the merits. His and the appeal judge’s view is that Dathcom should have initiated the arbitration rather than proceeding with the lodging of the share transfer instruments but they are both wrong about that imo

Anyone know approx the kind of coin $$$ we are going to need to get to the end on the legal process ? Will the DRC/China then have to pay AVZ legal costs once they get their arses kicked ?

How long is a piece of string!?
Award of costs will be determined on final resolution and depend on the strength of the oppositions' cases (as far as we all know extremely weak). We would likely get awarded majority of costs, but the lawyers will need to be paid along the way rather than all at the end (also subject to their ability to pay costs).

We were awarded legal costs last July I think it was, to the tune of 800k if memory serves me correct. Can’t say I’ve ever seen a cent of this come in on the books.
Even when we have a legal win and awarded costs they just ignore it. Have AVZ chased this money?
